This Chapter may be cited and shall be known as the "Solid Waste
Management Code of Jefferson County, Missouri".
The provisions of this Chapter shall be effective within unincorporated
Jefferson County.

For the purposes of this Chapter, the following terms shall
be deemed to have the meaning indicated below:
APPROVED DISPOSAL SITE
Any site where final disposition of waste is made under plans
for development and operation approved by responsible local, State
and Federal agencies.
APPROVED INCINERATOR
An incinerator which operates under applicable permits approved
by responsible local State and Federal agencies.
APPROVED PROCESSING SITE
Incinerators, transfer stations, compost plants or any reclamation,
recycling, salvage or other site where processing and/or storage before
or after processing of solid waste is done, which operate under application
permits approved by responsible local State and Federal agencies.
BULKY RUBBISH
Non-putrescible solid wastes consisting of combustible and/or
non-combustible waste materials from dwelling units, commercial, industrial,
institutional or agricultural establishments which are either too
large or too heavy to be safely and conveniently loaded in solid waste
transportation vehicles by solid waste collectors with equipment available,
including discarded large appliances such as freezers, refrigerators,
water heaters, etc.
COLLECTION
Removal of solid waste from its place of storage to the transportation
vehicle.
COUNTY
The unincorporated areas of Jefferson County.
DEMOLITION AND CONSTRUCTION WASTE
Solid waste materials from the construction or destruction
of residential, industrial or commercial structure or rubble from
burned buildings.
DEMOLITION LANDFILL
A solid waste disposal area used for the controlled disposal
of demolition wastes, construction materials, brush, wood wastes,
soil, rock, concrete and non-decomposable inert solids insoluble in
water.
DERELICT VEHICLES
Any vehicle that is inoperable (unable to start and move
under its own power), partially or totally dismantled, or has portions
of its body work missing or is substantially damaged. Derelict vehicles
may include, but are not limited to cars, trucks, motorcycles, construction
equipment, recreational equipment (such as boats, campers, motor homes,
ATVs, and go-carts), lawn and garden equipment, and trailers (such
as utility, boat, and box).
DIRECTOR
The Director of the Department of County Services and Code
Enforcement of Jefferson County, Missouri or his/her authorized representative.
DISPOSABLE SOLID WASTE CONTAINERS
Disposable plastic or paper sacks with a capacity of twenty
(20) to thirty-five (35) gallons specifically designed for storage
of solid waste.
DISPOSAL
Final disposition of solid waste.
DIVISION
The Solid Waste Division of Jefferson County, Missouri.
DNR
The Missouri Department of Natural Resources.
DWELLING UNIT
Any room or group of rooms located within a structure and
forming a single habitable unit with facilities which are used or
are intended to be used for living, sleeping, cooking and eating.
GARBAGE
Putrescible animal or vegetable waste resulting from the
handling, preparation, cooking, serving or consumption of food.
HAZARDOUS WASTE
Any waste or combination of wastes, as determined by the
Hazardous Waste Management of the State of Missouri by rules and regulations,
which, because of its quantity, concentration, or physical, chemical
or infectious characteristics, may cause or significantly contribute
to an increase in mortality or an increase in serious irreversible,
or incapacitating reversible, illness, or pose a present or potential
threat to the health of humans or the environment.
INCINERATOR
A solid waste processing facility consisting of any device
or structure used for weight or volume reduction of solid waste by
combustion pursuant to disposal or salvaging operations.
OCCUPANT
Any person who, alone or jointly or severally with others,
shall be in actual possession of any dwelling unit or of any other
improved real property, either as owner or as a tenant.
OPEN BURNING
Burning of solid wastes in the open, such as open dump.
OPEN DUMP
A solid waste disposal area at which solid wastes are disposed
of in a manner that does not protect the environment, are susceptible
to open burning and are exposed to the elements, vectors and scavengers.
OPERATOR
A person other than the owner principally responsible for
the operation of a solid waste disposal area or solid waste processing
facility.
