No gasoline-powered or diesel-powered motor vehicle shall be operated on the streets, roads, alleys or highways listed below within the Township of Spring Garden, York County, Pennsylvania, utilizing, in said operation, an engine brake, engine suppression device or compression brake.
The streets subject to this prohibition shall be as follows:
A. 
State Route 3054, known as “Country Club Road,” beginning at George Street (SAR 3001) and continuing westbound to Richland Avenue (SR 3054).
This article shall not apply to emergency driving situations requiring the utilization of an engine brake to protect the safety and property of the residents of Spring Garden Township, other motor vehicle operators, pedestrians, and the operator and passengers of the motor vehicle involved in said emergency situation.
Any person or other legal entity who or which shall violate or fail, neglect or refuse to comply with any other provisions of this article shall, upon conviction thereof, be sentenced to pay a fine of not more than $1,000 and costs of prosecution, and, in default of payment thereof, to be imprisoned for a period of not more than 30 days.
