A. A general
election for the elective officers of the City shall be held on the
first (1st) Tuesday after the first (1st) Monday in April of each
year.
1. On the first (1st) Tuesday after the first (1st) Monday in April
of odd-numbered years, an election shall be held by the qualified
voters of each ward in the City for one (1) Alderman from each ward
who shall hold their respective offices for the term of two (2) years
and until his/her successors shall be elected and qualified.
2. On the first (1st) Tuesday after the first (1st) Monday in April
of the year 2000 and every four (4) years thereafter, an election
shall be held by the qualified voters of each ward in the City for
Mayor who shall hold the office for the term of four (4) years until
his/her successor shall be elected and qualified.
3. On the first (1st) Tuesday after the first (1st) Monday in April
of even-numbered years, an election shall be held by the qualified
voters of each ward of this City for one (1) Alderman for each ward
who shall hold their respective offices for the term of two (2) years
and until their successors shall be elected and qualified.

A. All
qualified persons desiring to run for an elected office of the City
of Lake Saint Louis and desiring to have his/her name placed on the
ballot as a candidate for such office shall file a notice of intention
to run for such office with the City Clerk setting forth the name
of the candidate, address, age, length of residency, and office for
which he/she is running.
B. All notices of intention to run for an elected office shall be filed
with the City Clerk at City Hall, 200 Civic Center Drive between 8:30
A.M. and 5:00 P.M. Monday through Friday, excluding holidays, on the seventeenth
(17th) Tuesday before the election date to the fourteenth (14th) Tuesday
before the election date. On the first day for filing only, the business
hours for filing shall commence at 8:00 A.M. and end at 5:00 P.M.
The Clerk shall keep a permanent record of the names of the candidates,
the offices for which they seek election and the date of their filing,
and their names shall appear on the ballots in that order, except
that in the case of candidates who file a declaration of candidacy
with the Clerk prior to 5:00 P.M. on the first (1st) and last days
for filing, the Clerk shall determine by random drawing the order
in which such candidates' names shall appear on the ballot. The drawing
shall be conducted so that each candidate may draw a number at random
at the time of filing. The Clerk shall record the number drawn with
the candidate's declaration of candidacy. The names of candidates
filing on the first (1st) day for filing shall be listed, from the
first (1st) position on the ballot, in ascending order of the numbers
drawn. The names of candidates filing on the last day for filing shall
be listed, from the last position on the ballot, in ascending order
of the numbers so drawn. Only those names of candidates received by
5:00 P.M. on the fourteenth (14th) Tuesday prior to any election date
shall be placed on the ballot.

C. The
City Clerk shall provide forms, as approved by the Board of Aldermen,
to all eligible candidates for the filing of such notice of intention
to run. Said forms shall include: name of the candidate, address,
age, length of residency, status of City taxes, voting qualification,
resident of the ward from which running, citizen of U.S.

Any person who is not qualified for his/her office as provided
by this Code or other ordinances shall not be entitled to have his/her
name printed on the ballot. The qualifications of a candidate for
office shall be determined by the City Aldermen upon hearing given
and upon its own motion or upon written affidavit by some person that
a named candidate is not qualified as such for the office sought.

A candidate may not withdraw his/her candidacy after the certification of the notice as set out in Section
105.070 by the City Clerk to the election authority. A candidate's name may be removed after that time only upon death or order of court of record.

All City elections shall be conducted and held in conformance
with the provisions of Chapter 115, RSMo. (hereinafter "the Act").

Whenever an overlapping political subdivision conducts an election
on the same day as the City election, the County Clerk, as the designated
election authority, shall conduct the City election.
In City elections, the City Clerk shall notify the County Clerk
prior to 5:00 P.M. on the tenth (10th) Tuesday prior to any City election
except as noted in Section 115.125.1, RSMo. The notice shall be in
writing, shall specify that the Board of Aldermen is calling the election,
the purpose of the election, the date of the election, and shall include
a certified copy of the legal notice to be published including the
sample ballot. The written notice shall be executed on behalf of the
Board of Aldermen by the Mayor of the Board and shall include the
attestation of the City Clerk and shall have affixed thereto the Seal
of the City of Lake Saint Louis. The notice and any other information
required by this Section may, with the prior notification to the election
authority receiving the notice, be accepted by facsimile transmission
prior to 5:00 P.M. on the tenth (10th) Tuesday prior to the election,
provided that the original copy of the notice and a certified copy
of the legal notice to be published shall be received in the office
of the election authority within three (3) business days from the
date of the facsimile transmission.

Prior to each City election the Board of Aldermen shall timely
pass an election ordinance authorizing, establishing and providing
the election procedure to be followed in the conduct of the City election.
