In addition to the definitions described in Section 22-1 of this chapter, the following words and phrases, as used in this article, have the following meanings:
OFF-STREET PARKING LOT
The areas or places constructed or acquired or to be constructed or acquired and owned and operated by the Borough for the parking and storing of motor and other vehicles and shall include all real and personal property, driveways, roads, approaches, structures, garages, meters, mechanical equipment and all appurtenances and facilities, either on, above or under the ground, which are used or usable in connection with such parking or storing of such vehicles.
PARKING SPACE
The area or portion of an off-street parking lot within which a vehicle may be properly parked, which space shall be bounded by curbs or lines marked on the surface of the lot, or by a combination of curbs and lines.

The off-street parking lots regulated and controlled by this article are defined as follows:
(a) 
Parking Lot No. 1 is all of that area owned, leased or controlled by the Borough in the rear of the buildings which front on the west side of Speedwell Avenue from Franklin Place to a point 280 feet south therefrom, the 14 parking spaces on the north side of the parking island on Lot 17 in Block 66, and all of Lot 37 in Block 66 on the Tax Map of the Borough of Morris Plains.
(b) 
Parking Lot No. 2 is all of that area leased, owned or controlled by the Borough, situate on the westerly side of Speedwell Avenue, between Franklin Place and Jaqui Avenue and in the rear of the buildings which front on Speedwell Avenue.
(c) 
Parking Lot No. 3 is all of that area leased, owned or controlled by the Borough, situate on the easterly side of Speedwell Avenue adjacent to the railroad and north of New Jersey Highway Route 202 (also known as the "Railroad Freight Yard").
(d) 
Borough Hall parking lot is all of that area in the rear of that of the Borough Hall on Speedwell Avenue and between the Borough Hall and the Borough Hall Annex.

No person shall park any vehicle in any municipal parking lot unless said vehicle is parked in accordance with the regulations provided in this article, which are summarized as follows:
(a) 
Overtime parking. No person shall park any vehicle in violation of the time limitations set forth in the individual municipal parking lot regulations.
(b) 
Daytime permit parking. No person shall park any vehicle in violation of the daytime permit parking regulations set forth in the individual municipal parking lot regulations.
(c) 
Nighttime permit parking. No person shall park any vehicle in violation of the nighttime permit parking regulations set forth in the individual municipal parking lot regulations.

(a) 
The parking lots shall be properly marked off into parking spaces. Parking in all of the parking spaces shall be limited to the periods of times as posted in said parking lots by signs identifying the particular parking spaces as may be from time to time designated and prescribed by the Borough Council by ordinance.
(b) 
Where metered parking is provided, the prescribed fee shall be payable by depositing a coin of the United States of America in the parking meter adjacent to the parking space used.
(c) 
Morris Plains Community Park Parking Lot. The northernmost driveway of the parking lot at Morris Plains Community Park shall be designated as "one-way, exit only."

