The purpose of this chapter is to authorize public servants of the Town
of Southport to issue and serve appearance tickets in connection with violations
of state statutes, local laws, ordinances, or rules and regulations of the
Town which the public servants are authorized or required to enforce.
The following public servants of the Town of Southport are hereby authorized
to issue and serve an appearance ticket with respect to violation of a state
statute, a local law, ordinance, rule or regulation of the Town of Southport
that such public servants are, respectively, required or authorized to enforce
the following provisions of the Code of the Town of Southport:
A. The Code Enforcement Officer shall enforce:
(1) Chapter
185, Air Pollution.
(2) Chapter
234, Buildings, Unsafe.
(3) Part 1, Administration and Enforcement, of Chapter
245, Construction Codes, Uniform.
(4) Chapter
352, Mobile Homes and Mobile Home Parks.
(5) Chapter
402, Property Maintenance.
(6) Chapter
413, Refrigerators, Abandoned.
(7) Chapter
468, Swimming Pools.
B. The Highway Superintendent shall enforce:
(1) Article
I, Sidewalk Construction and Maintenance, of Chapter
459, Streets and Sidewalks.
C. The Dog Warden shall enforce:
(1) Chapter
192, Animals (dog control ordinances).
D. The Fire Prevention Officer shall enforce:
(1) Part 2, Fire Prevention, of Chapter
245, Construction Codes, Uniform.
E. The special Town policeman shall enforce:
(1) Chapter
200, Assemblies, Mass.
(4) Chapter
380, Parks and Recreation Areas.
(5) Chapter
396, Peddling and Soliciting.
(6) Chapter
497, Vehicles and Traffic.
F. Together with all other public servants who are named
in the Code of the Town of Southport for the enforcement of all code provisions
therein not hereinbefore set forth.
An appearance ticket other than for a parking violation shall be served personally, except that an appearance ticket issued for the violation of Chapter
525, Zoning, or of a local building or sanitation code, may be served in any manner authorized for service under § 308 of the Civil Practice Law and Rules.
