The following words, terms and phrases, when used in this Chapter,
shall have the meanings ascribed in this Section.
ALLEY, COMMERCIAL
An internal access road serving non-residential properties.
A commercial alley generally provides secondary vehicular access to
the rear or side of a lot, block or parcel of land otherwise abutting
a street.
ALLEY, RESIDENTIAL
An internal subdivision access road serving as a secondary
vehicular access to the rear or side of a residential lot, block or
parcel.
AS-BUILT PLANS
Improvement plans depicting improvements as actually installed,
including horizontal and vertical location of underground utilities
and other underground facilities.
BENCH MARK
A definite point of elevation and location of more or less
permanent character based on United States Geological Survey (U.S.G.S.)
datum. Bench marks established by 1981 Metropolitan St. Louis Sewer
District (MSD) bench mark loop system or MoDOT are acceptable.
BLOCK
An area of land within a subdivision consisting of a series
of lots, entirely surrounded by streets, highways, rights-of-way,
streams, parks, etc., or a combination thereof.
BOUNDARY ADJUSTMENT
An adjustment of lot lines of platted lots or other lawful
parcels for the purpose of adjusting the sizes of frontages, configuration
of buildable lots or consolidation of existing lots which does not
create an additional lot.
BUILDING
Any structure having a roof supported by columns or walls
for the housing or enclosure of persons or animals. Where dwellings
are separated from each other by a division wall without openings,
each portion of such dwelling shall be deemed a separate building.
CALIPER
The diameter of a tree measured at a height of three (3)
feet above the surface of the ground at a distance of not more than
one (1) foot from the trunk.
COMMISSION
The Planning and Community Design Commission of the City
of Olivette, Missouri.
COMMON GROUND
Natural or landscaped open space within or related to a subdivision,
not in individually owned lots, designed and intended for resource
protection or siting common facilities (e.g., recreation facilities
and storm drainage detention facilities) and dedicated for the common
use of the residents of the subdivision.
CONDOMINIUM
Real property, portions of which are designated for separate
ownership and the remainder of which is designated for common ownership.
Real property is not a condominium unless the undivided interests
in the common elements are vested in the unit owners.
CONDOMINIUM PLAT
A plat of the parcel and of all units of a multi-unit building
or buildings which complies with the "Condominium Property Act", Chapter
448, RSMo., as amended.
DEVELOPMENT
All structures and other modifications of the natural landscape,
above and below ground or water on a particular site.
DIRECTOR
The Director of Public Services for the City of Olivette
or designee.
EASEMENT
A grant of one (1) or more of the property rights by a property
owner to, and for the use by, the public, corporation or another person
or entity.
FEMA
Federal Emergency Management Agency.
GRADE
The datum or reference level for a point on the ground or
the degree of inclination of a road or slope.
IMPROVEMENTS
Fixed works located on a lot or parcel including, without
limitation, pavement, bridges and culverts, water mains, fire hydrants,
storm sewer facilities, sanitary sewer facilities, signs, survey monuments,
landscaping, street lighting and other similar items.
LAND SURVEYOR
A registered land surveyor licensed to practice in the State
of Missouri.
LOT
A parcel of land intended to be separately owned, developed
and otherwise used as a unit.
LOT, CORNER
A lot abutting two (2) or more streets at their intersection.
LOT, FLAG
A lot having access provided to the bulk of the lot by a
narrow corridor of property.
LOT, IRREGULAR
A lot or parcel that has less than the required minimum area,
width or depth or a lot or parcel that exhibits a configuration which
is detrimental to or inhibits reasonable access and egress to and
from the street system.
LOT, NON-CONFORMING
A lot of record which fails to meet current applicable minimum
size or dimensional standards of the zoning district in which such
lot is located.
LOT OF RECORD
A lot which is a portion of a subdivision, the plat of which
has been recorded in the office of the St. Louis County Recorder or
other parcel lawfully established and officially recorded by deed;
provided that such lot or parcel was of a size and dimension that
met minimum requirements applicable at the time of its recordation
or establishment.
LOT WIDTH
The measured width of a lot along the front setback.
METES AND BOUNDS
The method used to describe a parcel of land by bearings
and distances.
MODOT
The Missouri Department of Highways and Transportation.
MONUMENT
The physical object which marks the corner point determined
by the surveying process. The accessories, such as bearing trees,
bearing objects, reference monuments, mounds of stone and other similar
objects that aid in identifying the corner position, are also considered
a part of a corner monument.
MSD
The Metropolitan St. Louis Sewer District.
OFF-SITE
Premises not located within the property to be subdivided
or developed, whether or not in the same ownership of the subdivider
requesting approval of the subdivision or development.
OWNER
A person, agent, firm, corporation or other organization
having a legal or equitable interest in property.
PEDESTRIAN WAY
Any designated pathway designed to separate pedestrian traffic
from vehicular traffic or otherwise provide for pedestrian traffic
circulation.
PLAT
A scaled map, plan or layout of a tract of land indicating
the subdivision of said tract of land in accordance with the requirements
of this Chapter.
RIGHT-OF-WAY
A strip of land, either public or private, on which an irrevocable
right-of-passage has been recorded for use of vehicles or pedestrians
or both or for the placement of utilities and which meets the minimum
prescribed width established by this Chapter.
