For the purpose of this chapter, the following words and their derivations shall have the meanings herein given. When not inconsistent with the context, words used in the present tense include the future, words in the plural include the singular, words in the singular include the plural, and words in the masculine gender include the feminine. The word "shall" is always mandatory and not merely directory. See §
233-68 of this chapter for definitions applicable to the Pinelands Area.
As used in this chapter, the following terms
shall have the meanings indicated:
ACCESSORY USE OR BUILDING [Amended 5-8-2001 by Ord. No. 1466]
An accessory structure or use is a structure or use which:
A.
Is subordinate to and serves a principal use.
B.
Is subordinate in area, extent and purpose to
the principal structure or principal use served.
C.
Contributes to the comfort, convenience or necessity
of the occupants, business or industry of the principal structure
or principal use served.
D.
Is located on the same lot as the principal
structure or principal use served.
ALTERATION
As applied to a building or a structure, a change or rearrangement
in the structural parts or in the existing facilities, or an enlargement,
whether by extension of a side or by increasing in height, or by moving
from one location or position to another.
APPLICANT
A developer or landowner submitting an application for development.
APPLICATION FOR DEVELOPMENT
The application form and all accompanying documents required
by ordinance for approval of a forestry plan, resource extraction
plan, subdivision plat, site plan, planned development, conditional
use, zoning variance or direction of the issuance of a permit pursuant
to Section 25 or Section 27 of the Municipal Land Use Law.

APPROVED SURFACE MATERIAL
As it pertains to driveways and private roads which access
private residences, an approved surface material shall be that which
is maintained and constructed of compacted dirt, stone, or any other
hard compacted surface and not obstructed by any trash, debris, structure,
vehicle or pot hole and must support the weight of any emergency vehicle.

ASSISTED-LIVING CARE FACILTIES
Residences for the frail elderly that provide rooms, meals,
personal care, and supervision of self-administered medication. They
may provide other services, such as recreational activities, financial
services, and transportation.

AUTOMOBILE SERVICE STATION
Any building, land area or other premises or portion thereof
used or intended to be used for the retail dispensing or sales of
automobile fuels, that may include the following accessory uses: sales
of lubricants, tires, accessories, or supplies; minor repair of automobiles,
provided that automobile wrecking, recycling, major repairs of automobiles,
parking or storing of automobiles for hire, and the operation of more
than one towing vehicle shall not be deemed permissible accessory
uses of an automobile service station.

BASEMENT
A portion of the building partly underground, but having
less than half its clear height below the average grade of the adjoining
ground. (See "cellar.")
BOARDER
An individual other than a member of the family occupying
the dwelling unit or a part thereof who, for a consideration, is furnished
sleeping accommodations and may be furnished meals or other services
as part of the considerations.

BOARDING HOUSE
A dwelling or part thereof, in which lodging is provided
by the owner or operator to more than three boarders.

BUFFER
A strip of land containing natural woodlands, earth mounds
and/or planted screening material and separating one kind of land
use or one property from another.
BUILDING
A structure enclosed within exterior walls or fire walls,
built, erected and framed of component structural parts, designed
for the housing, shelter, enclosure and support of individuals, animals
or property of any kind. (See "structure.")
BUILDING HEIGHT
The vertical distance measured from the average elevation
of the finished grade at all corners of the building to the highest
point of the roof for flat roofs, to the mean height level of the
distance measured between the eaves and ridge for gable, gambrel and
hipped roofs and to the deckline for mansard roofs.

