A. No
person or business shall make application or be considered to have
an "off-site tent sales" permit without first having a current business
license from the City of Florissant.
B. No
person or business shall be granted a permit that currently has an
outstanding building or zoning code violation.
C. Permits
are non-transferable.

A. It
shall be unlawful for any person or business to conduct an off-site
tent sale or any kind of sale on any other property other than their
own property within the City of Florissant without first making application
and securing a permit from the City.
B. Applications
shall be made to the Building Commissioner, Public Works Department,
along with the following information:
1. Name and address of person or business requesting the "off-site tent
sale" permit;
2. Location where the sale will be held;
3. Name, address, phone number(s) and approval of the property owner
where the sale will be held;
4. A plot plan or site plan of the property, drawn to scale, showing
all property lines, roads, ingress and egress, buildings, parking,
sale/tent location and any other structures;
5. Size (length, width, height), type and location of the tent, all
temporary structures, signs, banners, balloons, blow-up structures,
advertisements, decorative lights, searchlights and location of sale
items/goods/merchandise;
6. Describe any noise and entertainment that will be used and hours
of operation including, but not limited to, loud speakers, PA systems,
bands, music, horns, sirens, carnival rides, etc.;
7. Note: fireworks of any kind are expressly prohibited.
8. Describe any cooking and/or food preparations that will be performed;
9. Provide location and number of all trash and recycling containers;
10. List days and hours of sale;
11. List number of sales personnel and person in charge of sale event
with phone numbers accessible through the entire sales event;
12. Describe any security measures and/or personnel to be used including
any overnight security personnel;
13. Provide the number of parking spaces eliminated by the tent structure
and the estimated number of parking spaces to be used by staff and
by customers during the sale event.

As used in this Article, the following terms shall have these
prescribed meanings:
BUSINESS
A person (as described herein) or person(s) who are required by Chapter
605: BUSINESS REGULATIONS, Section
605.033: Duty To Obtain License is required to have, hold and maintain in good standing a business license with the City of Florissant.
CITY
The City of Florissant.
DIRECTOR
The Director of Public Works and/or designee for the City
of Florissant, Missouri.
PERSON
An individual, association, firm, company, corporation, partnership,
joint stock company, syndicate, receiver, trustee, conservator and/or
any other officer appointed by any State or Federal court.
SALE EVENT
Any sales event, whether a tent is used or not, which occurs
off-site on another property other than the person or business requesting
the permit and is either a one (1) day, a two (2) consecutive day
or maximum three (3) consecutive day event.
TEMPORARY STRUCTURE
Any air-supported, air-inflated, membrane-covered cable,
and/or membrane-covered frame structure, to and including any structure
referenced as a "tent".

The fee for issuance of an "off-site tent sale" permit shall
be one hundred dollars ($100.00) for a "for profit" business and forty
dollars ($40.00) for a Federally designated not-for-profit organization
per sale event regardless if it is a one (1) day or three (3) day
event. (Fee covers processing the application, review of applications,
pre-sale site inspection, issuance of a permit and site inspection
during sale event.)

A. A permit
may be issued to a person or business once within a calendar year;
said permit shall only be for each sale event; a single sale event
may be a single day long or up to a maximum of three (3) consecutive
days long.
B. The
person or business that obtains a permit and the owner of the property
upon which the sale event occurs is limited to two (2) sale events
within a twelve (12) month period.
C. Hours
of sale shall be limited to the hours of 8:00 A.M. and 10:00 P.M.
D. Sale
events may only be held on commercial property zoned "B-1" through
"B-5", "HB", "M-1" and "M-2".
E. All
temporary electric service shall be GFIC protected. All generators
and GFIC junction boxes shall be fenced and/or guarded to protect
the safety of the staff and general public. A separate electrical
permit is required.
F. Fire
extinguishers shall be provided and placed as directed by the City
as well as directed by the Fire District.
G. The
off-site tent sales permit must be conspicuously and clearly displayed
at the site of the sales event.
H. Unless specifically addressed under this Article
XX, all other business regulations per Chapter
605 shall apply as well as all other City codes and ordinances.
I. Permits shall not be issued for the sale of alcoholic beverages (included, but not limited to, beer, wine, liquors, hard liquor, any intoxicating beverages as more clearly defined in Chapter
600: Alcoholic Beverages), guns, knives and/or weapons of any kind, pornography of any kind, drugs/ medicines of any kind, fireworks of any kind, farm animals of any kind, products/merchandise/ materials giving off noxious and offensive odors of any kind, pawnshop/pawnbroker pledged goods and securities and/or anything that might endanger the health/safety/welfare of the general public.

A. Any permit granted pursuant to the provisions of this Article
XX. "Off-Site Tent Sales" shall be subject to revocation for cause by the Director of Public Works (or his/her designee) including, but not limited to, the following:
1. Falsification of any information on the application submitted;
2. Failure to comply with any of the restrictions/requirements/limitations
of this Article;
3. Threatens the health, safety and welfare of the general public;
4. Creates a hardship, burden and/or disturbs the peace of any adjacent
residential or commercial property owner or business.

If the permit is denied, the applicant may appeal in written
form to the Director of Public Works. A hearing may be requested where
the details of the denial will be reviewed and where alternate remedies
and hardships will also be reviewed.

Any person or business found to be in violation of any of the provisions contained within this Article
XX. "Off-Site Tent Sales" and/or any of the City codes/ordinances shall be subject to the penalties prescribed under Section
100.080 of the Florissant Code of Ordinances.