SETBACK
The required minimum horizontal distance between the closest
point of an exterior wall of a building or any projection thereon
and the applicable property line or right-of-way line within which
no structure can be placed, unless otherwise provided for in the zoning
ordinance.
SIDEWALK
An improved pedestrian way, located within a street right-of-way
or an easement along a street, designed to separate pedestrian traffic
from vehicular traffic on such street.
SKETCH PLAT
A two-dimensional depiction of a subdivision showing proposed
layout of lots, streets and other surface improvements and meeting
other requirements of this Chapter.
SLOPE
The inclination from a horizontal reference line of the ground
surface and expressed by stating the horizontal distance relative
to the amount of vertical rise or fall (e.g., two (2) horizontal units
to one (1) vertical unit).
STREET
A public or private thoroughfare which affords the principal
means of vehicular access to abutting property. The term includes
all facilities which normally are found within a right-of-way. A street
may be designated as a highway, thoroughfare, parkway, throughway,
road, avenue, boulevard, lane, place, court or other such terms but
shall not include a pedestrian way or a residential or commercial
alley.
STREET, COMMERCIAL COLLECTOR
A street designed or used primarily for high vehicular speeds
or heavy volumes of traffic on a continuous route. Commercial collector
streets primarily serve non-residential uses and provides access from
residential collector, minor commercial or minor residential streets
onto a regional access system. Commercial collector streets are generally
under the jurisdiction of the MoDOT or the St. Louis County Department
of Highways and Traffic. Commercial collector streets include the
following: Olive Boulevard, Dielman Road (north of Olive Boulevard)
and North Price Road and such other streets as may be so designated
from time to time by the City Council.
STREET, CUL-DE-SAC
A minor residential or non-residential street, one (1) end
of which is closed and consists of a circular turnaround.
STREET, HALF-WIDTH
Any public or private street right-of-way which is less than
the full required width specified in this Chapter and which is established
so as to permit additional half-width street to be provided at a later
date to complete the full-width street, within the required right-of-way.
STREET, MINOR COMMERCIAL
A local street that primarily serves non-residential uses
to provide access onto a commercial collector. Minor commercial streets
include the following: Bauer Boulevard, Dielman Rock Island Drive,
Dielman Industrial Drive and Olivette Executive Drive and the first
five hundred (500) feet of any street accessing onto Olive Boulevard
and any such other streets as may be so designated from time to time
by the City Council.
STREET, MINOR RESIDENTIAL
A street that principally provides access to residential
properties and carries relatively low traffic volumes that are primarily
generated within the immediate residential neighborhood.
STREET, PRIVATE
A street which has not been dedicated to public use and accepted
for maintenance by the City of Olivette.
STREET, RESIDENTIAL COLLECTOR
A street designed to collect local residential traffic from
minor residential streets and minor subdivision streets onto a regional
access system and is designed or used primarily for high vehicular
speeds or heavy volumes of traffic on a continuous route. Residential
collector streets include the following: Old Bonhomme Road, Dielman
Road (south of Olive Boulevard), Engel Lane, Villa Avenue, Hilltop
Drive and the portion of Grandview Avenue accessing Warson Road and
such other streets as may be so designated from time to time by the
City Council.
STREET, STUB
Any street closed at one (1) end of which is closed and terminating
without a proper circular turnaround.
STRUCTURE
Anything constructed or erected, the use of which requires
permanent location on the ground or attached to something having a
permanent location on the ground including, but without limitation,
advertising signs, billboards, backstops for tennis courts, pergolas,
radio towers, memorials and ornamental structures. The word "structure" includes the word "building".
SUBDIVIDER
A person, firm, corporation or other organization undertaking
a development or subdivision.
SUBDIVISION
Any one (1) or more of the following activities with respect
to land:
1.
The division or redivision of a tract of land into two (2) or
more lots;
2.
The creation of a condominium;
3.
The consolidation of two (2) or more tracts of land into one
(1) lot;
5.
The dedication or establishment of a street or right-of-way
for use in conjunction with use or access to a tract of land; or
6.
It includes resubdivision and, when appropriate to the context,
relates to the process of subdividing or to the land or territory
subdivided.
SUBDIVISION ASSOCIATION
An organized association of owners that operates and maintains
various common properties of a subdivision.
SUBDIVISION, MINOR
A single-family residential subdivision consisting of ten
(10) or less lots.
SURVEY
A depiction together with a metes and bounds description
of a parcel, lot, subdivision or other continuous quantity of land
prepared by a registered land surveyor.
TRUST INDENTURE
A recordable instrument by which common ground and improvements
are held or maintained or through which assessments in a subdivision
are levied for administration of specific maintenance obligations.
U.S.G.S.
United States Geological Survey.
ZONING DISTRICT
A district, established by the Zoning Code, wherein certain
use and development regulations apply to the land located within the
district.

To facilitate the use of this Chapter, terms defined in this
Article have been capitalized wherever used in this Chapter; provided
that any failure to provide such capitalization in succeeding Articles
shall have no effect on the meaning of such term or its application
in this Chapter.
