It is the intent of these regulations to prohibit the infringement
of any businesses in any established residential areas and in so doing
to regulate the term and frequency of a personal property sale, such
as garage sales, porch sales, basement sales, yard sales and other
similar types of sales, so as not to disturb or disrupt the residential
environment of the area. It is not the intent of this chapter to seek
control of sales by individuals selling a few of their household or
personal items or to seek the control of an individual engaged in
a liquidation sale being conducted in connection with the sale of
all or substantially all of his household or personal items relative
to that individual's relocation outside of the Village of Lancaster.
Any person desirous of holding a personal property sale, such
as but not limited to garage sale, basement sale, porch sale or yard
sale, or resale of used household clothing or any personal property
items which are owned by the residents of the premises, shall obtain
a permit therefor from the Village Clerk-Treasurer of the Village
of Lancaster.

Any such permit issued shall be for a term not exceeding three
consecutive calendar days. Permits shall be limited to two per calendar
year per residential dwelling, and a minimum of 30 days shall have
expired since the last regulated sale before the Clerk-Treasurer of
the Village of Lancaster shall issue a permit for the same residential
dwelling.

Application for permit shall be made to the Village Clerk-Treasurer
upon forms furnished by the Clerk-Treasurer.

The permit fee for each sale shall be as provided in Chapter
144, Fees, of the Code of the Village of Lancaster.

Any church, civic, fraternal or charitable organization holding
a sale of the type described in this chapter shall be exempt from
the rules and regulations contained herein, provided that the sale
is held upon property owned or rented by that particular organization.
A police officer or any other official designated by any Village
ordinance to make inspections under the licensing or regulating ordinance
or to enforce the same shall have the right of entry to any premises
showing evidence of a personal property sale, for the purpose of enforcement
or inspection and may close the premises from such a sale or arrest
any person who violates the provisions of this chapter.

Any person committing an offense against any provision of this chapter shall, upon conviction thereof, be punishable as provided in Chapter
1, General Provisions, Article
II, Penalties for Offenses, of the Code of the Village of Lancaster.