(a) 
The southernmost parking space in the southeast corner of Block 66, Lot 15.01, and the northernmost parking space in the northeast corner of Block 66, Lot 16, are and shall be designated for handicapped individuals pursuant to N.J.S.A. 39:4-197.5.
(b) 
The remaining 18 parking spaces on Lots 13, 14, 14.01 and 15.01 in Block 66 located on the east side of Parking Lot No. 1 shall be limited to two-hour parking between the hours of 8:00 a.m. and 6:00 p.m., prevailing time, Monday through Saturday, inclusive, Sundays and holidays excepted.
(c) 
Pursuant to the terms of a lease agreement between the Borough of Morris Plains and the owner of Lots 12 and 12.01 in Block 66, an area on the east side of Parking Lot No. 1 shall be reserved for use as a dumpster area by the owner of Block 66, Lot 12.01.
(d) 
Pursuant to the terms of a lease agreement between the Borough of Morris Plains and the owner of Lots 12 and 12.01 in Block 66, the northernmost parking space on the west side of Parking Lot No. 1 is and shall be reserved for use as a parking space by the owner of Block 66, Lot 12.01.
(e) 
The seven parking spaces located within Lots 14 and 14.01, Block 66, along the westerly side of Parking Lot No. 1 shall be limited during the hours of 7:00 a.m. and 5:00 p.m. for the use of the owner of the Lots 14 and 14.01, and/or his designated residential tenants, nonresidential tenants or employees of the buildings known as "672-680 Speedwell Avenue" who have paid for and received a permit for such parking from the Borough Clerk, as set forth in Section 22-27 of this chapter.
(f) 
The three parking spaces located within Lots 12 and 12.01, Block 66, along the westerly side of Parking Lot No. 1 shall be limited during the hours of 7:00 a.m. and 5:00 p.m. for the use of the owner of the Lots 12 and 12.01, and/or his designated residential tenants, nonresidential tenants or employees of the buildings known as "694 and 700 Speedwell Avenue" who have paid for and received a permit for such parking from the Borough Clerk, as set forth in Section 22-27 of this chapter.
(g) 
The seven parking spaces located within Lot 13, Block 66, along the westerly side of Parking Lot No. 1 shall be limited during the hours of 7:00 a.m. and 5:00 p.m. for the use of the owner of Lot 13, and/or his designated residential tenants, nonresidential tenants or employees of the buildings known as "682-690 Speedwell Avenue" who have paid for and received a permit for such parking from the Borough Clerk, as set forth in Section 22-27 of this chapter.
(h) 
The two southernmost parking spaces on Lot 16 in Block 66 on the east side of Parking Lot No. 1 shall be limited to two-hour parking between the hours of 8:00 a.m. and 6:00 p.m., prevailing time, Monday through Saturday inclusive, Sundays and holidays excepted.
(i) 
Pursuant to the terms of a lease agreement between the Borough of Morris Plains and the owner of Lot 16 in Block 66, the eight southernmost parking spaces within Lot 16 and Lot 37 in Block 66 along the westerly boundary of Parking Lot No. 1 shall be limited during the hours of 7:00 a.m. and 5:00 p.m. for the use of the owner of Lot 16 and/or his designated residential tenants, nonresidential tenants or employees of the buildings known as "658-662 Speedwell Avenue," who have paid for and received a permit for such parking from the Borough Clerk, as set forth in Section 22-27 of this chapter.
(j) 
The northernmost parking space in the northwesterly corner of Lot 37 in Block 66 shall be limited during the hours of 7:00 a.m. and 5:00 p.m. for the use of the owners of Lots 12, 12.01, 13, 14, 14.01 and 16 of Block 66, and/or their designated residential tenants, nonresidential tenants or employees of the buildings known as "658-662 Speedwell Avenue, 672-680 Speedwell Avenue, 682-690 Speedwell Avenue or 694 and 700 Speedwell Avenue" who have paid for and received a permit pursuant to Section 22-27 of this chapter.
(k) 
The eight northernmost parking spaces along the northerly boundary of Lot 37 in Block 66 shall be limited to two-hour parking between the hours of 8:00 a.m. and 6:00 p.m., prevailing time, Monday through Saturday, inclusive, Sundays and holidays excepted. Parking in the two southernmost parking spaces along the northerly boundary of Lot 37 in Block 66 shall be limited during the hours of 7:00 a.m. to 5:00 p.m. for the use of those persons who have paid for and received a permit from the Borough Clerk, as set forth in Section 22-27 of this chapter.
(l) 
The remaining 16 parking spaces in Lot 16 and Lot 37 in Block 66 shall be limited to two-hour parking between the hours of 8:00 a.m. and 6:00 p.m., prevailing time, Monday through Saturday inclusive, Sundays and holidays excepted.
(m) 
The three easternmost spaces on the north side of the parking island on Lot 17 in Block 66 are and shall be designated for handicapped parking pursuant to N.J.S.A. 39:4-197.5.
(n) 
The remaining 11 spaces on the north side of the parking island on Lot 17 in Block 66 shall be limited to two-hour parking between the hours of 8:00 a.m. and 6:00 p.m., prevailing time, Monday through Saturday inclusive, Sundays and holidays excepted.
(o) 
Parking in all of the parking spaces in Parking Lot No. 1 shall be prohibited between the hours of 12:00 midnight and 6:00 a.m., seven days a week, provided that the holders of twelve-hour parking permits pursuant to the provisions of Section 22-27 of this chapter shall be permitted to park in Parking Lot No. 1 during such hours, and provided, further, that any residential tenants of the buildings known as "658-662 Speedwell Avenue, 672-680 Speedwell Avenue, 682-690 Speedwell Avenue or 694 and 700 Speedwell Avenue" who have paid for and received a permit pursuant to Section 22-27 shall be permitted to park in the twelve-hour permit parking spaces within Parking Lot No. 1 on a twenty-four-hour basis upon display of a permit for such purpose, which may be obtained from the Borough Clerk at no fee. Such residential permit shall be displayed on the rear of the inside rearview mirror of the vehicle parked in Parking Lot No. 1. The residential permit shall confirm no additional rights on the holder thereof, except for those specified in this paragraph.

