No unauthorized person shall maliciously, willfully or negligently
break, damage, destroy, uncover, deface or tamper with any structure,
appurtenance or equipment which is part of the sewage works. Any person
violating this provision shall be subject to immediate arrest under
charges of disorderly conduct.

A. The
Park Hills Director of Utilities, inspector and other duly authorized
employees of the Park Hills Wastewater Department bearing proper credentials
and identification shall be permitted to enter all properties and
buildings for the purpose of inspection, observation, measurement,
sampling and testing in accordance with the provisions of this Chapter.
The Park Hills Director of Utilities or his/her representatives shall
have no authority to inquire into any processes including metallurgical,
chemical, oil, refining, ceramic, paper or other industries beyond
that point having a direct bearing on the kind and source of discharge
to the sewers or waterways or facilities for wastewater treatment.
B. While performing the necessary work on private properties referred to in Subsection
(A), the Park Hills Director of Utilities or duly authorized employees of the Park Hills Wastewater Department shall observe all safety rules applicable to the premises established by the person or company owning and leasing the premises and the person or company shall be held harmless for injury or death to the Park Hills employees and Park Hills shall indemnify the company against loss or damage to its property by City employees and against liability claims and demands for personal injury or property damage asserted against the company and growing out of the gauging and sampling operation, except as such may be caused by negligence or failure of the company to maintain safe conditions as required by the City, Federal and State laws.
C. The
Park Hills Director of Utilities, inspector and other duly authorized
employees of the Park Hills Wastewater Department bearing proper credentials
and identification shall be permitted to enter all private properties
through which Park Hills holds a duly negotiated easement for the
purpose of, but not limited to, inspection, observation, measurement,
sampling, repair and maintenance of any portion of the sewage system
and treatment works lying within said easement. All entry and subsequent
work, if any, on said easement shall be done in full accordance with
the terms of the easement pertaining to the private property involved.

A. Any
person found to be violating any provision of this Chapter shall be
served by the City with written notice stating the nature of the violation
and providing a reasonable time limit for the satisfactory correction
thereof. The offender shall, within the period of time stated in said
notice, permanently cease all violations.
B. Any person who shall continue any violation beyond the time limits provided in Subsection
(A) above shall be guilty of a misdemeanor and on conviction thereof shall be fined in the amount not exceeding one hundred dollars ($100.00) for each violation. Each day in which any such violation shall continue shall be deemed a separate offense.
C. Any
person violating any of the provisions of this Chapter shall become
liable to the City for any expense, loss or damage occasioned to the
City or Park Hills by reason of such violation.

A. Developments Inside Of City. The following sewer facility
policy shall apply to all developers and/or owners of property desiring
sewer service, which require the construction of sewer facilities
to serve the owners' property.
In order to define the terms of this policy, the following definitions
will apply:
DEVELOPMENT
Includes all that area within the property lines of the piece
of property owned by an owner/developer.
INTERCEPTOR
Sewer line and/or appurtenances necessary to convey sewage
from the development to the existing sewer system owned by the City
of Desloge.
OWNER/DEVELOPER
A company or individual who desire to provide sewer service
to one (1) or more lots prior to occupancy.
All construction costs and related costs shall be borne by
the owner/developer.
All construction costs for sewer lines within the development
shall be paid by the owner/developer.
The construction costs to install the interceptor and/or
appurtenances to convey sewage from the development to the City's
collection line shall be paid for by the owner/developer.
B. Procedural Policy — Owner/Developer.
1. The owner/developer will make an application to the City in letter
form indicating the intention to construct a sewer facility.
2. The owner/developer has the right to hire his/her own consulting
engineer to prepare the necessary plans and necessary specifications
for the construction of the sewer facility.
3. The plans and specifications shall be prepared by the professional
engineer together with the estimated cost to construct the sewer facility,
the estimated cost to construct the sewer facility will be defined
as that cost within the development and that cost to construct the
sewer line noted above as the interceptor. The estimated construction
cost will be signed by the consulting engineer.
4. The plans and specifications shall be submitted to Desloge and to
Park Hills Wastewater Department for their review and approval.
5. Upon receipt of approval from both the City and Park Hills Wastewater
Department by notation on the drawings, the owner/developer shall
submit the approved plans and specifications to the Missouri Department
of Natural Resources in request of a permit to construct.
6. The owner/developer shall complete and prepare the necessary documentation
requesting a construction permit from the Department of Natural Resources.
This construction permit request will also be photocopied and sent
to the City and Park Hills Wastewater Department.
