Any owner may appeal a stormwater user fee by filing a written appeal with the Village Clerk. Payment of any outstanding stormwater user fee is a precondition to the filing of an appeal.
The appeal shall include a survey of the parcel by a land surveyor or engineer, showing total parcel size, the impervious surface area and any other information relevant to the appeal. The appeal shall also contain calculations as to the approximate amount the owner deems the stormwater user fee should be for the parcel.
The Village shall hear and decide the appeal within 60 days of the filing of the appeal in an open session of the Village. The owner shall receive written notice of the date, time and place the Village hears and decides the appeal. The Village's decision shall be in writing and, if the appeal is denied, the reasons shall be stated by the Village.
Any owner aggrieved by a decision of the Village may, within 30 days of the date of filing of the decision with the Village, commence an action seeking the remedy available by certiorari.
Any adjustment in the stormwater user fee made by the Village upon appeal shall be credited in full or part to subsequent stormwater user fee billings until such time as the full amount is returned. The entire amount may be refunded at the discretion of the Village.
An appeal of any special assessment levied upon a parcel may be made according to the terms of § 66.0703(12), Wis. Stats.
