Certain documents, three (3) copies of which are on file in the office of the City Clerk of the City of Desloge, being marked and designated as the International Private Sewage Disposal Code/1997, as published by the International Code Council, be and are hereby adopted as the Code of the City of Desloge for regulating and controlling the design, construction, quality of materials, erection, installation, alternation, repair, location, relocation, replacement, addition to, use or maintenance of sewage systems in the City of Desloge and providing for the issuance of permits and collection of fees therefore; and each and all of the regulations, provisions, conditions and terms of such International Private Sewage Disposal Code, 1997 Edition, published by the International Code Council in the office of the City Clerk are hereby referred to, adopted and made a part hereof as if fully set out in this Chapter. Except as otherwise specifically provided in Section 525.020 of this Chapter, and except as hereafter amended by and other duly enacted ordinance of this City, any future amendments to the International Private Sewage Disposal Code shall become effective and be applicable herein upon the effective date of passage of any such amendment thereto.
A. 
The following Sections of said International Private Sewage Disposal Code, 1997 Edition, are hereby revised as follows:
1. 
Section 101.1. Insert "City of Desloge, Missouri".
2. 
Section 106.4.2. Insert "The fee for the initial building permit shall be governed by".
3. 
Section 405.330 of the City Code to cover the administrative costs of verifying design and installation of sewage systems.
4. 
Section 106.4.3 Refunds. In the case of a revocation of a permit or abandonment or discontinuance of a private sewage disposal project, no portion of fees collected shall be refunded.
5. 
Section 108.4. Insert "misdemeanor, five hundred dollars ($500.00), ninety (90) days".
6. 
Section 108.5. Insert "five dollars ($5.00), five hundred dollars ($500.00)".
A. 
Any person who shall violate a provision of the Code or shall fail to comply with any of the requirements thereof or who shall erect, construct, alter or repair a building or structure in violation of an approved plan or directive of the Code Official, or of a permit or certificate issued under the provisions of this Code, shall be guilty of a misdemeanor, punishable by a fine of not more than five hundred dollars ($500.00), or by imprisonment of not exceeding ninety (90) days, or both such fine and imprisonment. Each day that a violation continues after due notice has been served shall be deemed a separate offense.
B. 
Any person who shall continue any work on or about the structure after having been served with a stop work order, except such work as that person is directed to perform to remove a violation or unsafe condition, shall be liable to a fine of not less than five dollars ($5.00) or more than five hundred dollars ($500.00).
