A. All
so-called "garage sales", "estate sales", "demolition sales" or other
sales involving the offering for sale items of personal property on
property zoned and occupied as a residence shall be and are henceforth
subject to the following rules and regulations, to wit:
1. No one may employ the services of a professional sales person or
auctioneer in connection with any such sale, except that a professional
sales person (but not an auctioneer) may be employed to conduct estate
sales of household furniture, furnishings, jewelry, and other items
typically sold at these events in the residence of a person who has
recently died or has moved or is in the process of moving his/her
place of residence.
2. No personal property of any type belonging to anyone not living in
the residence or which the person living in such residence has not
owned for at least six (6) months shall be brought upon the premises
for the purpose of being sold in such sale.
3. There shall be no display or sale of any property in the front yard
of the premises.
4. No signs shall be posted anywhere in the City of Frontenac advertising such sales, except that the property owner may install signs on the residential lot on which such sale is to be held as provided in Chapter
525 of the Code of Ordinances of the City of Frontenac.
5. Not more than one (1) such sale per annum (lasting not more than
two (2) consecutive days) shall be held at the same premises if occupied
by the same family or any member of such family.
6. The owner of the property where such sale is to take place shall
be responsible for assisting in ensuring free movement of traffic
on the street abutting the place of sale by erecting temporary "No
Parking" signs along the same side of the street as fire hydrants.
"No Parking" signs must be posted for a minimum distance of three
hundred (300) feet in each direction from the property lines at such
place of sale. "No Parking" signs shall be made available on a loan
basis from the City Police Department.
B. In addition to compliance with the provisions of Subsection
(A) of this Section
220.700, the property owner where an estate sale is to take place shall be responsible for obtaining a permit from the City Police Department at least five (5) business days prior to the date of the sale, which permit may be conditioned on approval of a plan assuring safe and efficient management of parking and traffic flow. For purposes of this Subsection
(B), an
"estate sale" shall be
defined as a sale involving items of personal property which are stored
or displayed within or vended from any part of the interior of the
residence (other than the garage), and/or whenever a professional
sales person is engaged to conduct the sale.
C. Anyone violating the provisions of this Section
220.700 shall be guilty of a misdemeanor and subject to a fine of not less than fifty dollars ($50.00) nor more than three hundred dollars ($300.00).