BUILDING LINE
The line established by law, beyond which a building shall
not extend, except as specifically provided by law. All yard requirements
are measured to the building line.
CARTWAY
The area of a roadway within which vehicles are permitted,
including travel lanes and parking areas, but excluding shoulders,
curbs, sidewalks, swales or other auxiliary areas.
CELLAR
The portion of the building partly underground, having half
or more than half of its clear height below the average grade of the
adjoining ground.
CERTIFICATE OF USE AND OCCUPANCY
The certificate issued by the Building Official which permits
the use of a building in accordance with the approved plans and specifications
and which certifies compliance with the provisions of law for the
use and occupancy of the building in its several parts together with
any special stipulations or conditions of the building permit.
CLUZ ZONE
An area of noise exposure designated on the "Cluz" Map Exhibit
ES-2 of the National Aviation Facilities Experimental Center's Compatible
Land Use Zones Report of January 1978. This zone is indicated on Galloway's
Opportunities and Constraints Map Exhibit 2 (part of the Master Plan)
as Noise Exposure Zones 2 and 3.
COMMERCIAL
A.
COMMUNITY COMMERCIALRetail business and service establishments, including retail shops, personal service establishments, business and professional offices, banks and fiduciary institutions, eating and drinking establishments, hotels and motels, commercial recreation and public assembly halls, funeral homes, commercial parking lots and the like.
B.
NEIGHBORHOOD COMMERCIALRetail business and personal service establishments which are clearly designed to serve the immediate neighborhood, including retail shops, personal service establishments, luncheonettes and coffee shops, professional offices, banks and fiduciary institutions, etc.
C.
GENERAL RETAIL SALES AND RELATED SERVICES USESArt and school supply stores, bookstores, department stores, drugstores, electrical appliance stores, fabric and sewing accessory stores, furniture stores, gift, novelty and souvenir stores, home decorating stores, jewelry stores, laundry, dry-cleaning establishments with coin-operated and self-service facilities, hardware stores, leather shops, luggage and suitcase stores, liquor stores, mail packaging service, musical instrument stores, newspaper and magazine stands, printing shops, record shops, secondhand item stores, shoe stores, specialty stores, sporting goods shops, stationery shops, toy stores, video rental/sales.

COMMERCIAL FOREST
Any parcel of land five acres or larger used for gain by
the cutting of trees for sale as fuel or wood products.
COMMON OPEN SPACE
An open space area within or related to a site designated
as a development, and designed and intended for the use or enjoyment
of residents and owners of the development. Common open space may
contain such complementary structures and improvements as are necessary
and appropriate for the use or enjoyment of residents and owners of
the development.
CONFERENCE FACILITY
A facility used for conferences and seminars, with accommodations
for sleeping, food preparation and eating, recreation, entertainment,
resource facilities, meeting rooms, fitness and health center, and
retail stores and services primarily for conference center guests.

CONVENIENCE STORE
A relatively small food market generally less than 5,000
square feet where prepackaged foods, magazines and newspapers, cigarettes,
dairy products, and/or similar foods and items are sold for consumption
or use elsewhere. Convenience stores also include where, as a secondary
use of the premises, prepared foods (e.g., meats, cheeses, salads,
etc.) are sold over the counter in sandwiches or are packaged to take
out, and can contain coffee counters and soda fountains. A convenience
store does not include seating or areas for consumption of products
sold on site.

CONVENTIONAL DEVELOPMENT
That development which takes place as a "by right" use of
the zoning district and requires subdivision, rather than planned
development, review.
DECK
An open-sided platform, without roof or walls, which is elevated
and supported by piers, pillars or posts rooted in a permanent concrete
foundation, and which may be freestanding or attached to a principal
building. Decks shall be fitted with appropriate railings pursuant
to applicable building codes.

DENSITY
A.
GROSS DENSITYThe total number of dwelling units in the proposed development divided by the total number of acres of the proposed development site.
B.
NET DENSITYThe total number of dwelling units in a proposed development divided by the total number of acres of the proposed development site exclusive of streets, commercial uses, industrial uses and land to be dedicated to a public agency or government.
DEVELOPER
The legal or beneficial owner or owners of a lot or any land
proposed to be included in a proposed development, including the holder
of an option or contract to purchase or other person having an enforceable
proprietary interest in such land.
DEVELOPMENT
The division of a parcel of land into two or more parcels,
the construction, reconstruction, conversion, structural alteration,
relocation or enlargement of any building or other structure, or of
any mining, excavation or landfill, or the clearing, grading or disturbance
of any area in excess of 5,000 square feet for nonagricultural purposes
and any use or change in the use of any building or other structure,
or land or extension of use of land, for which permission may be required
pursuant to this chapter.

DRUGSTORE
A retail store where medicines and miscellaneous articles
such as foods, cosmetics, and film are sold.

