GENERAL REFERENCES
General penalty — See Ch. 1, Art. I.
A. 
Citation. The Town of Pacific is authorized to use and shall employ citation forms, such citations to conform to governing state statutes for municipal ordinance regulation, to charge violation of ordinances, including, but not limited to, ordinances for which statutory counterparts exist, as well as all municipal ordinances, and all other violations providing for penalty by forfeiture.
B. 
Violation letters. The Town may issue a violation letter before a citation is issued that explains the violation and gives the violator the option of paying the deposit within seven business days to avoid court costs and penalty assessments. If the forfeiture is not paid within seven business days, a citation will be issued which will consist of the court costs and applicable assessments.
The citation shall contain all of the information required pursuant to § 66.0113(1)(b), Wis. Stats., which is hereby incorporated by reference. Further, the citation shall contain such additional information as the Town Board deems necessary.
The form of citation to be used by the Town of Pacific is on file in the Town Clerk's office and is adopted by reference as if fully set forth herein.
A. 
Each citation issued under this section, except those to which Subsection D below applies, shall specify a cash deposit, as set forth in § 1-5 of this chapter, which consists of the appropriate forfeitures and costs, fees and surcharges imposed under Ch. 814, Wis. Stats.
B. 
Deposits shall be made in cash, money order or check to the Town of Pacific or the Columbia County Clerk of Courts, who shall provide a receipt therefor.
C. 
The penalty surcharge imposed by § 757.05, Wis. Stats., the jail surcharge imposed by § 302.46, Wis. Stats., and the justice information surcharge and special prosecution clerk's surcharge imposed by § 814.86. Wis. Stats., shall be added to all forfeitures hereunder, except where said forfeitures are derived from citations issued for violations of ordinances where state law controls or for ordinances involving nonmoving traffic violations. Said assessments shall be in an amount determined after deducting the court costs.
D. 
The deposit, including costs, pertaining to any minor receiving a citation under this section shall in no event exceed $50 plus the penalty surcharge imposed by § 757.05, Wis. Stats., the jail surcharge imposed by § 302.46, Wis. Stats., and the justice information system surcharge and special prosecution clerk's surcharge imposed by § 814.86, Wis. Stats., except that costs and penalties shall not be assessed against minors unless Wisconsin law so provides.
Every police officer or other official issuing a citation for any violation of this Code shall indicate on the citation the amount of the deposit that the alleged violator may make in lieu of a court appearance. The amount of the deposit shall be determined in accordance with the Town of Pacific Bond Schedule, which is hereby adopted by reference, subject to future modifications.
A. 
The Town Chairperson and any law enforcement official may issue a citation authorized under this chapter.
B. 
In addition, the following may issue citations with respect to those specified ordinances which are directly related to their official responsibilities:
(1) 
Town Engineer.
(2) 
Building Inspectors.
(3) 
Weed Commissioners.
(4) 
Town Constable, if any.
C. 
In addition, the Town Chairperson may, with the approval of the Town Board, authorize other Town Board members to issue citations pertaining to specific ordinances.
