The owner, lessee, custodian, or person lawfully in charge of any
real property may designate the City of Colonial Heights Police Department
as a "person lawfully in charge of the property" for the purpose of
forbidding another to go or remain upon the lands, buildings or premises
of the owner, lessee, custodian, or person lawfully in charge as specified
in the designation. This designation shall be valid only upon the
execution of written authorization on a form provided by the City
of Colonial Heights Police Department and approved by the City Attorney.
The Police Department shall keep any written authorization on file
and available for public inspection in accordance with applicable
law.
In all cases, the actual owner of the real property shall have the
right to change an officer's determination of "lack of permission."
Moreover, at any time, the owner may revoke his written authorization
by providing the Chief of Police with written notice of such revocation.
The Chief of Police, at any time, may terminate the agreement to act
as agent of the owner, lessee, custodian, or person lawfully in charge
for any given property by giving written notice of the termination
to the owner, lessee, custodian, or person lawfully in charge.