DWELLING UNIT
One or more rooms arranged for the use of one or more individuals
living together as a single housekeeping unit, with cooking, living,
sanitary and sleeping facilities.
DWELLING UNIT, TYPES
B.
SINGLE-FAMILY ATTACHEDA dwelling unit sharing a common or party wall with one or more single family units, but with no more than three units within a single structure.
C.
TOWNHOUSEA dwelling unit in a structure containing four or more dwelling units, each sharing two vertical common or party walls, except that the end units have a single common or party wall.
D.
GARDEN APARTMENTA dwelling unit in a structure of three or more dwelling units, each sharing vertical and horizontal common or party walls.
E.
CONDOMINIUMSPursuant to N.J.S.A. 40:55D-58, any of the above dwelling unit types may be held in condominium or cooperative ownership, since condominium denotes a form of ownership and not a type of use.

FAMILY
One or more persons related by blood or marriage living together
as a single housekeeping unit, or a collective number of persons living
together in one house, whose relationship is of a distinctive domestic
character, and cooking as a single housekeeping unit.
FARM
Any parcel of land five acres or larger in size which is
used for gain in the raising of agricultural products, livestock,
poultry, dairy products or horticulture.
FARM BUILDING
Any building used for the housing of agricultural equipment,
produce, livestock or poultry or for the incidental or customary processing
of farm products, provided that such building is located on, operated
in conjunction with and is necessary to the operation of a farm as
defined by this article.
FLOODPLAIN
The maximum area of land surface inundated by water during
a given storm.
FRESHWATER WETLAND
A.
Those areas of the Township designated by the
Galloway Township Freshwater Wetlands Map, which designation is based
upon the following soil types defined by the Soil Survey of Atlantic
County:
B.
Those areas of the Township not flooded by tidal
water, which have a seasonal high water table at zero to one foot,
as shown on the Galloway Township Flood Hazard Map No. 6.
GARAGE, PRIVATE
A garage for four or less passenger motor vehicles with no
provision for repairing or servicing such vehicles for profit.
GARAGE, PUBLIC
A building or part thereof, other than a private garage,
used for the storage, care or repair of motor vehicles for profit,
including any sale of motor vehicles, fuels or accessories, or in
which any such vehicles are kept for hire.
GASOLINE FILLING STATIONS
Any area of land, including structures thereon, that is used
for the sale of gasoline or other motor vehicle fuel, oil or lubricating
substance and which may include the sale of motor vehicle accessories
and facilities for polishing, greasing, washing, spraying, dry-cleaning
or otherwise cleaning or servicing such motor vehicles.
GOLF COURSE
An area of 50 or more contiguous acres containing a full-size
professional golf course, at least nine holes in length, together
with the necessary and usual accessory uses and structures, such as
but not limited to clubhouse facilities, dining and refreshment facilities,
swimming pools, tennis courts and the like, provided that the operation
of such facilities is incidental and subordinated to the operation
of the golf course.
GRADE
A.
For buildings adjoining one street only, the
elevation of the established curb at the center of the wall adjoining
the street.
B.
For buildings adjoining more than one street,
the average of the elevations of the established curbs at the center
of all walls adjoining streets.
C.
For buildings having no wall adjoining the street,
the average level of the ground adjacent to the exterior walls of
the building. All walls approximately parallel to and not more than
15 feet from a street line are to be considered as adjoining a street.
HOME PROFESSIONAL OFFICE
A business, profession, occupation or trade conducted for
gain or support by a resident of the dwelling unit and is incidental
and secondary to the use of the dwelling unit. A home professional
office shall not include retail sales to the general public unless
through mail, Internet or another similar service wherein the retail
customers are not visiting the residential unit.

HOTEL
A facility offering transient lodging accommodations to the
general public and providing additional services such as restaurants,
meeting rooms, and recreation facilities.

INDUSTRIAL
Relating to those fields of economic activity, including
forestry, fishing, hunting and trapping, mining, construction, manufacturing,
transportation, communication, electric, gas, sanitary services, and
wholesale trade.

INDUSTRIAL, HEAVY
An activity which involves the fabrication, reshaping, reworking,
assembly or combining of products from previously prepared materials.
Operations shall include automobile assembly, milling or forge activities,
or any item that is not considered light industrial.

INDUSTRIAL, LIGHT
Any activity which involves the fabrication, reshaping, reworking,
assembly or combining of products from previously prepared materials.
Operations shall result in small component assembly including electronic,
machine parts and other similar-sized items. All aspects of the industrial
process shall be carried out within an enclosed building.