OWNER
The person or persons holding title in fee to the land upon
which the solid waste disposal area or solid waste processing facility
is located; or, during periods of operation or necessary subsequent
controls, any leaseholder of the land upon which a disposal area or
processing facility is located; or both such holder in fee or such
leaseholder.
PERSON
Any individual, partnership, corporation, association, institution,
City, County, other political subdivision, authority, State agency
or institution, or Federal agency or institution.
PLANS
Reports and drawings, including a narrative operating description
prepared to describe the solid waste disposal area or solid waste
processing facility and its proposed operation.
PROCESSING
Incinerating, composting, baling, shredding, salvaging, resource
recovery, recycling, reclaiming, compacting and other processes whereby
solid waste characteristics are modified or solid waste quantity is
reduced.
RUBBLE
Solid waste consisting of building material from a structure
demolished by burning.
RUNOFF
The portion of precipitation that drains from an area as
surface flow.
SALVAGE STORAGE AND PROCESSING YARD
Any solid waste processing and/or storage site where derelict
vehicles, used automobile parts, tires, discarded appliances or metal
solid waste, or any combination thereof, are stored, processed or
salvaged outside a building.
SALVAGING
The controlled removal of solid waste materials for utilization.
SLUDGE
The accumulated semi-solid suspension of settled solids deposited
from wastewaters or other fluids in tanks or basins.
SOLID WASTE
Unwanted or discarded waste materials in solid or semi-solid
state including, but not limited to, garbage, ashes, street refuse,
rubbish, bulky rubbish, dead animals, animal and agricultural wastes,
yard wastes, discarded appliances, special wastes, industrial wastes,
demolition and construction wastes and rubble, discarded tires, derelict
vehicles or their parts, and items no longer being used for their
intended purpose which pose a risk to public health or safety.

COMMERCIAL SOLID WASTESolid waste resulting from the operation of any commercial, industrial, institutional or agricultural establishment.
2.
RESIDENTIAL SOLID WASTESolid waste resulting from the maintenance, occupancy and operation of dwelling units including multiple-housing facilities.
SOLID WASTE CONTAINER
Receptacle used by any person to store solid waste during
the interval between solid waste collections.
SOLID WASTE DISPOSAL
The process of discarding or getting rid of unwanted materials.
In particular, the final disposition of solid waste by man.
SOLID WASTE MANAGEMENT SYSTEM
The entire process of managing solid waste in a manner which
minimizes the generation and subsequent disposal of solid waste, including
waste reduction, source separation, collection, storage, transportation,
recycling, resource recovery, volume minimization, processing, market
development, and disposal of solid wastes.
SPECIAL WASTES
Solid wastes requiring handling other than that normally
used for municipal wastes.
STORAGE
Keeping, maintaining or storing solid waste from the time
of its production until the time of its collection.
TRANSFER STATION
A site or facility which accepts solid waste for temporary
storage, or consolidation and further transfer to a waste disposal,
processing or storage facility.
TRANSPORTATION
The transporting of solid waste from the place of collection
or processing to a solid waste processing facility or solid waste
disposal area.
YARD WASTES
Grass clippings, leaves and debris from dead, fallen or felled
trees.

A. Adequate Trash Storage Required. The owner and/or occupant of every dwelling unit and all institutional, commercial, industrial or agricultural establishments producing solid waste within the County shall provide sufficient and adequate containers for the storage of all solid waste, except bulky rubbish and demolition and construction waste and certain yard wastes (see Subsection
(D)) to serve each such dwelling unit and/or establishment and shall maintain such solid waste containers in good repair at all times.
