For the purpose of this Chapter,
the following definitions shall apply unless the context clearly indicates
or requires a different meaning.
CHIEF OF POLICE
The Chief of Police of the Saint Charles City Police Department.
DIRECTOR
The Director of the Finance Department.
MASSAGE THERAPY
A health care profession which involves the treatment of
the body's tonus system through the scientific or skillful touching,
rubbing, pressing or other movements of the soft tissues of the body
with the hands, forearms, elbows, or feet, or with the aid of mechanical
apparatus, for relaxation, therapeutic, remedial or health maintenance
purposes to enhance the mental and physical well-being of the client,
but does not include the prescription of medication, spinal or joint
manipulation, the diagnosis of illness or disease, or any service
or procedure for which a license to practice medicine, chiropractic,
physical therapy, or podiatry is required by law, or to those occupations
defined in Chapter 329, RSMo.
PRACTICE OF MASSAGE
The administration of a massage to another person for any
form of consideration.

A. This Chapter shall not apply to:
1.
Physicians, surgeons, nurses, chiropractors,
physical therapists and osteopaths who are licensed to practice their
respective profession in the State.
2.
A trainer of any duly constituted
athletic team who administers a massage in the normal course of training
duties.
3.
Any cosmetologist, barber or manicurist
who is duly licensed under the law of the State and who administers
massages pursuant to such laws in the course of his/her duties.

No person shall engage in the practice
of massage within the City unless such person has first been issued
a massage technician license by the Director of Finance and unless
such license remains in effect in conformity with this Chapter.

A. Each application for a massage technician
license shall be submitted to the Director of Finance and shall contain
the following information:
1.
The applicant's full name, residential
address and telephone number;
2.
The name, address and telephone number
of the massage establishment;
3.
A copy of the license to practice
massage therapy from the State of Missouri;
4.
Three (3) portrait photographs, at
least two (2) inches by two (2) inches.

Any person obtaining a license to act as a massage technician shall pay to the Chief of Police an annual license fee in the amount stated in Section
150.030.

No massage technician license shall
be transferable.
