That pursuant to the authority of Section 77.042 et seq., RSMo.,
the position of City Administrator is hereby established. The City
Administrator shall be employed by the Board of Aldermen with the
approval of the Mayor.

The City Administrator shall be the Chief Administrative Assistant
to the Mayor, and shall have general superintending control of the
administration and management of the government business, officers
and employees of the City, subject to the direction and supervision
of the Mayor.

The qualifications for City Administrator are that he/she be
at least twenty-one (21) years of age, a college graduate with degree
in Public Administration, and that he/she reside in the City while
serving in such capacity. A newly appointed City Administrator shall
have three (3) months in which to locate residence within the City,
unless modified by the Board of Aldermen. The City Administrator shall
be a full time employee and not engage in any other employment.

The City Administrator shall receive such compensation as may
be determined from time to time by the Board of Aldermen, and such
compensation shall be payable monthly.

The City Administrator shall serve at the pleasure of the appointing
authority. The Mayor, with the consent of a majority of the entire
Board of Aldermen, may remove the City Administrator from office at
will, and such City Administrator may also be removed by a majority
vote of the entire Board independently of the Mayor's approval or
disapproval.

A. The
duties of the City Administrator shall include, but not be limited
to the following:
1. Prepare and represent an annual report of the City's affairs, including
in the report a summary of reports of department heads and such other
reports as the Mayor and Board of Aldermen may require.
2. Act as the personnel officer and recommend an appropriate position
classification system and pay plan to the Mayor and Board of Aldermen.
3. After consultation with department heads, shall approve advancements
and appropriate pay increases within the approved pay plans and position
classification system.
4. Shall appoint department heads and other City personnel (except those
enumerated in the Missouri Revised Statutes or specifically authorized
by ordinance of the City of Troy, Missouri, as appointments of the
Mayor and Board of Aldermen). Shall make recommendations of removal
of department heads and other City personnel. During any time period
which the City of Troy does not have an acting City Administrator,
the authority to hire employees shall be vested in the Board of Aldermen
of the City of Troy.
5. Recommend to the Mayor and Board of Aldermen adoption of such measures
as necessary or expedient for the health, safety or welfare of the
City or for the improvement of administrative services for the City.
6. Attend all meetings of the Board of Aldermen.
7. Keep the public informed of the purposes and methods of City government
through available news media.
8. Have responsibility for all inventories of City property.
9. Prescribe such rules and regulations as instructed by the Mayor and
Board of Aldermen.
10. Supervise and coordinate work of all the department boards and committees
of the City.
11. Investigate and examine or inquire into the affairs or operation
of any department of the City if so instructed by the Mayor and Board
of Aldermen.
12. Coordinate Federal and State programs which may have application
to the City.
13. Supervise the activities of all employees of the City of Troy. Subject
to said supervision by the City Administrator, the Police Officers
shall be under the direct day-to-day supervision of the Chief of Police,
the members of the street crew shall be under the direct day-to-day
supervision of the foreman of the street crew and all clerical and
bookkeeping employees of the City shall be under the direct day-to-day
supervision of the City Clerk. The City Administrator shall convey
his/her recommendations or directives to the Chief of Police, the
foreman of the street crew, or the City Clerk who shall then act upon
said recommendations or directives. Should said department heads fail
to act upon said recommendations or directives or should there be
a disagreement concerning said recommendations or directives, then
the City Administrator shall report that matter to the Board of Aldermen,
who shall have authority to resolve said dispute. The City Administrator
and the department heads shall work together and cooperate to insure
the efficient operation of all of the activities of the City of Troy
and the Board of Aldermen shall consult with both the City Administrator
and the department heads involved in any questions or problems involving
a particular department of the City.

A. The
City Administrator shall have the following powers and limitations.
1. City property. The City Administrator shall have
responsibility for all real and personal property of the City of Troy.
He/she have responsibility for all inventories of such property and
for the upkeep of all such property. Personal property may be sold
by the City Administrator only with approval of the Board of Aldermen.
Real property may be sold only with the approval of the Board of Aldermen
by resolution or ordinance.
2. Set administrative policies. The City Administrator,
with the concurrence of the Board, shall have the power to prescribe
such rules and regulations as he/she shall deem necessary or expedient
for the conduct of administrative agencies subject to his/her authority.
3. Coordinate departments. Except as otherwise provided
by City ordinance or State law, the City Administrator shall have
the power to coordinate the work of all the departments of the City,
and when deemed necessary, shall have authority to assign the employees
of the City to any department where they are needed for the most effective
discharge of the functions of City Government.
4. Investigate and report. The City Administrator shall
have the power to investigate and to examine or inquire into the affairs
or operation of any department of the City under his/her jurisdiction,
and shall report on any condition or fact concerning the City Government
requested by the Mayor or Board of Aldermen.
5. At no time shall the duties or powers of the City Administrator supersede
the action by the Mayor and Board of Aldermen.

The City Administrator, before entering upon the duties of his/her
office, shall file with the City a bond in the amount of fifty thousand
dollars ($50,000.00); such bond shall be approved by the Board of
Aldermen and such bond shall insure the City of Troy for the faithful
and honest performance of his/her duties for the City of Troy and
for rendering a full and proper account to the City of Troy for funds
and property which come into the possession or control of the City
Administrator. The cost of such bond shall be paid by the City of
Troy; however, should the City Administrator be covered by a blanket
bond to the same extent, such individual bond shall not be required.