B. Residential Solid Waste Containers. Residential solid waste shall be stored in containers of not more than thirty-five (35) gallons or less than twenty (20) gallons in nominal capacity. Containers shall be leakproof, waterproof, and fitted with a fly-tight lid and shall be properly covered at all times, except when depositing waste therein or removing the contents thereof. The containers shall have handles, bails or other suitable lifting devices or features. Containers shall be of a type originally manufactured for residential solid waste with tapered sides for easy emptying. They shall be of lightweight and sturdy construction. The weight of any individual container and contents shall not exceed seventy-five (75) pounds. Galvanized metal containers, or rubber, fiberglass or plastic containers which do not become brittle in cold weather may be used. Disposable solid waste containers, as approved by the Director, may also be used for storage of residential solid waste. Multiple-housing facilities of four (4) or more units shall use bulk containers for storage of solid waste as described in Subsection
(C).
C. Non-Residential Solid Waste Containers. Commercial, industrial,
institutional or agricultural establishments shall store solid waste
in adequate solid waste containers as approved by the Director. The
containers shall be identified with the owner's name and/or phone
number, the containers shall be waterproof, leakproof and covered
at all times if so designed, except when depositing waste therein
or removing waste therefrom, and shall be cleaned periodically by
the collector. Waste deposited therein shall first be enclosed in
disposable containers by the establishment served.
D. Yard Wastes. Yard wastes shall be stored in containers so
constructed and maintained as to prevent the dispersal of wastes therein
on the premises served or upon adjacent public rights-of-way. The
weight of any individual container shall be determined by the solid
waste collector.
E. Waste Container Location. Residential solid waste containers
shall be stored upon the residential premises. Commercial solid waste
containers shall be stored upon private property. The storage site
shall be well drained, fully accessible to collection equipment, public
health personnel and fire inspection personnel and shall provide a
solid base for containers. The base shall be level with the ground.
F. Bulky Rubbish Storage. The owner and/or occupant of every
dwelling unit and all institutional, commercial, industrial or agricultural
establishments producing bulky rubbish shall store such rubbish within
the confines of a building until the day of collection and transportation
to an approved disposal site.
G. Demolition And Construction Waste Storage. Any person producing
demolition and construction waste while building or demolishing a
single structure shall store the waste on the building site no longer
than fourteen (14) days after the structure is completed or demolished
before disposing of the waste at an approved disposal site. Any person
producing demolition and construction waste while simultaneously building
or demolishing two (2) or more structures in the same development
shall store the waste on the premises no longer than thirty (30) days
between dates of collection and disposal at an approved disposal site.
H. Rubble Storage. Any person owning a structure which has
been:
1. Reduced
to rubble by fire;
2. Demolished
after a fire on order of the Jefferson County Code Official acting
on the regulations specified in the Jefferson County Building Code;
3. Demolished
after condemnation by the Fire Marshall of the fire district wherein
the burned or hazardous structure is located; or
4. Reduced
to rubble by any combination thereof;

shall be allowed to retain rubble on the site of the fire no
longer than forty-five (45) days from date of notice from the Director
for disposal of rubble to such person, same to be disposed of only
at an approved site. The notice of disposal shall be set by the Director
after his/her inspection of the site and consultation with the Code
Official and/or the Fire Marshall in whose district the structure
is located.

A. Waste Collection Required. The owner and/or occupant of
every dwelling unit and all institutional, commercial, industrial,
agricultural or other establishments producing solid waste in the
County shall be required to have solid waste collection service by
a hauler of their choice who has a valid Jefferson County hauling
permit for the collection, transportation and disposal of solid waste.
The cost of such collection shall be negotiated between the hauler
and the owner and/or occupant or establishment. Such cost as is incurred
shall be borne by the owner and/or occupant or establishment producing
the solid waste.
B. Waste Collection And Waste Ownership. All solid waste properly
prepared for collection as required by this Section shall be collected
by the owner and/or occupant's selected hauler, except bulky rubbish
as defined herein, provided however, that bulky rubbish will be collected
if tied securely in bundles not exceeding reasonable limitations of
weight and bulk as required by the hauler. All solid waste collected
shall, upon being loaded into transportation equipment, become the
property of the hauler.
