There is hereby created and established the office of City Administrator
for the City of Chaffee, Missouri.

A. A qualified
person shall be appointed City Administrator for the City of Chaffee,
Missouri, by the Mayor; such appointment shall be approved by a majority
of the members of the City Council. The person so appointed shall
serve for an indefinite term.
B. The City
Administrator shall be at least twenty-five (25) years of age and
shall have executive and administrative qualifications. The City Administrator
shall establish residence within the distance of twenty-five (25)
miles of the City of Chaffee, Missouri, within one (1) year of the
date of employment. The City Administrator shall devote full-time
to the duties of the office of City Administrator.
C. The City
Administrator, before entering upon the duties of his/her office,
shall file with the City bond in the amount of fifty thousand dollars
($50,000.00); such bond shall be approved by the City Council and
conditioned upon faithful and honest performance of his/her duties
and the rendering of full and proper accounts to the City for funds
and property that shall come into his/her possession or control of
the City Administrator. The cost of said bond shall be paid by the
City; however, should the City Administrator be covered by a blanket
bond to the same extent, an individual bond shall not be required.
D. Before
entering upon the duties of office, the City Administrator shall take
and subscribe to an oath or affirmation before the City Clerk, or
someone authorized to administer oaths, that the City Administrator
possesses all of the qualifications prescribed for the office by law;
that the City Administrator will support the Constitution of the United
States and the State of Missouri, the provisions of all laws of the
State of Missouri and the ordinances of the City and that the City
Administrator will faithfully demean himself/herself while in office.

The compensation of the City Administrator shall be established
in accordance with the annual budget ordinance or ordinance approving
the annual pay plan for employees of the City or an ordinance adopted
by the City Council that may specifically establish, modify or change
the compensation for the City Administrator.

The City Administrator shall serve at the pleasure of the appointing
authority. The City Administrator may be removed from office at will
by the City Council by a three-fourths (¾) vote of all members
elected to the City Council. Said authority may be exercised by the
City Council independently of the Mayor's approval, veto or disapproval.
If requested, the Mayor and City Council shall grant the City Administrator
a public hearing within thirty (30) days following notice of such
removal. During the interim, the Mayor, with the approval of a majority
of all members of the City Council or by two-thirds (2/3) of
all members of the City Council without the Mayor's approval, may
suspend the City Administrator from any further duties as City Administrator,
but may continue his/her salary for no more than a maximum of two
(2) calendar months following the initial notification to the City
Administrator of his/her termination and removal from office; provided
however, that if the City Administrator shall be removed for acts
of dishonesty or moral turpitude, such salary shall not be continued.
Nothing contained herein shall be construed to require or make mandatory
the continuation of compensation or salary of the City Administrator
for any time period subsequent to the date of initial notification
to the City Administrator of his/her termination and removal from
office.

A. The City
Administrator shall be the Chief Administrative Assistant to the Mayor
and shall have general, superintending control of the administration
and management of the government business, officers and employees
of the City, subject to the direction and supervision of the Mayor
and City Council. The City Administrator may head one (1) or more
departments and shall be responsible to the Mayor and the City Council
for proper administration and management of the government business,
officers and employees of the City. To that end, the City Administrator
shall have power and shall be required to:
1. Coordinate
Federal and State programs which may have application to the City
of Chaffee, Missouri, and make such applications and file such documents
as are necessary for application for grants and monies for said programs
as directed by the City Council. He/she shall administer all grants
and public funds bestowed upon the City and maintain adequate accounting
records thereof, subject to the direction of the Mayor and Council.
2. Prepare
the proposed budget annually and submit it to the Finance Committee
of the City Council for recommendation and submit it to the City Council
together with a message describing important features; the budget
is to be supported by appropriate schedules and analysis. The City
Administrator shall be designated the "budget officer" of the City.
The City Administrator shall make reports to the Finance Committee
of the City Council and the City Council relative to the financial
condition of the City; such reports shall be at least monthly and
at such other times as requested by the Finance Committee or the City
Council or Mayor.
3. Act
as personnel officer of the City of Chaffee and shall recommend an
appropriate position classification system and pay plan to the Mayor
and City Council at least annually. The City Administrator shall be
entitled to suspend, with or without pay, any employee of the City
of Chaffee including any member of the Police Department (not including
however, any elected or appointed official) for a period not to exceed
thirty (30) days. The City Administrator shall also recommend for
adoption by the City Council standard personnel procedures.
4. Recommend
to the Mayor and the City Council the adoption of such measures as
the City Administrator may deem necessary or expedient for the health,
safety or welfare of the City of Chaffee or for the improvement of
administrative services for the City of Chaffee. The City Administrator
shall submit to the Mayor and the City Council a proposed agenda for
each Council meeting at least forty-eight (48) hours before the time
of the regular Council meeting.
5. Work
with all City boards, commissions and committees and serve as an advisor
to each. The City Administrator shall help coordinate the work of
each committee, board or commission for the betterment of the City
of Chaffee. The City Administrator shall attend all meetings of the
City Council, Police Personnel Board, Library Board and Park Board,
unless excused therefrom.
6. Serve
as the purchasing agent of the City of Chaffee and all purchases amounting
to less than five hundred dollars ($500.00) shall be made under the
direction and supervision of the City Administrator. All such purchases
shall be made in accordance with the purchasing rules and procedures
as approved by the City Council.
7. Supervise
the preparation of all bid specifications for services and equipment,
and receive sealed bids for presentation to the City Council.
8. Attend
State and regional conferences and programs applicable to the office
of City Administrator and the business of the City of Chaffee, whenever
such attendance is directed and approved by the City Council and the
Mayor.
9. Keep
full and accurate records of all actions taken by him/her in the course
of his/her duties, and shall safely and properly keep all records
and papers belonging to the City of Chaffee and entrusted to his/her
care, and shall maintain the personnel records of the City. All such
records shall be and remain the property of the City of Chaffee and
shall be open to inspection by the Mayor and City Council at all times.
In the event of the City Administrator's absence, all records of the
City Administrator, including personnel records, shall be maintained
by the Mayor.
10. Have
responsibility for all real and personal property of the City of Chaffee.
The City Administrator shall have responsibility for all inventories
of such property and for the upkeep of such property.
11. Account
to the Mayor and the City Council for any actions taken when requested
to do so, and at all times shall be subject to supervision, control
and direction of the Mayor and the City Council.
12. Investigate
and examine or inquire into the affairs or operation of any department
of the City of Chaffee or employee thereof under his/her jurisdiction,
and shall report on any such condition or fact concerning the City
Government as requested by the Mayor or City Council.
13. Coordinate
the work of all departments of the City and, at times of an emergency,
shall have authority to assign the employees of the City to any department
where they are needed for the most effective discharge of the functions
of the City Government.
14. Overrule
any action taken by the head of a department, which is not under the
control of a board or commission appointed by the City Council.
15. Meet
with standing committees appointed by the Mayor on matters concerning
general and special administrative problems, who shall consult with
and render advice to the City Administrator on such matters.
16. In
addition to the foregoing duties, the City Administrator shall perform
any and all other duties or functions prescribed by the Mayor and
City Council.
17. At
no time shall the duties or powers of the City Administrator supersede
the action by the Mayor or City Council.

No individual member of the City Council shall directly interfere
with the conduct of any department or duties of employees subordinate
to the City Administrator except at the expressed direction of the
City Council pursuant to an authorized vote at a Council meeting,
or with the approval of the City Administrator. The word "interfere", as used in this Section, means any act which tends to countermand
an order or direction of the City Administrator or any act which directs
an employee to take any action not authorized by the City Administrator.
