A. The City
Collector of the City of Chaffee, Missouri, shall be appointed by
the Mayor and approved by a majority of the members of the City Council
of said City, and shall hold his/her office for a term of one (1)
year thereafter and until his/her successor is duly appointed and
qualified. No person shall be eligible to hold the office of City
Collector who is not a qualified voter of the City of Chaffee, Missouri,
and who shall not have been a resident of the City of Chaffee, Missouri,
for at least one (1) year next preceding the date of his/her appointment
or who shall be at the time of such appointment in arrears for any
unpaid City taxes or guilty of forfeiture or defalcation in office.
B. The Collector
of this City shall have power to employ one (1) or more deputies to
assist in the performance of the duties of that office, whenever in
his/her judgment it shall be necessary. In every such case, the Collector
shall be liable for the acts, conduct and behavior of any and all
such deputies, and for all monies handled by them, belonging to the
City or owing to the City. The Collector shall have the right to require
a bond of any such deputy or deputies, to himself/herself, to remunerate
and indemnify himself/herself in any way whatever from any and all
losses occurring in any way whatever in connection with the City monies
by reason of negligence, mistake, crime or fraud, or fault of any
such deputy or deputies. All such deputies shall be paid by the Collector
appointing them, and the City shall in no case be liable for the compensation,
or any part thereof, of any such deputy or deputies.
C. The Collector
shall make a report in writing to the Council, at its first (1st)
regular meeting of each month, setting out in full the amount of money
received by his/her office during the preceding month and from what
source or sources received, the amount of his/her commissions thereon
and the amount paid into the City Treasury and exhibit his/her receipts.
D. At the
first (1st) regular meeting of the Council in January of each year,
the Collector shall make a detailed report in writing to the Council,
which report shall contain a complete statement of all monies due
the City from various sources collected during the preceding year
ending December thirty-first (31st). The report shall also contain
a statement of the amount due the City from various sources as the
same appear in the books of the City and also the total amount of
fees paid said Collector for his/her services during said period.
E. All fees
earned and collected by the City Collector shall be paid into the
City Treasury and become a part of its General Revenue Fund. Provided
however, that nothing herein contained shall be construed to mean
that in computing the compensation on amounts collected shall the
fees and like penalties on delinquent real and personal taxes be included,
when such fees and penalties are collected for the benefit of officers,
abstract fees and other money advanced by the City, if any, towards
the collection of such delinquent taxes aforesaid.
