There is hereby established a Fire Department for the City,
which shall consist of a Chief, and such organized Volunteer Firemen
as may be enrolled by the Chief with the consent of the Board of Aldermen.

The Fire Department shall have charge of the fire apparatus
and shall keep the same in good order for immediate use and for more
effectually perfecting the firemen and discharge of their duties and
shall as often as practicable thoroughly test the condition of the
fire-fighting apparatus and fire suppression systems. Upon arrival
at any fire, the members present shall take all necessary and proper
action to extinguish such fire as quickly as possible and with the
least damage possible. The fire official or his duly authorized representatives,
as may be in charge at the scene of a fire or other emergency involving
the protection of life and/or property, is empowered to direct such
operations that may be necessary to extinguish or control such suspected
or reported fires, gas leaks or other hazardous conditions or situations
or of taking any other action necessary in the reasonable performance
of their duty. The fire official may prohibit any person, vehicle
or object from approaching the scene and may remove or cause to remove
from the scene any person, vehicle or object which may impede or interfere
with the operations of the Fire Department. The fire official may
remove or cause to be removed any person, vehicle or object from hazardous
areas. All persons ordered to leave a hazardous area shall do so immediately
and shall not re-enter the area until authorized to do so by the fire
official.

If a request is received for fire fighting assistance outside
the City limits, the Fire Chief, may determine whether to answer such
request depending upon conditions at the time, and his/her decision
shall be final. The decision of the Fire Chief shall in no way subject
him/her to liability.

The Chief shall be appointed by the Mayor and with the consent
of the Board of Aldermen. The person so appointed shall serve for
an indefinite term.

The Officers shall be appointed by the Fire Chief with the approval
of the Mayor and with the consent of the Board of Aldermen. The persons
so appointed shall serve for an indefinite term.

A. It
shall be the duty of the Fire Chief to examine and report quarterly
to the Mayor the condition of the Fire Department and its equipment
and to recommend such alterations and additions and changes as the
Fire Department may in his/her judgment require. It shall also be
his/her duty to ascertain and report to the Mayor the condition and
efficiency of the Fire Department and if the Fire Department fails
to observe and enforce its rules and regulations so as to impair its
efficiency to report the same, with such suggestions as he/she may
deem most appropriate.
1. The Fire Chief shall examine all buildings and all places where explosives
and flammable materials are kept in the City and to report their condition
at least once a year to the Mayor, and the Fire Chief is hereby authorized
to enter any and all buildings and places for the purpose of inspecting
same.
2. The Fire Chief shall from time to time report to the Mayor the condition
of fire escapes on public buildings and on other buildings required
by law to be provided with fire escapes.
3. The Fire Chief shall keep an inventory of all the Fire Department's
property and equipment and report the same to the Mayor at least once
a year.
4. The Fire Chief shall keep the department in good condition and at
all times ready for inspection and to react to fires, gas leaks or
other hazardous conditions and to discharge all of its duties.
5. In the exercise of these duties, the Fire Chief may delegate such
responsibilities to the Assistant Chief, to other Fire Department
members or such others as in his/her judgment may be required.
6. The Fire Chief shall from time to time have the authority to adopt,
post and publish written fire control measures, recommendations and
regulations as herein set forth for the purpose of controlling conditions
which could impede or interfere with the fire suppression forces and
the fire suppression system within the City.
7. The Fire Chief, in coordination with the designated City Building Inspection Official shall act as the designated Code Official to enforce the provisions of the BOCA National Fire Prevention Code, l0th Edition, 1996 ("National Fire Prevention Code"), as adopted and amended under Section
520.010 of the Code.
8. The Fire Chief shall take such actions as are deemed necessary to
enforce the BOCA National Fire Prevention Code and NFPA 291 in conjunction
with the designated City Building Inspection Official.

The Assistant Chief shall assume the duties of the Chief in
his/her absence, or the vacancy of the office until a new Chief is
appointed, and shall assist the Chief in the performance of his/her
duties, and shall obey his/her orders.

The Firemen shall be under the immediate control and direction
of the Fire Chief, and upon an alarm of fire shall without unnecessary
delay report to the endangered premises with the City fire apparatus.