JUNK- OR SALVAGE YARD
Any area and/or structure used or intended to be used for
the conducting and operating of the business of selling, buying, storing
or trading in used or discarded metal, glass, paper, cordage or any
used or disabled fixtures, vehicles or equipment of any kind. The
storage of not more than three disabled vehicles in conjunction with
a public garage shall not be considered a "junkyard."
LOT
A designated parcel, tract or area of land established by
a plat or otherwise as permitted by law and to be used, developed
or built upon as a unit.
LOT AREA
Any area of land which is determined by the limits of the
lot lines bounding that area. Where a portion of the lot must be dedicated
for a public right-of-way, that dedicated area may be included in
the calculation of the "lot area," up to 10% of the "lot area."

LOT, CORNER
A lot or parcel of land abutting upon two or more streets
at their intersection, or upon two parts of the same street forming
an interior angle of less than 135°. Each corner lot shall have
two front yards, one side yard and one rear yard. A corner lot shall
have a primary and a secondary front yard. The primary front yard
shall be along the smaller of the two street frontages as further
defined in "lot frontage" herein.

LOT COVERAGE
The percentage of the lot area which is covered by buildings.
LOT, DEPTH OF
The mean distance from the street line to the rear lot line.
LOT FRONTAGE
A lot line or portion thereof which is coexistent with a
street line. In the case of a street of undefined width, said lot
line shall be assumed to parallel the center line of the street at
a distance 25 feet therefrom. In the case of corner lots, the smaller
of the two or more lot lines coexistent with street lines shall be
considered as the "frontage."
LOT WIDTH
The horizontal between the side lot lines at the building
line.
MAJOR SUBDIVISION
A subdivision which requires the creation of more than three
lots, any new street or the extension of any off-tract improvement.
MIGRANT LABOR CAMP
One or more vehicles, buildings or structures used as living
quarters by seasonal, temporary or migrant farm workers in connection
with any work or place where work is being performed, whether or not
rent is paid in connection with the use or occupancy of such premises.
MINOR SUBDIVISION
A subdivision of land that does not involve the creation
of more than three lots, planned development, any new street, extension
of any off-tract improvement, the cost of which is to be prorated
pursuant to N.J.S.A. 40:55D-42 or any lot or portion of a lot which
has been subdivided within the previous three-year period.

MOTEL
An establishment providing transient accommodations containing
six or more rooms with at least 24% of all rooms having direct access
to the outside without the necessity of passing through the main lobby
of the building.

NONCONFORMING LOT
A lot the area, dimension or location of which was lawful
prior to the adoption, revision or amendment of a zoning ordinance,
but fails to conform to the requirements of the zoning district in
which it is located by reason of such adoption, revision or amendment.
NONCONFORMING STRUCTURE
A structure the size, dimension or location of which was
lawful prior to the adoption, revision or amendment of a zoning ordinance,
but which fails to conform to the requirements of the zoning district
in which it is located by reasons of such adoption, revision or amendment.
NONCONFORMING USE
A use or activity which was lawful prior to the adoption,
revision or amendment of a zoning ordinance, but which fails to conform
to the requirements of the zoning district in which it is located
by reasons of such adoption, revision or amendment.
NURSING HOME
An extended or intermediate health care facility licensed
or approved to provide full-time convalescent or chronic care to individuals
who, by reason of advanced age, chronic illness or infirmity, are
unable to care for themselves.

OCCUPANCY
The specific purpose for which land or a building is used,
designed or maintained.
OFF-SITE COMMERCIAL ADVERTISING SIGN
A sign, other than a sign which advertises an agricultural
commercial establishment, which directs attention to a business, commodity,
service or entertainment conducted, sold or offered at a location
other than the premises on which the sign is located.

OPEN SPACE
Any parcel or area of land or water essentially unimproved,
dedicated, designated or reserved for public or private use or enjoyment
or for the use or enjoyment of owners and occupants of land adjoining
or neighboring such open space; and improved only by buildings, structures,
streets and off-street parking and other improvements that are designed
to be incidental to the natural openness of the land.
PARKING LOT, COMMERCIAL
Any lot which is devoted to the parking of automobiles in
return for a fee and which is not directly operated by and on behalf
of a use permitted in the zone in which located.
PARKING SPACE
An off-street space available for the parking of a motor
vehicle.
PERSONAL SERVICE ESTABLISHMENTS
Establishments primarily engaged in providing services involving
the care of a person or his or her personal goods or apparel.

