As used in this chapter, the following terms shall have the meanings indicated:
TEMPORARY CANOPIES
Temporary canopies, tents, overhangs and the like (hereinafter referred to collectively as "temporary canopies") that are raised on residential properties and lack footings, piling or foundations.
Temporary canopies are not permitted in residential properties in residential zones, except in accord with the below exceptions and location restrictions.
A. 
Temporary canopies, for recreational use, sun shade, or the like shall be permitted for the period between April 15 and November 15 each year, provided they do not constitute a nuisance.
B. 
The Zoning Officer or the Borough Manager may temporarily waive the restrictions of these requirements for up to 60 additional days at a time if the placement of the temporary canopy is in association with temporary storage or staging related to an emergency, such as, but not limited to, residential fire, hurricane, or a natural or man-made disaster, which event(s) caused substantial damage to a residential property or its contents.
C. 
Temporary canopies for special events, such as weddings, graduations and the like shall be permitted at any time of year, provided they are removed within five days of installation.
Temporary canopies are prohibited from being placed in streets or the front yard of a property. Temporary canopies placed in a side yard or rear yard shall comply with the setback requirements of the zone. No temporary canopy can be placed on a property in such a manner that it would create a sight obstruction for motorists or bicyclists.
A. 
Temporary canopies may not be used for the storage of vehicles, boats, recreational vehicles, jet skis, or the like, nor shall they be used for repair work on any of the above.
B. 
In no event, even under emergency conditions, may temporary canopies be used for the storage of hazardous material.
C. 
Temporary canopies may be used only for the temporary storage of construction material or debris if there is an open permit issued by the construction office for the property and the storage is related to the project under permit, provided that the use of the temporary canopy does not extend beyond 180 days.
D. 
No heat or temperature control source of any kind shall be placed in the temporary canopy. No utilities shall be connected to the temporary canopy.

Any person, firm, corporation, association or legal party whatsoever who or which shall violate, or authorize or procure a violation, or cause to be violated, any provision of this chapter shall, upon conviction thereof, be punishable as provided under the general penalty provisions found at § 1-15 of this Code. This, however, shall not apply against any municipal employee or officer that authorizes action by permit or otherwise in the ordinary course of their duties.
