As used in this chapter, the following terms shall have the
meanings indicated:
USED TIRES
Any type of rubber tire that has been mounted and attached
to any type of vehicle or equipment.
The storage of used vehicle tires is prohibited in all districts,
with the following exceptions:
A. Automobile dealerships, automotive garages, trucking companies, excavating
companies, tire manufacturers, tire recapping and recycling operations
and repair shops may store up to 200 used tires, provided that such
storage takes place entirely within the building or buildings or outside
and effectively screened with a fenced enclosure to eliminate visibility
from surrounding properties at street levels and from public streets.
B. Farms may store up to 200 used tires, provided that such storage
takes place entirely within the farm buildings, except for in bunker
silos, where a maximum of 500 may be allowed.
C. The Town Board of the Town of LeRoy may grant a special permit for entities engaged in any of the uses set forth in Subsection
A or
B above for storage of additional tires.
(1) In granting such special permit, the Town Board shall specifically
consider the following:
(a)
Risk of fire, such as fire lanes and proof of adequate fire
protection.
(b)
Adequate screening from view from highways and adjoining property.
(c)
Impact on the environment.
(d)
Such other items as the Board may deem desirable or appropriate.
(2) In granting such permit, the Board shall be empowered to impose such
conditions as it deems necessary, convenient and/or appropriate to
control any noise, traffic, dust, smoke, glare, fire hazard, possibility
of pollution of the air or water or any other condition it finds.
D. Private homeowners and tenants of apartments may store up to 10 used
tires, provided that such storage takes place entirely within the
building.
Any person, firm or corporation who or which violates the provisions
of this chapter shall be guilty of an offense and, upon conviction,
shall be subject to a fine not to exceed $250, 15 days' imprisonment,
or both, for each offense. Each day that the provisions of this chapter
are violated shall constitute a separate offense.
