The purpose of this article is to provide for the Town Board of the Town of Southport to appoint alternate members for both the Town of Southport Planning Board and Town of Southport Zoning Board of Appeals. Also, pursuant to the Municipal Home Rule Law, an additional purpose of this article is to amend or supercede both Subdivision 15 of Town Law § 271 and Subdivision 11 of the Town Law § 267 to expand the condition under which said alternate members of the Town Planning Board or Town Zoning Board of Appeals to serve, to include both a conflict of interest by a regular member of said boards or the inability of a member of said boards to attend a meeting of the board on which they serve.
The Town Board of the Town of Southport shall appoint one alternate member of the Town Planning Board, who shall have a term of three years from the date of appointment. In the event that a regular member of the Town Planning Board is unable to participate in an action before the Town Planning Board as the regular member shall find that he or she has a conflict of interest or is unable to attend a Town Planning Board meeting for any reason, then the alternate member shall serve in the place of said regular member of the Town Planning Board. The alternate member of the Town Planning Board shall be subject to the same training and continuing education, attendance, conflict of interest, compensation, eligibility, vacancy in office, removal and service on other boards requirements as a regular member of the Town Planning Board.
The Town Board of the Town of Southport shall appoint one alternate member of the Town Zoning Board of Appeals, who shall have a term of three years from the date of appointment. In the event that a regular member of the Town Zoning Board of Appeals is unable to participate in an action before the Town Zoning Board of Appeals as the regular member shall find that he or she has a conflict of interest or is unable to attend a Town Zoning Board of Appeals meeting for any reason, then the alternate member shall serve in the place of said regular member of the Town Zoning Board of Appeals. The alternate member of the Town Zoning Board of Appeals shall be subject to the same training and continuing education, attendance, conflict of interest, compensation, eligibility, vacancy in office, removal and service on other boards requirements as a regular member of the Town Zoning Board of Appeals.