(a) 
The 11 parking spaces in Parking Lot No. 2 on the west side of the guardrail shall be limited to two-hour parking from 8:00 a.m. to 6:00 p.m., prevailing time, Monday through Saturday inclusive, Sundays and holidays excepted.
(b) 
The two southernmost spaces adjacent to No. 3 Franklin Place in the southeast corner of Parking Lot No. 2 shall be for handicapped individuals.
(c) 
Parking in all of the remaining parking spaces in said Parking Lot No. 2 on the westerly side of the lot shall be limited during the hours of 7:00 a.m. to 5:00 p.m. to business owners and employees of businesses located in buildings which front on Speedwell Avenue between Franklin Place and Jaqui Avenue who have paid for and received a permit for such parking from the Borough Clerk, as set forth in Section 22-27 of this chapter.
(d) 
With the exception of the two southernmost parking spaces reserved for handicapped individuals under Paragraph (b) above, the remaining five parking spaces adjacent to No. 3 Franklin Place shall be limited to two-hour parking from 8:00 a.m. to 6:00 p.m., prevailing time, Monday through Saturday inclusive, Sundays and holidays excepted. Parking on the easterly side of Parking Lot No. 2 shall be limited to 30 minutes during the hours of 8:00 a.m. to 6:00 p.m., prevailing time, Monday through Saturday inclusive, Sundays and holidays excepted.
(e) 
Parking in all of the parking places in Parking Lot No. 2 shall be prohibited between the hours of 10:00 p.m. and 6:00 a.m., seven days a week, provided that the holders of twelve-hour parking permits pursuant to the provisions of Section 22-27 of this chapter shall be permitted to park in Parking Lot No. 2 during such hours, and provided, further, that residential tenants of the buildings located between Franklin Place and Jaqui Avenue which front on Speedwell Avenue shall be permitted to park in Parking Lot No. 2 on a twenty-four-hour basis and limited to twelve-hour parking spaces upon display of a permit for such purpose, which may be obtained from the Borough Clerk at no fee. Such permit shall be issued on a yearly basis.
(f) 
The permit shall be displayed on the rear of the inside rearview mirror of the vehicle parked in Parking Lot No. 2. The permit shall confer no additional rights on the holder thereof, in addition to those specified in this paragraph.

Parking in all of the parking spaces in Parking Lot No. 3 shall be prohibited between the hours of 12:00 midnight and 6:00 a.m., seven days a week and shall be limited to one-hour parking from 8:00 a.m. to 6:00 p.m., prevailing time, Monday through Saturday inclusive, Sundays and holidays excepted; provided, however, that:
(a) 
The 29 spaces on the easterly side of Speedwell Extension from a point on Speedwell Avenue Extension 120 feet north of the center line of Jaqui Avenue and proceeding north therefrom shall be designated and limited to and available only between the hours of 7:00 a.m. and 7:00 p.m. to those persons who have paid for and received a permit for such parking from the Borough Clerk as set forth in Section 22-27 of this chapter; and
(b) 
The four spaces on the easterly side of Speedwell Extension between a point on Speedwell Avenue Extension 80 feet north of the center line of Jaqui Avenue and a point on Speedwell Avenue Extension 120 feet north of the center line of Jaqui Avenue shall be designated and limited as two-hour parking from 8:00 a.m. to 6:00 p.m., prevailing time, Monday through Saturday inclusive, Sundays and holidays excepted.
(c) 
Any parking space(s) reserved for electric charging vehicles and so designated shall be subject to the provisions of Section 22-40.

(a) 
The Mayor is authorized and directed to provide reserved spaces in the Borough Hall parking lot for certain municipal vehicles. These reserved spaces shall be designated by suitable signs.
(b) 
No person shall park any unauthorized vehicle in any such reserved parking space.
(c) 
No person shall park a vehicle in the Borough Hall parking lot unless he is:
(1) 
Present for the purpose of conducting official business with the Borough;
(2) 
Attending a meeting of the Borough; or
(3) 
An official or employee of the Borough.

(a) 
The twelve-hour parking permits herein required shall be obtainable by residents of the Borough of Morris Plains or employers or employees of businesses located within the Borough of Morris Plains upon payment of the required charge, for which the Borough will issue a permit, good only during the six-month period for which the permit was purchased.
(b) 
The required charge for the permit for residents of the Borough of Morris Plains or employers or employees of businesses located within the Borough shall be that set forth in the Fee Schedule of the Borough of Morris Plains, established by ordinance.
(c) 
The charge shall be paid to the Borough Clerk, who shall cause a permit to be issued and who shall keep a record of permits issued and to whom issued. The Borough Clerk shall account to the Borough Council for the charges collected.
(d) 
The Borough will not reserve any particular space for the purchaser of a permit, and there shall be no guaranty of the availability of a space for said vehicle. The Borough hereby assumes no liability in the event of unavailability of a parking space, and there shall be no refund because of said unavailability of space.
(e) 
The permits shall be issued for the six-month periods from October 1 to March 31 and from April 1 to September 30.
(f) 
In addition to the foregoing, a resident of the Borough of Morris Plains or employers or employees of businesses located in the Borough of Morris Plains may, during the times indicated in the paragraph above, buy parking permits not only for the immediately succeeding six-month period, but also for the following six-month period. No refunds of permit fees for unused permits shall be made in any case, and there shall be no proration of such fee or charge.

