A.
Law enforcement
mutual aid is added and shall authorize mutual aid between political
subdivisions in emergency situations and shall read as follows:
1.
Any
Police Officer of the City of Strafford shall have the authority to
respond to an emergency situation outside the City boundaries when
the emergency situation arises within any political subdivision that
also has authorized its Police Officers to respond to emergency situations
within the City of Strafford, Missouri.
2.
Any
Police Officer from any political subdivision that has a law enforcement
mutual aid agreement with the City of Strafford shall have the authority
to respond to emergency situations in the City of Strafford.
3.
As used
in this Section, "Police Officer" means an officer
who has completed the basic Police training program promulgated by
the City of Strafford, Missouri, after receiving a request for assistance
from the Strafford Police Department or one (1) of its Law Enforcement
Officers.
4.
Police Officers of any political subdivision that has authorized its Police Officers to respond to the City of Springfield, as listed in Section 200.050, are also hereby authorized to respond to any emergency situation arising in the City of Strafford, Missouri, after receiving a request for assistance from the Strafford Police Department or one (1) of its Law Enforcement Officers.

As used
in this Section, "Police Officer" means an officer
who has completed the basic Police training program promulgated by
Chapter 590, RSMo. As used in this Section, "respond" shall mean to take any and all action which the Police Officer may
lawfully take as if exercising his/her powers within the jurisdiction
of his/her employing City. As used in this Section, "emergency
situation" means any situation in which the officer has a
reasonable belief that a crime is about to be committed, is being
committed or has been committed involving injury or threat of injury
to any person, property or governmental interest and that his/her
response is reasonable necessary to prevent or end such emergency
situation.

Section 70.820, RSMo., along with this Article of the City of
Strafford, Missouri, has authorized Strafford Police Officers, under
limited conditions, to respond to emergency situations outside the
City of Strafford. This enables our officers to respond to calls for
assistance from other law enforcement agencies when they have an emergency
situation.

It shall be the policy of the Strafford Police Department to
respond to a request for assistance from another Law Enforcement Agency
when an emergency exist, provided the political subdivision governing
that agency has authorized Strafford Police Officers to respond to
emergency situations arising therein.

A.
EMERGENCY SITUATION
LONG-TERM OR MULTIPLE-EVENT RESPONSE
RESPONSE
SHORT-TERM RESPONSE
Definitions. As used in this Article, the following terms
shall have these prescribed meanings:
Any situation in which the officer has reasonable belief
that a crime is about to be committed, is being committed or has been
committed involving injury or threat of injury to any person, property
or government interest and that his/her response is reasonably necessary
to prevent or end such emergency situation or mitigate the likelihood
of injury involved in such emergency situation.
A request for assistance when the task will be of more than
two (2) hours duration or will involve multiple tasks or any request
outside the County.
Any and all action which the Police Officer may lawfully
take as if exercising his/her powers within the City of Strafford.
A request for assistance when the task appears to be of less
than two (2) hours in duration and is within the County.
B.
Authority. In responding to an emergency situation outside
the City limits, Strafford Police Officers are authorized to engage
in only those actions which are reasonably required to deal with the
contingencies of the emergency situation itself. While actively engaged
in the performance of his/her duties in direct response to the contingencies
of an emergency outside the City limits, on-duty Strafford Police
Officers possess the same authority and powers as though operating
within the City limits.
C.
Short-Term Response.
1.
Strafford
Police Officers may respond to an emergency request by another Law
Enforcement Agency for a short term only after authorization by a
Strafford Police supervisor or commanding officer. Supervisors and
commanding officers shall consider the nature of the emergency, current
on-duty strength and workload in the City prior to their decisions.
2.
Example. A robbery occurs outside the City and an armed
suspect is contained in a building. The County does not have sufficient
personnel to handle the incident and request Strafford Police Officers
to assist. This would require prior authorization by a supervisor.
3.
Exception. Where a life threatening emergency is in view
of an on-duty officer and time does not permit prior authorization,
the officer shall immediately notify the dispatcher and seek authorization
at the first (1st) available point.
4.
Example. An officer is near the City limits and observes
a Law Enforcement Officer in an altercation with a citizen as a result
of a vehicle stop outside the City. The officer may respond and assist,
seeking authorization at the first (1st) available point.
D.
Long-Term And Multiple-Event Response.
1.
Long-term
or multiple-event response authorization of Lieutenant or higher authority
and notification to the Board or Mayor prior to or as soon as practical
after committing officers to the emergency situation.
2.
Example. An officer in another jurisdiction is shot. The
subsequent hunt for the suspect requires a large amount of manpower
and we receive a request for assistance. This would require prior
authorization.
E.
Reporting And Supervision.
1.
Any
time Strafford Police Officers respond to emergency situations outside
the City limits, the primary unit will be designated. The primary
unit officer shall submit an appropriate written report of the incident
and Strafford Police Department Officer(s) involvement in the situation.
2.
When
officers respond outside the City, the Strafford Police Department
chain of command shall remain intact. Officers may comply with all
reasonable requests of the agency with primary jurisdiction but remain
under direct supervision of the Strafford Police Department.

A.
The City
of Strafford hereby adopts and will enforce this policy prohibiting
the use of excessive force by law enforcement agencies within its
jurisdiction against any individual engaged in non-violent civil rights
demonstrations. The City of Strafford also prohibits the physical
barring of any entrance or exit to such a facility and will enforce
all applicable State laws in this regard.
B.
Any person
charged with a violation of any provision of this resolution will
be served by the City of Strafford with written notice stating the
nature of the violation.
C.
Any person
convicted of this violation shall be guilty of a misdemeanor and shall
be fined an amount not to exceed one hundred dollars ($100.00) for
each violation. Each day on which such violation occurs shall be deemed
to be a separate offense.
D.
Any person
violating any of the provisions of this resolution shall become liable
to the City of Strafford for any expense, loss or damage occasioned
the City of Strafford by reason of such violation.
