A. A land
disturbance permit is required for any land disturbance activity including
streets and utilities construction on any site more than one (1) acre.
Application for a City land disturbance permit shall be submitted
on forms issued by the Building Official and shall contain all information
required by the Building Official. Phased development of tracts larger
than one (1) acre does not exempt the developer from the provisions
of this Chapter.
B. Applications
for land disturbance permits (for any area greater than one (1) acre)
shall be accompanied by:
1. A detailed site development plan.
2. A copy of the Department of Natural Resources Missouri State Operating
Permit for land disturbance activities for the property in question.
3. A sedimentation and erosion control plan stamped by a Missouri registered
engineer.
4. Stormwater Pollution Prevention Plan (SWPPP).
5. If the development is to be constructed in phases, the developer
shall specify on the City's land disturbance permit application which
phase the land development/disturbance permit is being requested.
The City will issue a permit only for the specified phase under construction.
C. No
final plat or final plan in a Planned Unit Development (PUD) shall
be approved prior to approval of a site development plan encompassing
the entire area being platted or planned.
D. A land
disturbance permit shall not be required for sites that are less than
one (1) acre or for individual lots in residential zoned development
except that erosion control provisions, grading limits, low floor
elevation and storm drainage work, including piping, swaling and ditching,
shall be shown on the plot plan and approved prior to issuance of
a building permit.
E. Agricultural
activities are exempted from the provisions of this Chapter except
that a land disturbance permit is required for the mechanized clearing
and removal of trees on sites more than one (1) acre.
