A Law Library Committee is hereby established consisting of the Clerk of the Circuit Court of Colonial Heights, the Commonwealth's Attorney of the City of Colonial Heights, the City Attorney of the City of Colonial Heights and two members of the Virginia State Bar who have their principal offices in the City of Colonial Heights. The Chief Judge of the Circuit Court of Colonial Heights shall appoint said two members of the Virginia State Bar, who shall serve at the pleasure of the Court, and the Chief Judge shall also designate the person to be in charge of the day-to-day operation of the library.
A. 
Pursuant to Chapter 4 of Title 42.1 of the Code of Virginia, 1950, as amended, the City of Colonial Heights, a municipal corporation of the Commonwealth, does hereby assess, as part of the costs incident to each civil action filed in the General District Court of the city, the sum of $2 and, in the Circuit Court of the City of Colonial Heights, the sum of $2.
B. 
Such assessments shall be collected by the Clerk of the Court in which the action is filed and remitted to the Director of Finance of the City of Colonial Heights subject to disbursements by the City Council for the acquisition of law books, law periodicals and computer legal research services and equipment for the establishment, use and maintenance of a law library, which shall be open for the use of the public, and such disbursements may include compensation to be paid to the librarians and other necessary staff for the maintenance of such library and acquisition of suitable quarters for such library. The compensation of such librarians and necessary staff and the cost of suitable quarters for such library shall be fixed by the City Council and paid out of the funds created by the imposition of this assessment.

C. 
The assessment provided for herein shall be in addition to all other costs prescribed by law but shall not apply to any action to which the Commonwealth or any political subdivision thereof, or the federal government, is a party and in which the costs are assessed against the Commonwealth, political subdivision thereof or the federal government.
The public library of the City shall be under the general control and management of the City Manager, who shall appoint a Librarian to administer the day-to-day operations of the library.
The Librarian shall manage the library, employ staff for established positions, direct the activities of staff, prepare the budget in consultation with the City Manager, keep suitable financial records of the library, select and purchase books, library materials and supplies, prepare and release all library publicity, stimulate the growth of library service, and perform any other duty that the City Manager assigns. Before entering upon the discharge of his duties, the Librarian shall take the oath of office for the faithful performance of his duties.
All moneys received on account of or for the library shall be paid into the City treasury at such times as shall be prescribed by the Director of Finance. The Librarian or City Manager shall approve all vouchers and bills for the maintenance and operation of the public library, and no such voucher or bill shall be paid by the Director of Finance unless the same has been so approved.
Any person who willfully, maliciously or wantonly writes upon, injures, defaces, tears, cuts, mutilates or destroys any book, plat, picture, engraving, map, newspaper, magazine, pamphlet, manuscript, record or other public library property shall be punished as provided in Chapter 1, General Provisions, Article II, of this Code.
