A grading or building permit may not be issued for any parcel
or lot unless the final erosion and sediment control and stormwater
management plan has been approved by the approving authority as meeting
all the requirements of this chapter and the Design Manual. Where
appropriate, a building permit may not be issued without:
A. Recorded easements for the stormwater management facilities and practices
and easements to provide adequate access for inspection and maintenance
from a public right-of-way;
B. A recorded stormwater management maintenance agreement as described in Article
X, §
192-27, of this chapter;
C. A performance bond, an irrevocable letter of credit or other surety;
as described in this chapter; and
D. Permission from adjacent property owners, as may be required.
Any grading or building permit issued by the approving authority
may be suspended or revoked after written notice is given to the permittee
for any of the following reasons:
A. Any violation(s) of the conditions of the stormwater management plan
approval;
B. Changes in site runoff characteristics from those upon which an approval
or waiver was granted;
C. Construction not in accordance with the approved plans;
D. Noncompliance with correction notice(s) or stop-work order(s) issued
for the construction of the stormwater management practice; or
E. An immediate danger in a downstream area that may be caused, exacerbated,
or relieved by the suspension or revocation of the permit, in the
opinion of the approving authority.
In granting the plan approval, the approving authority may impose
such conditions thereto as may be deemed necessary to ensure compliance
with the provisions of this chapter and the preservation of the public
health and safety.
