Where a public or private sanitary sewer system is not available under the provisions of Section 18A-4, Paragraph 3, the house service connection shall be connected to a septic tank or other individual sewage disposal facility complying with the provisions of this Article and the Borough Board of Health Ordinance No. 3-69 (Appendix A, Section 4.1 et seq.).

Before commencement of construction of an individual sewage disposal facility, the owner shall first obtain a written permit signed by the Plumbing Inspector or such other person designated by the Borough Mayor. The application for such permit shall be made on a form furnished by the Borough which the applicant shall supplement by any plans, specifications and other information as are deemed necessary by the Plumbing Inspector or such other person designated by the Mayor. Such permit and inspection fees and other charges as the Borough Council may fix from time to time shall be paid at the time the application is filed or otherwise as required.

A permit for an individual sewage disposal facility shall not become effective until the installation is completed to the satisfaction of the Plumbing Inspector. He shall be allowed to inspect the work at any stage of construction, and, in any event, the applicant for the permit shall notify the Plumbing Inspector when the work is ready for final inspection and before any underground portions are covered. The inspection shall be made within forty-eight (48) hours (excluding Saturdays, Sundays and legal holidays) of the receipt of such notice by the Plumbing Inspector.

The type, capacity, location and layout of an individual sewage disposal facility shall comply with all requirements of the Health and Sanitary Code of the Borough (Appendix A, Article 4, Revised Ordinances of the Borough of Morris Plains, New Jersey, 1972) as amended and of the Department of Health of the State of New Jersey. No permit shall be issued for any individual sewage disposal facility employing subsurface soil absorption facilities where the percolation test does not meet the requirements of the Borough Board of Health. No septic tank or cesspool shall be permitted to discharge to any public or private sewer system or natural outlet.

At such time as a public or private sewer system becomes available to a property served by an individual sewage disposal facility as provided in Section 18A-4, Paragraph 3, a direct connection shall be made to the public or private sewer system in compliance with this chapter, and any septic tanks, cesspools and similar individual sewage disposal facilities shall be disconnected and filled with suitable nondestructible material or maintained in a safe and sanitary condition.
6. 
The owner shall operate and maintain the individual sewage disposal facilities in a sanitary manner at all times at no expense to the Borough.
7. 
No statement contained in this Article shall be construed to interfere with any additional requirements that may be imposed by the Borough board of health or its designated representative or any other regulatory body having jurisdiction.