The Fire Chief shall have full power, control and command over
all persons at a fire, excepting only City Police Officers on duty.
He/she shall station the fire apparatus and see to it that all persons
belonging to the Fire Department perform the duties required of them.
It shall also be the duty of the Chief to direct at all fires such
measures as he/she shall deem advisable for the extinguishment and
control of such fires.

A. All
fire hydrants within the City shall be maintained in good working
order by the water company or other entity supplying water through
the fire hydrants and water flow and pressure maintained at that fire
hydrant or anywhere else within the water supply system if a fire
hydrant is in use shall be sufficient for the Fire Department's use
for fire suppression.
B. A person
shall not use or operate any fire hydrant intended for the use of
the Fire Department for fire suppression or for any other purpose
unless such person first secures a permit for such use from the Fire
Chief and the water company or other entity supplying the water in
that hydrant. This Section shall not apply to the use of such hydrants
by a person employed by or authorized to make such use by the water
company or other entity supplying water to that fire hydrant or by
the Fire Chief or his designated representative in the course of the
testing referenced below.
C. No
person, water company or other entity supplying water for that fire
hydrant may take that fire hydrant out of use or operation unless
they first secure a permit to do so from the Fire Chief.

A. A certain
document, three (3) copies of which are on file in the office of the
City Clerk of the City of Desloge, Missouri, being marked and designated
as the "NFPA 291 Recommended Practice for Fire Flow Testing and Marking
of Hydrants, 1995 Edition" ("NFPA 291") as published by the National
Fire Protection Association, be and is hereby adopted as the method
of fire flow testing and treatment of fire hydrants within the City
of Desloge; and each and all of the regulations, provisions, penalties,
conditions and terms of the said NFPA 291 are hereby referred to,
adopted and made a part hereof, as if fully set out in this Chapter,
with the additions, insertions, deletions and changes, if any, prescribed
hereinafter in this Chapter. Except as otherwise specifically provided
in this Chapter and except as hereinafter amended by any other duly
enacted ordinance of this City, any future amendments to the NFPA
291 shall become effective and be applicable herein upon the effective
date of passage of any such amendment thereto.
B. In
order to carry out the testing and purposes of the NFPA 291 or any
other necessary reasons, the Fire Chief or his designated representative
is authorized to open, use or operate any fire hydrant in order to
perform testing for any purpose, including the fire flow testing and/or
testing of residual fire hydrants in accordance with the practices
set out in NFPA 291, and to coordinate any necessary marking of fire
hydrants or to take any other actions necessary to provide appropriate
unrestricted use and operation of the fire hydrants as part of the
overall fire suppression system in the City of Desloge. Any water
company or other entity supplying water to the fire hydrant shall
mark the hydrants as directed by the Fire Chief in accordance with
NFPA 291.

No person shall drive any vehicle over, upon or across any fire
hose at any time when said hose may be in use or lying upon or across
any public way.

A. No
person shall park or leave standing in front of, or within fifteen
(15) feet of, any fire hydrants or in front of the fire house any
vehicles at any time. It shall be unlawful to obscure from view, damage,
deface, obstruct or restrict the access to any fire hydrant or any
Fire Department connection for the pressurizations of fire suppression
systems, including fire hydrants and Fire Department connections that
are located on public or private streets and access lanes or on private
property.
B. The
Fire Chief may provide written notice of violations of this Section
and if, upon expiration of the time mentioned in the notice of violation,
obstructions or encroachments are not removed, the Fire Chief or his
duly appointed representative shall proceed to remove same. Costs
incurred in the performance of necessary work shall be paid from the
municipal Treasury on certificate of the Fire Chief and the legal
authority of the municipality shall institute appropriate action for
the recovery of such costs against said violator.
C. In
the event that the violation interferes with the Fire Department's
ability to extinguish any fire, the Fire Department shall take whatever
action is necessary to cease any such interference including, but
not limited to, moving any vehicle by any means possible or breaking
windows of any vehicle in order to thread hoses used for fire suppression
through the vehicle. Neither the City nor the Fire Department or anyone
acting for the Fire Department shall be liable to anyone for such
actions.

No person shall use; or as owner thereof permit to be used,
any siren, whistle or whistles or blue lights not installed on fire
or police apparatus or in some way pertaining to fire without first
obtaining permission from the Fire Chief.

No person shall intentionally give or make a false alarm of
fire.

Any person violating any provisions of this Chapter shall be
guilty of a misdemeanor.