C. Pickup. All solid waste containers as required by this Chapter for the storage of residential solid waste and yard wastes as regulated in Section
250.020(B —
D) and other solid waste authorized for pickup in this Section by solid waste collectors shall be placed on the designated collection day at a location on the owner and/or occupant's property previously agreed upon by the hauler and the owner and/or occupant. All such containers and solid waste shall be placed for collection in an area not subject to runoff from storm water. The containers shall be returned within twenty-four (24) hours after collection to the owner and/or occupant's storage location.
D. Right Of Entry For Collector. Solid waste collectors operating
with a valid hauling permit from the Director are hereby authorized
to enter upon private property for the purpose of collecting solid
waste therefrom as required by this Section. Solid waste collectors
shall not enter dwelling units or commercial establishments for the
purpose of collecting residential or commercial solid waste without
prior agreement with the owner and/or occupant of such dwelling unit
or commercial establishment or their duly authorized agent.
E. Residential Collection Frequency. All owners and/or occupants
of residential structures shall arrange for the removal of solid waste
at least once per week. Exceptions to the minimum collection service
required would be:
1. In case
of weather so severe as to make collection on a particular day impossible,
or
2. In the
event of a national holiday falling on a regularly scheduled collection
day, or
3. In low
population density areas to be determined by the Director.
F. Bulky Rubbish Collection. The opportunity for bulky rubbish
collection by haulers shall be made available twice yearly. Cost of
pickup shall be borne by the owner of the rubbish. This is not to
exclude bulky rubbish pickup at any time of the year when arranged
between hauler and customer.
G. Unserved Residents.
1. In the
event that there is an unserved resident in the County, it shall be
the responsibility of the solid waste collector who is performing
collection service in that area to make available to that resident
trash collection, transportation and disposal of the resident's solid
waste.
2. In the
event that there is more than one (1) solid waste collector in the
area where an unserved resident lives and neither or none of said
collectors voluntarily offers to serve said resident, the Director
shall determine which collector shall make service available to said
resident based on economic feasibility. A commercial trash container
provided by the designated collector in a spot agreeable to the customer,
collector and owner of the property wherein the container is located
shall be acceptable in cases where it is impractical, impossible or
economically unfeasible to provide door-to-door collection.
H. Collector Responsibility For Litter. Solid waste collectors operating with a valid hauling permit from the Director shall be responsible for the collection of solid waste from the point of collection to the transportation vehicle; provided the solid waste was stored in compliance with Section
250.020 or, in case of bulky rubbish. Any spillage or blowing litter caused as a result of the duties of the solid waste collector shall be collected and placed in the transportation vehicle by the solid waste collector.

A. Vehicles Required To Be Permitted. All solid waste shall
be transported in vehicles which meet current local, State and Federal
regulations and hold valid County hauling permits where required.
B. Vehicle Requirements. All transportation vehicles shall
be maintained in a safe, clean and sanitary condition and shall be
so constructed, maintained and operated as to prevent spillage of
solid waste therefrom. All vehicles to be used for transportation
of solid waste shall be constructed with water-tight bodies or containers
and with covers of suitable materials with fasteners designed to secure
all sides of the covers to the vehicles or containers and shall be
secured whenever the vehicle is transporting solid waste or, as an
alternate, the entire bodies thereof shall be enclosed with only loading
hoppers exposed.
C. Permits Not Required For Excavated Material Handling. Permits
shall not be required for the removal, hauling or disposal of earth
and rock material from grading or excavation activities, however,
all such material shall be conveyed in tight vehicles, trucks or receptacles
so constructed and maintained that none of the material being transported
shall spill upon the public rights-of-way.
D. Demolition And Construction Wastes. Transportation and disposal of demolition and construction wastes shall be in accordance with Section
250.060, the permit regulations of this Chapter and in compliance with all requirements of local, State and Federal agencies.
E. Hazardous Wastes. Transportation and disposal of hazardous wastes shall be in accordance with Section
250.060, the permit regulations of this Section and in compliance with all requirements of local, State and Federal agencies.

