The provisions of this Title prohibiting the standing or parking
of a vehicle shall apply at all times or at those times herein specified
or as indicated on official signs except when it is necessary to stop
a vehicle to avoid conflict with other traffic or in compliance with
the directions of a Police Officer or official traffic control device.
The provisions of this Title imposing a time limit on parking
shall not relieve any person from the duty to observe other and more
restrictive provisions prohibiting or limiting the stopping, standing
or parking of vehicles in specified places or at specified times.
When signs are erected giving notice thereof, no person shall
park a vehicle at any time upon any of the streets described by ordinance.
When signs are erected in each block giving notice thereof,
no person shall park a vehicle between the hours specified by ordinance
on any day except Sunday and public holidays within the districts
or upon any of the streets described by ordinance.
When signs are erected in each block giving notice thereof,
no person shall stop, stand or park a vehicle between the hours specified
by ordinance on any day except Sundays and public holidays within
the district or upon any of the streets described by ordinance.
Whenever by this Title or any ordinance of the City any parking
time limit is imposed or parking is prohibited on designated streets,
it shall be the duty of the City Traffic Engineer to erect appropriate
signs giving notice thereof and no such regulations shall be effective
unless said signs are erected and in place at the time of any alleged
offense.
In cases where an equally direct and convenient alternate route
is provided, an ordinance may describe and signs may be erected giving
notice thereof that no persons shall operate any commercial vehicle
upon streets or parts of streets so described except those commercial
vehicles making deliveries thereon.

A. For
purposes of this Section, "truck or trucks" shall
be defined as follows: Any vehicle, machine, tractor, trailer or semi-trailer
or any combination thereof propelled or drawn by mechanical power
and designated or used in the transportation of property upon roads,
alleys, streets or highways.
B. No
commercial vehicle or truck having a gross weight in excess of ten
(10) tons shall be driven on those streets, roads, alleys or highways
within the City limits of Willard, Missouri except as otherwise specified
herein.
C. Notwithstanding
any other provision to the contrary, commercial vehicles or trucks
having a gross weight in excess of ten (10) tons shall be permitted
on those streets, roads, highways and alleys under the following circumstances:
1. While making deliveries or picking up specific products or items
at or to a specific location on the street, road, alley or highway
for the time required to make said delivery or pickup of said goods
or products;
2. When engaged in the picking up of trash, rubbish, recyclables or
other products for purposes of disposal;
3. When said vehicle is authorized road equipment utilized for maintenance,
repair, cleaning or plowing said streets and when said vehicle is
an emergency vehicle or a vehicle owned and operated by local, State
or Federal government agency;
4. When said vehicle is utilized in the normal cause of the farming
business and is being used for those purposes to move from one location
to another or to deliver or transport goods produced on the farm.
D. No person shall operate or drive or cause to be operated or driven any truck or commercial vehicle having a gross weight in excess of ten (10) tons on any residential street in the City of Willard, except as otherwise provided herein and as reflected in Subsections
(C) and
(F).
E. If
any truck or commercial vehicle is found on any street, road, alley
or highway in violation of the provisions of this Section, and the
identity of the driver or operator cannot be found or determined,
the owner or person in whose name such vehicle is registered shall
be held prima facie responsible for such violation. However, in the
case of an owner-lessor/lessee motor vehicle, Section 304.120(4),
RSMo., shall dictate the establishment of who shall be held responsible
for any violation of this Section.
F. Trucks
or commercial vehicles as described and unless otherwise specified
herein shall not be operated in any area of Willard which is designated
as a residential zoning district. Except trucks or commercial vehicles
with a gross weight in excess of ten (10) tons shall be permitted
on Farmer Street (also known as AB Highway), Jackson Street and Highway
160 (Olympian Boulevard). Trucks or commercial vehicles with a gross
weight in excess of ten (10) tons may be operated in any area of Willard
which is designated commercial or industrial.
G. Notwithstanding
any other provision to the contrary, the City of Willard may post
signs designating areas where trucks or commercial vehicles are prohibited
or limited in access by the vehicle's gross weight. However, failure
to post said signs shall not be a defense for violation of this Section.
