A portion of the Township of East Caln shown on the map attached
as Attachment 1 to this chapter is and shall be served by the Downingtown
Municipal Water Authority (hereinafter referred to as the "Authority").
Any and all water users within the area served by the Authority
shall procure and purchase any and all water service from the Authority,
subject to the provisions set forth below.
The drilling, installation or use of wells for water service
is and shall be prohibited within the area served by the Authority
unless the use of a well is approved, in writing, by the Authority
upon application by a property owner for hardship relief.
Nothing contained herein is intended to or shall be construed
to require the abandonment of existing wells. However, should an existing
well cease to function or provide potable water, and cannot be remediated,
the property owner shall be required to connect to the available public
water system and shall not be permitted to drill a replacement well.
The design and installation of any connections, system additions,
service lines, pumps, valves or other facilities connected to the
Authority water system shall be subject to the approval of the Authority,
and all standards and materials utilized for such installations shall
be in conformity with the rules and regulations of the Authority in
effect at the time an application to connect is filed with the Authority.
Any and all applications for permits or approval for any and
all construction, improvement, development submitted to the Township
of East Caln within the area served by the Authority shall likewise
be concurrently submitted to the Authority via an Authority application
for connection and approval, and no permit or final approval shall
be granted by the Township without an approval of the water system
connection and water service from the Authority to the extent permitted
by law.
