The purpose of this chapter is to regulate activities
and behavior on the multi-use trails in the Town of Lloyd so as to
enhance the enjoyment of and provide protection for all persons using
the trails and to provide appropriate penalties and enforcement procedures
for violations.
As used in this chapter, the following terms
shall have the meanings indicated:
MULTI-USE TRAILS
Trails used for hiking, biking, roller-blading, cross-country
skiing, walking, jogging, equestrian or similar uses and located on
property owned by or licensed or leased to the town or to which the
town has been granted an easement to use such property for such uses.
It shall be a violation of this chapter for
any person not to comply with the following regulations with respect
to multi-use trails:
A. Hours. No person shall use any multi-use trail from
dusk to dawn, except to participate in a supervised program of the
town.
B. Noninterference with persons and wildlife. No person
shall annoy, harass or otherwise harm any other person or disturb
or damage any wildlife.
C. Care of property. No person shall damage, destroy,
remove or misuse any property or plant life.
D. Avoidance of littering. No person shall leave, deposit
or throw any litter or throwaways. The policy shall be that anything
carried in will be carried out.
E. Control of pets. Any dog or pet taken onto a multi-use
trail shall be on a nonretractable leash which shall be no longer
than six feet. The leash in use shall be of a length so as to not
interfere with the safety and enjoyment of other users of the trail.
Pet owners shall curb their dogs off the trail and shall prevent
their pets from littering the trail. Owners and keepers are responsible
for cleanup in the event that a pet leaves any residue which could
be harmful or dangerous to other users of the trail.

F. Equestrian use of unpaved trails is allowed. No horse
shall travel the paved portion of any trail except to cross it.
G. Prohibited uses: motor vehicles, except for emergency
vehicles, motorized wheelchairs and authorized vehicles. There shall
be no recreational motor-driven vehicles or all-terrain vehicles permitted
on any trail.
H. No one shall discharge any firearms, fireworks or
bows and arrows from or across a trail, except as part of a town-sponsored
event. All firearms shall be unloaded while users are on or crossing
the trail.
I. Alcoholic beverages. No one shall possess or partake
of any alcoholic beverage except in a facility duly licensed to serve
alcoholic beverages or at a town-sponsored event for which the presence
of alcoholic beverages has been specifically approved by the Town
Board or his designee.
J. Nuisance. No person shall create a nuisance detrimental
to the health, morals, safety, convenience and welfare of persons
in public areas.
K. Encroachments. No person shall create a barrier or
place or construct, upon any of the town's multi-use trail rights-of-way,
any structures, building materials or natural materials which would
in any way encroach upon or block the path or any part of the way
utilized by the town and by the public for public purposes, or encroach
in any way or barricade the said multi-use trails, excepting those
structures or other improvements to be constructed by and for the
town for the public good which have been approved by the Town Board.
L. Bicycles.

(1) Persons riding bicycles on any multi-use trail must yield to pedestrians
using the multi-use trail.
(2) No person shall operate a bicycle on any multi-use trail unless it
is equipped with a bell or other device capable of giving a signal
audible for a distance of at least 100 feet, except that a bicycle
shall not be equipped with, nor shall any person use upon a bicycle,
any siren or whistle.
(3) When overtaking pedestrians on any multi-use trail, cyclists must
give ample reasonable warning and must pass said pedestrians in single
file at a prudent and responsible speed. When coming from the opposite
direction, cyclists must pass pedestrians in single file at a prudent
and responsible speed.
M. Waivers. The Town Board can, for good reasons, issue
limited temporary exceptions and waivers to the activities allowed
and prohibited on the multi-use trails.
Any person violating any of the above provisions
shall have committed an offense and shall be fined for each violation
not less than $50 nor more than $200 or imprisoned for not more than
15 days on any violation of this chapter of the Town Code. Any person
who violates any federal law, the Penal Code of the State of New York
or provisions of the Town of Lloyd Code, the State Motor Vehicle Laws
or other state laws on the multi-use trail shall be subject to such
additional penalties as such law provides, in addition to the penalties
provided in this section. Town officials, employees and other officers,
specifically designated by the Town Board, the Town of Lloyd Police,
the Ulster County Sheriff's Department and the New York State Police
shall issue citations for violations of any of the provisions set
forth above.
The procedure for any tickets or other complaints
issued for violations of the above regulations shall follow the procedures
for Justice Courts and the Criminal Procedure Law, and in addition
the Town Board may bring civil action for violations in the State
of New York Supreme Court to obtain injunctions or civil penalties
at the rate of $100 per week for any continuing violation of this
chapter of the Town Code.
