The Board of Trustees of the Village of Lancaster declares it
to be its official policy that any or all department heads, employees,
officers and officials of said Village shall, as a basic prerequisite
to the holding of any of the above-mentioned positions, be a resident
of the Village of Lancaster at all times during their employment by
said Village.

The only exceptions to the above-mentioned policy shall be those
exceptions approved by the Board of Trustees of the Village of Lancaster
upon a showing by any particular employee, department head, officer
or official of said Village that the requirement of residency causes
an undue hardship to said individual and upon a finding by the Board
of Trustees of the Village of Lancaster that it would be in the best
interests of all interested parties to exempt said employee, department
head, officer or official from the terms and conditions of its policy
statement. Only residents of the County of Erie may apply for the
exception set forth herein.

The Building Inspector shall be appointed by a resolution of
the Village Board of the Village of Lancaster. The Building Inspector
shall possess background experience related to building construction
or fire prevention and shall, within the time prescribed by law, obtain
such basic training, in-service training, advanced in-service training
and other training as the State of New York shall require for code
enforcement personnel, and the Building Inspector shall obtain certification
from the Department of State pursuant to the Executive Law and the
regulations promulgated thereunder.
The Code Enforcement Officer shall be appointed by a resolution
of the Village Board of the Village of Lancaster. The Code Enforcement
Officer shall possess background experience related to building construction,
maintenance and fire prevention and shall, within the time prescribed
by law, obtain such basic training, in-service training, advanced
in-service training and other training as the State of New York shall
require for code enforcement personnel.
The Fire Inspector shall be appointed by a resolution of the
Village Board of the Village of Lancaster. The Fire Inspector shall
possess background experience related to fire prevention and shall,
within the time prescribed by law, obtain such basic training, in-service
training, advanced in-service training and other training as the State
of New York shall require for fire inspection personnel.
The Building Inspector, Fire Inspector and Code Enforcement
Officer, while acting pursuant to the provisions of the Village Code,
shall not be personally liable for any damage that may accrue to persons
or property as the result of any act required or permitted in the
discharge of his or her official duties, providing that such acts
are performed in good faith without gross negligence.
