The provisions of this Article shall govern the minimum conditions
and the responsibilities of persons for maintenance of dwellings and
dwelling units.

The Building Inspector is hereby authorized and directed to
make inspections to determine the condition of dwellings, dwelling
units, rooming houses, rooming units and premises located within the
City in order that he may perform his duty of safeguarding the health
and safety of the occupants of dwellings and of the general public.
The owner or occupant of every dwelling, dwelling unit, rooming house
or rooming unit or the person in charge thereof shall give the Building
Inspector free access to such dwelling, dwelling unit, rooming house
or rooming unit and its premises at all reasonable times for the purpose
of such inspection, examination and survey. If any owner or occupant
shall refuse such access, the Building Inspector shall report his
preliminary findings to the Chief of Police and may request that the
Chief make application for the issuance of an administrative search
warrant. Every occupant of a dwelling or dwelling unit shall give
the owner thereof or his agent or employee access to any part of such
dwelling or dwelling unit or its premises at all reasonable times
for the purpose of making such repairs or alterations as are necessary
to effect compliance with the provisions of this Chapter or with any
lawful rule or regulation adopted or any lawful order issued pursuant
to the provisions of this Chapter.

All structural members, including stairs, porches and appurtenances,
shall be maintained free from deterioration and shall be capable of
safely supporting the imposed dead and live loads.

Every foundation, floor, wall, ceiling and roof shall be reasonably
weather-tight, water-tight and rodent-proof; shall be free of holes,
wide cracks, breaks, loose, warped or rotting boards; and shall be
kept in good repair.

All overhang extensions, including all canopies, marquees, signs,
metal awnings, stairways, fire escapes, standpipes, exhaust ducts
and similar overhand extensions; all chimneys, cooling towers, smokestacks
and similar appurtenances; and all architectural features, such as
cornices, belt courses, corbels, terra-cotta trim, wall facings and
similar features shall be maintained structurally safe and sound,
in good repair, and properly anchored.

Every handrail and guard shall be firmly fastened and capable
of supporting normally imposed loads and shall be maintained in good
condition.

A. Generally. Every window, door and frame shall be kept in
sound condition, in good repair, and weather-tight.
B. Exits From Sleeping Rooms. At least one (1) openable window
or door leading to the outside or to a protected corridor shall be
provided in each sleeping room for safe and rapid egress.
C. Doors. All exterior doors and hardware shall be maintained
in good condition. Locks at all entrances to dwelling units and rooming
units shall tightly secure the door.

Every basement hatchway and window shall be maintained to prevent
the entrance of rodents, rain and surface drainage.

During the period from April first (1st) to November first (1st)
for protection against mosquitoes, flies and other insects, every
door, window or other device used for ventilation from a dwelling
unit to outdoor space shall have supplied screens.

A. All structures
shall be kept free from insect and rodent infestations. All structures
in which insects or rodents are found shall be promptly exterminated
by approved processes that will not be injurious to human health.
After extermination, proper precautions shall be taken to prevent
reinfestation.
B. Every
occupant of a dwelling containing a single dwelling unit shall be
responsible for the extermination of any insects, rodents or other
pests therein or on the premises; and every occupant of a dwelling
until in a dwelling containing more than one (1) dwelling unit shall
be responsible for such extermination whenever his dwelling unit is
the only one infested. Notwithstanding the provisions of this Subsection,
whenever infestation is caused by failure of the owner to maintain
a dwelling in a rodent-proof or reasonably insect-proof condition,
extermination shall be the responsibility of the owner.
C. Whenever
infestation exists in two (2) or more of the dwelling units in any
dwelling, or in the shared or public parts of any dwelling containing
two (2) or more dwelling units, extermination thereof shall be the
responsibility of the owner.

A. Every
occupant of a structure shall dispose of all rubbish and garbage in
a clean and sanitary manner by placing such rubbish and garbage in
approved residential solid waste containers.
B. Every
occupant of a one- or two-family dwelling shall be primarily responsible
for the removal of rubbish and garbage, and the owner shall be secondarily
responsible for removal of rubbish and garbage.
C. The owner
of every occupied premises containing three (3) or more dwelling units
shall supply approved covered containers for rubbish and garbage,
and the owner of the premises shall be responsible for the removal
of rubbish and garbage.

A. The occupant
shall keep that part of the dwelling and the dwelling unit which such
occupant occupies or controls in a clean and sanitary condition.
B. The owner
of a dwelling containing two (2) or more dwelling units shall be responsible
for maintaining in a clean and sanitary condition the shared or public
areas of the dwelling and premises thereof.

All plumbing fixtures shall be properly connected to either
a public sewer system or to an approved private sewage disposal system.
Every plumbing stack, vent, waste and sewer line shall function properly
and be kept from obstructions, leaks and defects.

Every plumbing fixture and water and waste pipe shall be properly
installed and maintained in good sanitary working condition, free
from defects, leaks and obstructions.

Every water closet compartment floor surface and bathroom floor
surface shall be constructed and maintained so as to be reasonably
impervious to water and so as to permit such floor to be easily kept
in a clean and sanitary condition.