PHARMACY
An establishment where prescription and nonprescription drugs
are prepared and dispensed.

PLANNED COMMERCIAL DEVELOPMENT
An area to be developed according to a plan as a single entity
containing one or more structures with appurtenant common areas to
accommodate commercial or office uses or both and any residential
and other uses incidental to the prominent use.
PLANNED DEVELOPMENT
Planned unit development, planned unit residential development,
residential cluster, planned commercial development or planned industrial
development.
PLANNED INDUSTRIAL DEVELOPMENT
An area to be developed according to a plan as a single entity
containing one or more structures with appurtenant common areas to
accommodate industrial uses and any other uses incidental to the predominant
use.
PLANNED INDUSTRIAL RESIDENTIAL DEVELOPMENT
An area with a minimum contiguous or noncontiguous acreage
of 150 acres to be developed as a single entity according to a plan,
containing one or more residential clusters or planned unit residential
developments and one or more structures with appurtenant common areas
to accommodate industrial, commercial and/or office uses.

PLANNED UNIT DEVELOPMENT
An area with a minimum contiguous or noncontiguous acreage
of 10 acres to be developed as a single entity according to a plan,
containing one or more residential clusters or planned unit residential
developments and one or more public, quasi-public, commercial or industrial
areas.
PLANNED UNIT RESIDENTIAL DEVELOPMENT
An area with a minimum contiguous or noncontiguous acreage
of five acres to be developed as a single entity according to a plan
containing one or more residential clusters, which may include appropriate
commercial or public or quasi-public uses, all primarily for the benefit
of the residential development.
PLAT
A map or maps of a subdivision or site plan.
PORCH
A roofed platform which is elevated from grade and supported
by piers, pillars or posts rooted in permanent concrete foundation,
and which projects from the exterior wall of a principal building,
has direct access from that principal building, and has at least three
of its perimeter sides unobstructed in any manner between floor and
ceiling except for roof-support elements. Porches shall be fitted
with appropriate railings pursuant to applicable building codes.

PORTICO (aka PORTE-COCHERE)
An open-sided roofed structure projected from the exterior
wall of a principal building, with direct access from that building,
and sheltering an entrance to that building. A portico may also be
considered as a roofed area forming a porch.

A.
The roof of a portico shall be supported by
piers, pillars or posts rooted in a permanent concrete foundation.
B.
In no case shall a portico be construed as a
carport (i.e., open-sided garage) for the parking of motor vehicles
or other outdoor storage.
PRELIMINARY APPROVAL
The conferral of certain rights pursuant to Sections 34,
36 and 37 of the Municipal Land Use Law prior to final approval after specific elements of a development
plan have been agreed upon by the Planning Board and the applicant.
PRIME AGRICULTURAL LANDS
Those soils designated in the Atlantic County Soil Survey
as Agricultural Capability Classes I and II. The Atlantic County Soil
Survey is available from the United States Department of Agriculture,
Atlantic County District Conservationist.
PRINCIPAL BUILDING
A building in which is conducted the main or principal use
of the lot on which said building is situated. No lot shall have erected
upon it more than one principal residential building unless otherwise
specified in the Code.

PROFESSIONAL OFFICE
The office of a doctor, minister, professional engineer,
lawyer and such similar professional occupations.
PUBLIC AREAS
A.
Public parks, playgrounds, trails, paths and
other recreational areas.
B.
Other public open spaces.
C.
Scenic and historic sites.
D.
Sites for schools and other public buildings
and structures.
PUBLIC DEVELOPMENT PROPOSAL
A Master Plan, capital improvement program or other proposal
for land development adopted by the appropriate public body, or any
amendment thereto.
PUBLIC DRAINAGEWAY
The land reserved or dedicated for the installation of stormwater
sewers or drainage ditches, or required along a natural stream or
watercourse for preserving the channel and providing for the flow
of water to safeguard the public against flood damage, sedimentation
and erosion.
PUBLIC OPEN SPACE
An open space area conveyed or otherwise dedicated to a municipality,
municipal agency, board of education, state or county agency or other
public body for recreational or conservational uses.
RECREATION FACILITY
A place designed and equipped for the conduct of sports and
leisure-time activities.