A. State And Federal Permits. All solid waste disposal sites,
solid waste processing sites and solid waste storage sites located
and operating in the County and all solid waste collection and transportation
vehicles operating in the County shall have applicable, valid State
and Federal permits where required before annual County permits shall
be issued, shall be in compliance with all responsible regulatory
agencies and shall be located, designed, operated and permitted in
conformity with the rules and regulations of Jefferson County Solid
Waste Division.
B. Jefferson County Permits Required. No person shall engage
in the business of storing, collecting, transporting, processing or
disposing of solid waste within the County without first obtaining
an annual permit therefor from the Director, provided however, that
this provision shall not be deemed to apply to employees of the holder
of any such permit nor to the storage of residential solid waste on
the owner and/or occupant's premises before collection and disposal
of such waste.
C. Application For County Permit And Permit Issuance. The operator
of a solid waste disposal site in the County, a solid waste processing
site in the County, a salvage storage and processing yard in the County,
or a solid waste collection and transportation business operating
in the County shall make application to the Director for a County
permit to operate. The application shall be made on forms provided
by the Director. (When plans are required by the Solid Waste Management
Ordinance of Jefferson County, they shall be submitted to the Director
with the application for permit.) Upon receipt of an application for
permit to operate, the Director shall conduct an investigation and
inspection of the described facility or vehicle. When the investigation
reveals that the facility or vehicle does conform with the laws of
the State of Missouri, the regulations set forth in this Section and
that the applicant will store, process, collect, transport or dispose
of solid waste without hazard to public health or damage to the environment,
the Director shall issue a County permit for the operation of the
facility or vehicle as set forth in the application. The permit shall
be issued for the period of one (1) year.
D. Application Denial. In the event that the facility or vehicle
fails to comply with the requirements, the Director shall issue a
report to the applicant stating the reason for the denial of a County
permit or request that additional information, plans or alternation(s)
of plans be accomplished and proof submitted in accordance with these
rules and regulations and specify the time in which it shall be done.
If the applicant does not make the modifications pursuant to the Director's
notice within the time limit specified therein, or if the application
does not clearly show that the collection, transportation, processing
or disposal of solid waste will create no potential public health
hazard or be without harmful effects on the environment, the application
shall be denied and the applicant notified by the Director, in writing,
stating the reason for such denial. Nothing in this Section shall
prejudice the right of the applicant to reapply after the rejection
of his/her application, provided that all aspects of the re-application
comply with the provisions of this Chapter.
E. Insurance Required. No such permit shall be issued, unless
the applicant therefor, in addition to all other requirements set
forth, shall file and maintain with the Director evidence of a satisfactory
public liability insurance policy covering all operations of such
applicant pertaining to such business and all vehicles to be operated
in the conduct thereof. All applicants, their subcontractors shall
be required to furnish to the Director certification of insurance
covering public liability, auto liability and Workers' Compensation.
The minimum limit of insurance for public liability and auto liability
shall be one million dollars ($1,000,000.00) combined single limit.
The minimum limits for Workers' Compensation shall be statutory, as
required by law. Should any policy be canceled, the Director shall
be notified of such cancellation by the insurance carrier in writing
no less than ten (10) days prior to the effective date of such cancellation,
and provisions to that effect shall be incorporated in such policy
which shall also place upon the company writing the policy the duty
to give such notice.
F. Application Requirements. Each applicant for any such permit
shall state in his/her application:
1. The
nature of the permit desired as to collect, transport, store, process
or dispose of solid waste or any combination thereof;
2. The
characteristics of solid waste to be collected, transported, stored,
processed or disposed of;
3. The
number of solid waste transportation vehicles to be operated thereunder;
4. The
precise location(s) of solid waste storage, processing or disposal
facilities to be used;
5. The
boundaries or locations of the collection area, if applicable;
6. Such
other information as required by the Director.
G. Permit Fees. Each applicant shall pay an annual fee of one
hundred dollars ($100.00) for each solid waste storage, processing
or disposal facility, transfer station or recycling site to be operated
and/or an annual fee of ten dollars ($10.00) for each vehicle used
in transporting and/or collecting solid waste.