7. Prior to construction of the sewer facility, the owner/developer
shall notify the City and Park Hills Wastewater Department of their
intention to commence construction.
8. The consulting engineer will provide periodic construction inspection
to insure that the plans and specifications are being adhered to during
construction.
9. The Park Hills Director of Utilities or his designee will witness
a test on the completed sewer line to insure the water tightness and
the alignment of the installed sewer line.
10. The owner/developer shall deed over to Desloge all interest they
may have in the sewer line extensions together with the necessary
easements for future maintenance of the sewer line. Said easements
shall be assigned by the City to Park Hills Wastewater Department
per the contract between the two (2) Cities.
11. The owner/developer shall arrange to have one (1) year insurance
bond to guarantee the performance of any repairs necessary within
the one (1) year guarantee period. If for any reason the sewer facility
fails to function properly during the one (1) year guarantee period,
the owner/developer shall be responsible to repair the sewer facility
as may be necessary. If the owner/developer declines to repair the
sewer facility within the one (1) year period, the City will contact
the bonding company to guarantee that the proper repairs are made.
12. The owner/developer will be required to issue a set of plans to the
City and to Park Hills Wastewater Department indicating the "as-built"
information illustrating the "as-constructed" sewer facility.
13. The owner/developer will issue a signed and notarized statement to
the City that all outstanding bills on this project have been paid
and that there remain no outstanding charges against the sewer facility
project.
C. Individual Owners Inside Of City.
1. An individual owner shall run his/her own line from the house or
business to an existing sewer line or pay a contractor to do the work.
2. Tap on to this existing line can only be done by a person that is
licensed and bonded to do so and at owner's expense.
3. Fee of one hundred dollars ($100.00) is to be paid at City Hall before
tap on is made. After the tap is made, the Park Hills Wastewater Department
will notify the City that the tap is complete, at which time the City
will remit fifty dollars ($50.00) to the Park Hills Wastewater Department.
If the structure is an apartment building, a fee of one hundred dollars
($100.00) for the first (1st) apartment plus twenty-five dollars ($25.00)
for each additional apartment.
D. It
is the desire of the Board of Aldermen of the City to set policy,
terms and conditions for the extension of sewer lines and/or the provision
of sewer services outside the corporate limits of the City in accordance
with the City's interest in promoting orderly development within its
immediate planning area, in avoiding fragmented corporate limits and
in furthering the primary purpose of providing municipal services
to the City's own taxpaying citizens.
1. It is the policy of the City not to provide billing services for sewer service outside the corporate limits of the City or to allow any person or entity outside the corporate limits to tap into any line of the existing sewer system in the City consistent with written contract with Park Hills and any exception thereto will be referenced in a written contract with the City. The City also does not allow sewage generated from outside the municipal limits to flow to any treatment facility via the sewer system within the City except as set forth in Subsection
(D)(2) of this Section.
2. The City may arrange for wastewater sewer services to be provided
outside the corporate limits of the City under the following conditions:
a. As agreed in contract with Park Hills; or
b. All extensions of municipal sewer service outside the corporate limits
of the City will be undertaken only where the persons or entities
requesting such extension:
(1)
In the case of land contiguous to the corporate limits of the
City, requests annexation by verified petition of all landowners of
record; or
(2)
In the case of land not contiguous to the corporate limits of
the City:
All landowners sign a "petition for voluntary annexation" with
pertinent text as substantially as follows:
"The undersigned, in consideration of Desloge, Missouri, granting
to the undersigned the right to tap into the sanitary sewer service
arranged by Desloge upon compliance with Desloge's development rules,
regulations, guidelines and procedures and, upon payment of the customary
fees, hereby petition(s) and request(s) the Board of Aldermen of Desloge
to annex into the corporate limits the following described tract of
land presently outside of the corporate limits when the said land
becomes contiguous to the corporate limits of said Desloge, Missouri..."
This request shall be a continuing obligation running with the
land and shall bind all subsequent owners, their heirs, executors,
administrators, assigns or legal representatives. It is understood
that this instrument shall be recorded in the Recorder of Deeds office
of St. Francois County and shall provide notice be of record.