RESIDENTIAL CLUSTER
An area to be developed as a planned development and entity
according to a plan containing residential housing units which have
a common or public space as an appurtenance.
REVERSE FRONTAGE
Access to lots fronting a major road is from an accessory
street, rather than the collectors.
SELF-SERVICE STORAGE FACILTIY
A building or group of buildings containing separate, individual,
and private storage spaces of varying sizes available for lease or
rent for varying periods of time.

SETBACK
The distance between the street line and the building line.
SIGN
Any object, device, display or structure or part thereof,
situated outdoors or indoors, which is used to advertise, identify,
display, direct or attract attention to an object, person, institution,
organization, business, products, service, event or location by any
means, including words, letters, figures, designs, symbols, fixtures,
colors, illumination or projected images. "Signs" do not include the
flag or emblem of any nation, organization of nations, state or city
or any fraternal, religious or civic organizations; merchandise, pictures
or models of products or services incorporated in a window display;
works of art which in no way identify a product; or scoreboards located
on athletic fields.

SIGN, AREA OF
The area included within the frame or edge of the sign. Where
the sign has no such frame or edge, the area shall be defined by an
enclosed four-sided (straight sides) geometric shape which most closely
outlines said sign.

SITE COVERAGE
The percentage of the gross site area covered by roads, paving,
structures or other impervious coverage.
SITE PLAN
A development plan of one or more lots on which is shown
the existing and proposed conditions of the lot, including but not
limited to topography, vegetation, drainage, floodplains, marshes,
and waterways; the location of all existing and proposed buildings,
drives, parking spaces, walkways, means of ingress and egress, drainage
facilities, utility services, landscaping, structures, signs, lighting,
and screening devices; and any other information that may be reasonably
required in order to make an informed determination concerning the
adequacy of the plan in accordance with the requirements of this chapter.

SITE PLAN, MAJOR
Any site plan not classified as a minor site plan.

SITE PLAN, MINOR
A site plan of one or more lots which is not exempted from site plan review by this chapter that proposes construction, reconstruction, conversion, structural alteration, relocation or enlargement of any building or structure, or mining excavation or landfill, or clearing, grading or disturbance of any area less than 10,000 square feet for nonagricultural purposes and any change in use of any building or other structure or land or extension of use of land, including the use of land for outdoor sales of products approved off-site, whether such use is temporary or permanent. Development must not require more than 10 parking spaces as determined in accordance with §
233-11, 15% additional building coverage and does not involve planned development, any new street, a connection with an off-site drainage system or outfall of drainage onto an adjoining property, or extension of any off-tract improvement. Individual lot applications for one- or two-dwelling-unit buildings and accessory structures shall not be required to obtain minor site plan approval.

SMALL WIND ENERGY SYSTEM
A wind energy system, as defined herein, that is used to
generate electricity; and has a nameplate capacity of 100 kilowatts
or less.

SOLAR ENERGY SYSTEM
A solar energy system and all associated equipment which
converts solar energy into a usable electrical energy, heats water
or produces hot air or other similar function through the use of solar
panels.

SOLAR PANEL
A structure containing one or more receptive cells, the purpose
of which is to convert solar energy into usable electrical energy
by way of a solar energy system.

STOOP
An open platform, without roof or walls, consisting of steps
and a landing, which is located at the entrance door to a structure
and being no greater than six feet wide by six feet deep.