H. Permit Renewals. The annual permit may be renewed upon annual inspection and payment of the fees(s) as designated herein if facility or business has not been modified. If modifications have been made, the applicant shall re-apply for a permit as set forth in Subsections
(A) through
(G). No permits authorized by this Section shall be transferable from person to person.
I. Revocation Or Suspension Of County Permit. If the holder
of a permit fails to store, process, collect, transport or dispose
of solid wastes in a manner which protects the public health and prevents
damage to the environment and conforms to the laws of the State of
Missouri and this Section, the Director may revoke or suspend such
permit.
J. Penalties For Violation Of Permit Conditions. Any solid waste facility or business found to be in violation of the conditions of any requirements agreed to under the permit shall be in violation of this Section and subject to the penalties as defined in Section
250.130.
K. Opportunity To Correct Violations. In all cases, when the
corrective measures have not been taken within the time specified,
the Director shall suspend or revoke the permit or permits involved
in the violations, however, in those cases where an extension of time
will permit correction and there is no public health hazard created
by the delay, one (1) extension of time, not to exceed the original
time period, may be given.
L. Stickers Required. All motor vehicles operating under any
permit required by this Section shall display on the windshield or
rear window of such vehicle a sticker bearing the permit number(s).
Such stickers shall be furnished by the Director to the applicant
upon issuance of permit. Each permit for storage, processing or disposal
facilities shall be prominently displayed at such facility.
M. Special Operating Permit. In the event a person desires
to operate a solid waste disposal or solid waste processing of only
special wastes, that person may submit a written request to the Solid
Waste Division requesting that such area or facility be allowed to
apply for a "special operating permit". Such request shall explain
in detail the characteristics of the special wastes and the justification
for proposing design and operating procedures. If the Director finds
the request justified, the Director shall advise the person to submit
for approval an application for a "special operating permit" and detailed
plans and data for the design and operating of such disposal area
or processing facility. The Director reserves the right to specify
the time limit and any restrictions on the permit and at any time
to require alteration in design and operation as it deems necessary
to protect the public health, to minimize environmental damage and
to prevent nuisances.

A. Establishing Rules And Regulations. Within the framework
of this Chapter, the Director, with the approval of the County Executive,
shall make, amend, revoke and enforce reasonable and necessary rules
and regulations governing, but not limited to:
1. Preparation,
drainage and wrapping of garbage in solid waste containers. Specifications
for solid waste containers including the type, composition, equipment,
size and shape thereof. Identification of solid waste containers and
of the covers thereof and of equipment thereto pertaining, if any.
Weight limitations on the combined weight of solid waste containers
and the contents thereof and weight and size limitations of bundles
of solid waste too large for solid waste containers.
3. Sanitation,
maintenance and replacement of solid waste containers.
4. Collection,
transportation, processing and disposal of solid waste.
7. Records
of quantity and type of wastes received at processing and/or disposal
facilities.
8. Handling
of toxic and hazardous waste according to Missouri Department of Natural
Resources and the U.S. Environmental Protection Agency guidelines.
9. Handling
of special waste and sludge, ashes, construction, bulky items, white
goods, tires, automobiles, oils, greases, dead animals, etc.
10. Licensing
and inspection of all refuse collection vehicles handling waste according
to State/County regulations.
B. Director's Rights Of Inspection And Notice Of Violation. In order to ensure compliance with the laws of this State, this
Section and the rule and regulations authorized herein, the Director
is authorized to inspect all phases of solid waste management within
the County. No inspection shall be made in any dwelling unit unless
authorized by the owner and/or occupant or by due process of law.
In all instances where such inspections reveal violation of this Chapter,
the rules and regulations authorized herein for the storage, collection,
transportation, processing or disposal of solid waste or the laws
of the State of Missouri, the Director shall issue notice for each
such violation stating therein the violation or violations found,
the time and date of the corrective measures to be taken together
with a reasonable time in which such corrections shall be made.

