A. The
Clerk of the Municipal Court of the City of Chaffee shall be selected
by a majority vote of the City Council and shall serve as such at
the pleasure of the City Council.
B. The
compensation to be paid to the Clerk of the Municipal Court shall
be established by the City Council at such intervals as the City Council
shall deem appropriate.
C. The
duties of the Clerk of the Municipal Court or any assistant to the
Clerk of the Municipal Court shall be as follows:
1. To collect fines and Court costs for violations of City ordinances.
2. To take oaths and affirmations.
3. To accept signed complaints, and allow the same to be signed and
sworn to or affirmed before him/her.
4. To sign and issue subpoenas or subpoenas ducus tecum requiring the
attendance of witnesses.
5. To accept the appearance, waiver of trial, plea of guilty, and payment
of fines and costs in Traffic Violation Bureau cases or as otherwise
directed by the Municipal Judge.
6. To perform all other duties as provided for by ordinance, by the
Rules of Practice and Procedure adopted by the Municipal Judge and
by the Missouri Rules of Practice and Procedure in Municipal and Traffic
Courts, or by State law.
7. To maintain, properly certified by the City Clerk, a complete copy
of the City ordinances which shall constitute prima facie evidence
of such ordinance before the Municipal Court. Further, to maintain
a similarly certified copy on file with the Clerk serving the Circuit
Court of Scott County, Missouri.
Within fifteen (15) days after appointment and before entering
upon the discharge of the above described duties of office, the Court
Clerk shall give bond in a sum as determined by the City conditioned
upon the faithful performance of said duties and the said Court Clerk
will pay over all monies belonging to the City, as provided by law,
that may come into the Court Clerk's hands.
