In Central Business CB Districts, only the following structures
and uses shall be permitted:
A. Single-family dwellings and their accessory uses and structures.

B. Subject to site plan review and approval as provided in Article
XIV:

(1) Schools having an academic curriculum for primary, secondary or college
students. Schools meeting the requirements and standards of Article
9 of the Education Law for selection and development of school sites
shall be permitted without further building or land use control under
this chapter upon submission to the Building Inspector of plans and
specifications, together with evidence showing that they comply with
such requirements and standards.
(2) Churches and their related uses.
(3) Libraries, fire stations, municipal office buildings and public parks
and playgrounds.
(7) Retail stores, banks, business offices, personal service establishments,
mortuaries and undertaking establishments.
(8) Restaurants including carry-out and delivery, hotels, motels, indoor
theaters and recreation establishments.

(9) Gasoline service stations and commercial garages.
(10)
Public utility and municipal storage yards and repair shops.
(11)
Kennels, pet shops and veterinary establishments.
C. The special permit uses specified in Article
XV, upon approval of the Board of Appeals as therein provided.

In Central Business CB Districts, all structures and uses shall
be subject to the following regulations:
A. Required lot area. Lot area and minimum lot width for buildings used
wholly or partially for dwelling purposes other than by one person
acting as a caretaker shall be as follows. There shall be no limitation
on lot area or width for all other structures.
(1) Minimum lot area and width for single- and two-family dwellings.
(a)
Lots shall be not less than 9,600 square feet, and the minimum
lot width at the front building line shall be 75 feet.
(b)
The required lot area for two-family dwellings shall be not
less than 18,000 square feet, and the minimum lot width shall be 100
feet.
(2) The minimum lot area for multiple-family dwellings shall be 20,000
square feet, plus 3,000 square feet for each dwelling unit in excess
of two, and the minimum lot width for such dwellings shall be 150
feet.
(3) The required lot area for townhouses shall be not less than 2,000
square feet for each dwelling unit. There shall be a minimum of one
acre for each townhouse group. Townhouses shall not exceed eight units
per acre.
B. Percentage of lot coverage. All residential buildings, including
accessory buildings and all others permitted in Residential RM Districts,
shall cover not more than 25% of the area of the lot. All commercial
buildings permitted shall cover not more than 90% of the area of the
lot.
C. Front yards. Each lot shall have a front yard with a minimum setback
of zero feet from the right-of-way, except that, where a principal
structure is located within 100 feet in a different zoning district,
then the minimum setback shall be the average of the zero setback
and the setback of the adjacent structure in the adjacent zoning district.

D. Rear yards. Where a Central Business CB District adjoins a residential
district at the rear, rear yard requirements shall be as follows:
There shall be a rear yard not less than 40 feet deep. Otherwise,
the rear yard requirements shall be as follows: There shall be a rear
yard of at least 20 feet in depth, except that if the building is
used for dwelling purposes other than by one person acting as a janitor
or caretaker, the rear yard shall be 30 feet deep. For a building
that extends through from street to street, front yard requirements
shall apply on each frontage.
E. Side yards.
(1) For structures to be used wholly or partially for dwelling purposes
other than by one person acting as a janitor or caretaker, side yards
shall be as follows:
(a)
Each lot shall have two side yards with a total width of not
less than 16 feet, neither one of which may be less than six feet
in width at the front and rear building lines. When a lot less than
60 feet in width exists in separate ownership on the effective date
of this chapter, the total width of the two side yards may be reduced
by six inches for each foot of lot width less than 60 feet, but not
to a total width of less than 10 feet. When the total side yard width
becomes less than 12 feet, the two side yards shall be of equal width.
(b)
For two-family dwellings, when permitted under Article
XIV as a controlled site use, the total width of the two side yards shall be increased by 10 feet, neither one of which may be less than 10 feet in width at the front and rear building lines.
(c)
For townhouses, when permitted under Article
XIV as controlled site use, each side yard shall be a minimum of 40 feet. The minimum distance between separate buildings which make up townhouse groupings shall be 20 feet or equal to the height of the highest adjacent building, whichever is greater.
(2) For structures designed wholly for nonresidential use, no side yards
shall be required except:
(a)
When a lot in a Central Business CB District adjoins a lot in
a residential district at the side, a side yard shall be provided
on the residential side of the business lot, with a width not less
than that of the narrowest yard required in the adjoining residential
district.
F. Height. There shall be no limit on building height, except that for
each foot that the height of a building or structure exceeds 55 feet,
the total width of the two side yards shall be increased by two feet.
