There is hereby established a Fire Department for the City of
Chaffee, Missouri, which shall consist of a Chief, one (1) Assistant
Fire Chief, two (2) Captains, two (2) Lieutenants and as many assistant
firemen as the Council may from time to time appoint; and such number
of organized volunteer firemen as may be enrolled by the Fire Chief,
with the consent and approval of the Mayor and the Council, with said
total Fire Department not to exceed twenty (20) in number.

At the first (1st) regular meeting of the Council in April of
each year, the Mayor shall, by and with the consent and advice of
the Council, appoint some suitable and competent person to the office
of Fire Chief and shall at the same time appoint some suitable and
competent person to the office of Assistant Fire Chief. The persons
so appointed Chief and Assistant Fire Chief shall hold their offices
for one (1) year and until their successors are duly appointed and
qualified, unless sooner removed by the Mayor and Council according
to law and ordinance. Thereafter, the Fire Chief shall, with the consent
and approval of the Mayor and Council, designate two (2) members of
the Fire Department as Captains and designate two (2) members of the
Fire Department as Lieutenants.

A. The
Chief of the Fire Department and the Assistant Chief of the Fire Department
and each fireman appointed under the provisions of this Chapter shall:
1. Be a citizen of the United States of America,
2. Be a resident of the State of Missouri,
3. Be at least eighteen (18) years of age,
4. Be in good physical condition, and
5. Residency requirements.
a. Be a resident of the City of Chaffee, Missouri, or
b. Reside within a radius of ten (10) miles of the City of Chaffee,
Missouri, or
c. Be employed in a full-time capacity at an employment location located
within the City limits of the City of Chaffee, Missouri.
B. Notwithstanding
the qualifications as set forth hereinabove, no more than five (5)
members of the Fire Department may reside outside the City limits
of the City of Chaffee, Missouri.

Any member of the Fire Department may be removed from office
by the Mayor together with the consent and approval of a majority
of the members elected to the Council at will.

The Chief of the Fire Department shall have superintending control
over the Fire Department at all times and the members of the Fire
Department shall yield obedience to his/her orders in matters pertaining
to the Fire Department; provided that in the absence of the Fire Chief,
the Assistant shall be in command at fires and shall discharge all
the duties of the Chief. During the time that such Assistant shall
perform the duties of the Chief, he/she shall receive the same compensation
as the Chief for such services.

Assistant firemen shall, at all times, be under the direction
of the Chief and Assistant Chief, and during a fire shall repair without
delay to the endangered premises, and upon arrival report to the Chief
or Assistant Chief for instructions.

It shall be the duty of the Chief to report to the Council any
violation of any ordinance of this City for the prevention of fires
and shall swear to complaints before the Police judge or Municipal
Court Clerk or any other person authorized to take an oath on said
complaints against any person violating any of such ordinance.

The Fire Chief shall give a written report to the Council at
the first (1st) regular meeting of each month of the condition of
the fire apparatus, any repairs made or needed and any recommendations
for the betterment of the service or equipment. He/she shall also
report to the Council all fire alarms responded to during the preceding
month and how many of the members responded or failed to respond and
answer fire alarms, with the names of those responding and those failing
to respond to the fire alarms.

The Chief and Assistant and all other firemen appointed by the
Council shall receive as compensation for their services such sum
as may be designated by resolution at the time of the appointment.

A. When the Fire Department of the City of Chaffee responds to a request
for services to be provided outside the City limits of Chaffee, Missouri,
there is hereby established a fee for such services as set forth hereinbelow:

Service call with no fire involved (e.g., fire alarm, search
and rescue, flooding and other such events)

B. In addition to the charges in Subsection
(A), any water that has been provided from the City of Chaffee shall be included in the costs identified above and shall be calculated pursuant to Chaffee Ordinance, Section
700.220(A)(1).
C. The type of services performed and the length of time that the Fire
Department responded outside the City limits shall be determined by
the Fire Chief or Assistant Fire Chief of the City of Chaffee, Missouri.
D. The fees set forth in this Section are to be paid by the person requesting
the service and/or the owner of the property for which the service
was requested. There shall be no such fee when the request for firefighting
services is made by another municipality or governmental entity.
E. Notwithstanding the above, the Fire Chief or the Assistant Fire Chief,
in their sole discretion, may refuse to respond to a fire or other
incident outside of the City limits of the City of Chaffee, Missouri.
Further, in the event that the Fire Department of the City of Chaffee
responds to an incident outside of the City limits of the City of
Chaffee and during that incident a request for fire services arises
within the City limits of the City of Chaffee, Missouri, then in the
sole discretion of the Fire Chief or the Assistant Fire Chief of the
City of Chaffee, Missouri, the Fire Department may discontinue the
response to the out of City incident and the Fire Department may immediately
respond to the incident arising within the City of Chaffee, Missouri.