(h) 
Inasmuch as one of the conditions for the leasing from the owner of one of the above-named parking lots requires as part of the consideration thereof that the owner of the parking lot be entitled to 12 twelve-hour parking permits within Parking Lot Nos. 2 and 3 of the Borough and the further consideration that the owner guarantees the purchase of said 12 permits for the use of himself, as owner, and the use of the nonresidential tenants or employees of the building known as "736 Speedwell Avenue," in the Borough, there is hereby reserved from said parking permits 12 of said permits, which go on sale commencing the 15th day of the month preceding the six-month period from which said permits will be issued, to and including the 21st day of said month, and thereafter, also reserved, the same 12 permits which go on sale commencing the 22nd day of said month, to and including the 25th day of said month. Said 12 permits are to be sold to the owner and/or his designated nonresidential tenants or employees.
(i) 
Inasmuch as one of the conditions for the leasing from the owner of a portion of Parking Lot No. 2 located on Lot 19 in Block 63 requires as part of the consideration thereof that the owner of the parking lot be entitled to eight twelve-hour parking permits within Parking Lot Nos. 2 and 3 of the Borough and the further consideration that the owner guarantees the purchase of such eight permits for the use of himself, as owner, and the use of the nonresidential tenants or employees of the building known as "740 Speedwell Avenue" in the Borough, there is hereby reserved from such parking permits eight of the permits which go on sale commencing the 15th day of the month preceding the six-month period for which such permits will be issued, to and including the 21st day of said month, and thereafter, also reserved, the same eight permits which go on sale commencing the 22nd day of said month, to and including the 25th day of said month. Said eight permits shall be sold to the owner and/or his designated nonresidential tenants or employees.
(j) 
The Borough may issue no more than 12 one-day, twelve-hour parking permits to households of the Borough of Morris Plains during any calendar year. Such permits shall provide to the owner the same privileges and responsibilities as given to the bearer of a six-month twelve-hour parking permit, except that parking privileges shall be granted only for the day which appears on the permit. These one-day twelve-hour permits shall be issued at the office of the Borough Clerk on a first-come, first-served basis during normal business hours not more than five business days prior to the effective date of the permit. The fee for such one-day permits shall be that set forth in the Fee Schedule of the Borough of Morris Plains, Chapter 2, Section 2-46.

(a) 
No person shall permit a vehicle to remain in any parking space in any parking lot unless and until the fee or charge set forth in this article has been deposited or paid.
(b) 
No person shall permit any vehicle to be parked in any parking space for a period of time longer than prescribed by this article.
(c) 
No person shall permit any vehicle to be parked in any parking lot other than within the boundary lines of a parking space, as herein defined.
(d) 
No person shall wash, paint, repair or otherwise work on any vehicle parked in a municipal parking lot; provided, however, that nothing herein contained shall be construed to prohibit necessary emergency repairs to a vehicle.

The Police Department may remove from any off-street parking lot any unattended vehicle parked or standing in any portion of any off-street parking lot not designated as a parking space or any unattended vehicle parked or standing in a designated parking space which has remained in said designated parking space for a period of ten (10) hours, after a summons has been issued charging a violation hereunder. When a vehicle is so removed from an off-street parking lot, the owner of said vehicle shall pay, before being entitled to the recovery or possession of said vehicle, all reasonable charges for towing, storage and other expenses incurred in the removal of said vehicle.

(a) 
No person shall deface, injure, tamper with, open or willfully break, destroy or impair the usefulness of any parking meter installed under the provisions of this article.
(b) 
No person shall deposit or cause to be deposited in any parking meter any slug, device or metallic substitute or any other substitute for a United States coin.

Except as specifically provided therein, all the regulations for parking in Parking Lot Nos. 1, 2 and 3 enumerated in Sections 22-22 to 22-25 shall be effective daily between the hours of 7:00 a.m. and 7:00 p.m., except Saturdays, Sundays and legal holidays.
