The licensing provisions of this chapter shall not apply to any private dance, or to any dance, show, concert or other amusement or entertainment conducted under the supervision of Hope College, any public or parochial school, any church, or the City, or organizations under the control or direction of any of them, the Young Men's Christian Association, the Young Women's Christian Association, any fraternal beneficiary society when such amusement is open to members only, and not open to the public or any charitable organization as defined by IRC § 501(c)(3); nor shall the provisions of this chapter apply to religious services of any kind. This section shall not relieve any person or organization from obtaining a parade permit as provided in Section 18-20.

No person or organization shall present any theatrical exhibition, show, entertainment or amusement for which money or other compensation is in any manner demanded or received during Tulip Time week of any year, without first securing a license from the City Council for such presentation; provided, however, that persons licensed under Section 3-23 shall be exempt from the provisions of this section. If Council determines that the proposed activity: (a) detracts from, interferes with or is detrimental to planned Tulip Time activities; (b) is not in keeping with the theme of Tulip Time; or (c) would be in violation of any provisions of this Code or of state or federal law, such application for a license shall be denied, otherwise it shall be granted.