A. Solid
waste transportation businesses shall comply with all Sections of
the Jefferson County Solid Waste Management Ordinance. Such businesses
shall conform with the zoning requirements of the County. Such businesses
shall also be inspected at least annually and are subject to inspection
at any time to assure compliance with this Section.
B. Design
plans for the design, operation, construction or alteration of the
facility shall be prepared and submitted to the Director. The facility
shall not be constructed or placed in operation until approved by
the Director.
C. Water Quality. All waters discharged from the facility shall
be sufficiently treated to meet applicable water quality standards,
including those established under the authority of the Federal Water
Pollution Control Act, as amended, the Missouri Clean Water Commission
and under municipal or regional sewer discharge regulations.
D. Insects And Rodents.
1. Conditions
shall be maintained that are unfavorable for harboring, feeding and
breeding of insects and rodents.
2. Insect
and rodent control contingency programs shall be implemented when
necessary to prevent or rectify such problems.
E. Esthetics.
1. The
entire business area shall maintain a neat, clean appearance.
2. Immediate
action shall be taken to eliminate odors, dust or other nuisance conditions.
3. If bulky
rubbish is stored at the business, that storage area shall comply
with the requirements set forth for salvage storage and processing
yard.
F. Records.
1. The
operator of a solid waste business shall maintain records and monitoring
data as specified by the Director. The records and data shall be provided
to the Director upon request.
2. Records
shall be maintained covering at least the following:
a. The
actual or estimated quantity of solid waste received on each day.
b. Major
operational problems, complaints or difficulties.
c. Insect,
rodent, odor, dust and litter control efforts.
d. Maps
showing the roads on which collection service is provided by the company.

A. Section
250.060(L) requires that all motor vehicles engaged in the business of hauling solid waste in the County display a current Jefferson County Solid Waste Program sticker. Such vehicles shall be inspected at least annually and are subject to inspection at any time to assure compliance with this Section. Compliance with this Section for vehicles shall mean adherence to Section
250.040(A) and
(B) and Section
250.060(E) and
(G):
1. Vehicles
proposed to be used by the applicant to haul solid waste bear a current
State of Missouri safety check certificate if required by law.
2. Such
vehicles shall bear the name of the owner in easily readable lettering.
3. Such
vehicles are otherwise in good repair and when operated under normal
conditions do not emit unreasonably loud or disturbing noises.
4. Such
vehicles are clean and sanitary and so constructed as to reasonably
prevent spillage of load therefrom.
5. Such
vehicles are constructed with water-tight bodies and with covers which
are an integral part of the vehicle or, in the alternative, with a
separate cover of suitable material with fasteners designed to secure
all sides of the cover of the vehicle or, in the alternative, that
the entire body of the vehicle is enclosed with only loading hoppers
exposed.
6. The
portion of the vehicle in which the solid waste will be contained
is constructed of metal or other non-porous material capable of being
readily cleaned and kept sanitary.
7. There
will be no storage of bulky rubbish that has been collected in the
business at the hauler's residence unless that resident meets the
requirements for a salvage storage and processing yard.
8. Vehicles
shall be so maintained that they do not create an odor nuisance or
other nuisance condition where they are parked when not in use.
9. Waste
shall not be stored more than forty-eight (48) hours in any waste
transportation vehicle without the express permission of the Director.
10. The
hauler shall be responsible for securing bulky rubbish, yard waste
and salvage material to the vehicle in such a manner that will prevent
spillage.

Any person who violates this Chapter or fails to comply with
any of its requirements shall, upon conviction thereof, be fined not
more than one thousand dollars ($1,000.00) or imprisonment for not
more than one (1) year, or both, and in addition, shall pay all costs
and expenses involved in the case. Each day such violation continues
shall be considered a separate offense. Violations shall be prosecuted
in the Jefferson County Municipal Court by the Jefferson County Municipal
Prosecutor. Nothing herein contained shall prevent the County from
taking such other lawful action as is necessary to prevent or remedy
any violation.