STORY
That part of a building between the surface of any floor
and the next floor above it or, in its absence, the finished ceiling
or roof above it. A split-level story shall be considered a second
"story" if its floor level is six feet or more above the level of
the line of the finished floor next below it except a cellar. If any
floor under a sloping roof at the top of a building is more than two
feet below the top plate, it shall be counted as a "half-story." A
basement shall be counted as a story.
STREAM CORRIDOR
That land lying within 50 feet of the edge of any stream,
pond or lake or within 25 feet of the center of any intermittent stream.
STREAM ENCROACHMENT PERMIT
A permit required for construction, grading, filling or storage
of material, equipment or structures within Township stream corridors
or freshwater wetlands. (See "stream corridor" and "freshwater wetlands.")
STREET
A public thoroughfare which has been or will be dedicated
or deeded to the public for public use and which has been improved
and accepted in accordance with Township ordinances.
B.
COLLECTOR STREETSThose used primarily to carry traffic from minor to arterial streets, including the principal entrance roads of a residential subdivision or development, and roads for circulation within such subdivision or development.
E.
MARGINAL ACCESS STREETSThose parallel and adjacent to arterial streets and which provide access to abutting properties and protection from through traffic.
STREET LINE
That line determining the limit of the highway rights of
the public, either existing or contemplated. Where a definite right-of-way
width has not been established, the "street line" shall be assumed
to be at a point 25 feet from the center line of the existing pavement.
STRUCTURE
An assembly of materials forming a construction for occupancy
or use, including, among others, buildings, stadiums, gospel and circus
tents, reviewing stands, platforms, stagings, observation towers,
radio towers, water tanks, trestles, piers, wharves, open sheds, coal
bins, shelters, fences and display signs.
SUBDIVISION
The division of a lot, tract or parcel of land into two or
more lots, tracts, parcels or other divisions of land for sale or
development. The following shall not be considered subdivisions within
the meaning of this chapter, if no new streets are created: divisions
of land found by the Planning Board to be for agricultural purposes
where all resulting parcels are five acres or larger in size; divisions
of property by testamentary or intestate provisions; divisions of
property upon court order; and conveyances so as to combine existing
lots by deed or other instrument. The term "subdivision" shall also
include the term "resubdivision."
TERRACE
A level, open area, without roof or walls, projecting from
the exterior wall of principal building, with direct access from that
principal building, which has been surfaced with brick, stone or other
landscaping material and which is elevated no greater than three feet
above finished grade.

THREE SEASON PATIO ROOM (aka SCREENED PORCH, FLORIDA ROOM, ETC.)
A roofed structure projecting from the exterior wall of a
principal residential building and intended to be used exclusively
as seasonal space accessory to the residential use, with direct access
from the residential building, and consisting of a finished floor,
roof and three windowed or screened walls. Such room shall be limited
to a single story, shall be located within the side or rear yard of
the primary residential structure and shall not be heated or air conditioned.

TRAILER COACH
Any dwelling unit which is equipped with wheels or some device
used for the purpose of transporting such unit from place to place,
whether by motive power or other means, or any unit used for temporary
living or sleeping purposes temporarily located in the locality, whether
the same is on blocks, posts or any other type of foundation.
TRAILER COACH PARK
Any plot of ground upon which two or more trailer coaches
occupied for dwelling or sleeping purposes are located, regardless
of whether or not a charge is made for such accommodations.
UNIT
See "dwelling unit."
USE
The purpose for which the building or structure is designed,
used or intended to be used.
WALL
A structural member which also serves to separate space.
WAREHOUSE, CONTRACTORS
A building used primarily for the storage of goods and materials
customarily required in the building trade by a construction contractor.

WIND ENERGY SYSTEM
A wind turbine and all associated equipment, including any
base, blade, foundation, nacelle, rotor, tower, transformer, vane,
wire, inverter, batteries or other component necessary to fully utilize
the wind generator.

WIND TURBINE
Equipment that converts energy from the wind into electricity.
This term includes the rotor, blades and associated mechanical and
electrical conversion components necessary to generate, store and/or
transfer energy.

YARD
The unobstructed space adjacent to a building. Porches and
bay windows shall be considered as part of the building and shall
not encroach into the established yard setback. Overhanging eaves,
gutters, cornices of two feet or less and stoops may encroach into
the established yard setback.

YARD, FRONT
An open, unoccupied space on the same lot with the principal
building, extending the full width of the lot and situated between
the street line and the front line of the building projected to the
side lines of that lot. The building line shall be synonymous with
the rearmost limit of the required front yard area. In the case of
a corner lot, each yard with frontage on a street shall be considered
a front yard.

YARD, REAR
A yard extending across the full width of the lot and lying
between the rear line of the lot and the nearest line of any building.
The depth of a rear yard shall be measured at right angles to the
rear line of the lot. In the case of a corner lot, only one rear yard
shall be provided.

YARD, SIDE
An open, unoccupied space between the side line of the lot
and the nearest line of a building and extending from the front yard
to the rear yard. The width of a side yard will be measured at right
angles to the side line of the lot. In the case of a corner lot, not
more than one side yard shall be provided; the side yard shall be
measured between the primary front yard and the rear yard as defined
under "lot, corner" herein.

ZONING PERMIT
A permit stating that the purpose for which a building or
land is to be used is in conformity with the uses permitted and all
other requirements under this chapter for the zone in which it is
located or it is to be located.