c. Owners agree by contract to be bound to all development rules, regulations,
guidelines and procedures then in effect within the City including,
but not limited to, setback requirements, lot sizes, land use and
building and construction codes, street widths, utility installation
and site development plans as well as inspection requirements and
occupancy permits;
d. The persons or entities making the request agree to install at their
expense such sewer line extensions as are necessary to serve the property
requesting service from the nearest point of the then existing main
line sewer, except that the City and Park Hills Wastewater Department
reserve the right to require that service lines be appropriately sized
to accommodate future growth and orderly development. Any participation
by the City towards payment of the costs of said lines shall be limited
to the difference in cost between the oversized facilities and the
facilities necessary to provide the extension to the petitioner(s)
land(s). All lines so installed shall meet all standards in effect
at the time. Ownership of said lines including easements for said
lines shall be transferred to the City after inspection to insure
proper installation of said lines. Said easements shall be assigned
by the City to Park Hills Wastewater Department in accordance with
the contract between the two (2) cities; and
e. The Board of Aldermen of the City shall have made a determination
that the extension of said sewer service is in the best interest of
the City.
f. In the event of a conflict between areas outside the corporate limits
of the City requesting service and the City's ability to provide services,
the following priorities shall be followed:
(1)
Service shall first be provided to those areas requesting annexation
by petition of all property owners of record within the area.
(2)
Service will next be provided to those areas not contiguous
to the corporate limits.

Unless the context specifically indicates otherwise, the meaning
of the terms used in this Chapter shall be as follows:
ACT
The Federal Water Pollution Control Act, as amended, 33 U.S.C.
et seq.
ADMINISTRATOR
The Administrator of the U.S. Environmental Protection Agency.
BASIC USER CHARGE
The basic assessment levied on all users of the public sewer
system.
BOD (BIOCHEMICAL OXYGEN DEMAND)
The quantity of oxygen utilized in the biochemical oxidation
of organic matter under standard laboratory procedure in five (5)
days at twenty degrees Celsius (20°C), expressed in milligrams
per liter.
BUILDING DRAIN
That part of the lowest piping of a drainage system which
receives the discharge from soil, waste and other drainage pipes inside
the walls of the building and conveys it to the building sewer or
the approved point of discharge, beginning five (5) feet (1.5 meters)
outside the inner face of the building wall.
BUILDING SEWER
The extension from the building drain to the public sewer
or other place of disposal.
CITY
The City of Desloge, St. Francois County, Missouri, and any
reference to "within the City" shall mean all areas within the boundaries
of the City of Desloge.
COMPATIBLE POLLUTANT
Biochemical oxygen demand, temperature, suspended solids,
pH and fecal coliform bacteria, plus additional pollutants identified
in Park Hills NPDES permit.
CONTROL MANHOLE
A structure located on a site from which industrial wastes
are discharged. Where feasible, the manhole shall have an interior
drop. The purpose of a "control manhole" is to provide access for
a Park Hills Wastewater Department representative to sample and/or
measure discharges.
DELETERIOUS MATTER
Any substances, material and/or matter which is not a common
characteristic of normal domestic water-carried waste referred to
as wastewater and/or sewage, that will damage, harm and/or make inoperable
any portion of the wastewater system, which includes the pump unit(s),
piping, valves, treatment facilities, irrigation facilities and/or
appurtenances. Such substance(s), material(s) and/or matter include
the following: wood, metal, plastic or glass items, grit, sand, gravel,
stone or rock, trash, garbage, grease, oil, fat, cloth and/or disposable
diapers, feminine hygiene articles, articles of clothing, rubber goods,
plastic bags, nylon rope, eating utensils, toxic wastes, etc.
DIRECTOR
The chief administrative officer of the Missouri Department
of Natural Resources.
DIRECTOR OF UTILITIES
The Director of the Utility Department for the City of Park
Hills or his/her designee.
DOMESTIC SEWAGE
Wastewater derived principally from residences, business
buildings, institutions and the like.
EASEMENT
An acquired legal right of the specific use of land owned
by others.
FEDERAL GRANT
The U.S. Government participation in the financing of the
construction of the treatment works as provided for by Title II Construction
Grants for Waste Water Treatment Works of the Act.
FLOATABLE OIL
Oil, fat or grease in a physical state such that it will
separate by gravity from wastewater by treatment in an approved pretreatment
facility. A wastewater shall be considered free of floatable fat if
it is properly pretreated and the wastewater does not interfere with
the collection system.
GARBAGE
Solid wastes from the domestic and commercial preparation,
cooking and dispensing of food and from the handling, storage and
sale of produce.
GREASE
Any oil, tallow, animal fat and/or any compound used for
cooking and dispensing of food and from the handling, storage and
sale of produce.
INDUSTRIAL USER
Any non-governmental user of public owned treatment works
identified in the Standard Industrial Classification Manual, 1972,
Office of Management and Budget, as amended, and supplemented under
the following Divisions:
1.
Division A. Agriculture, Forestry and Fishing.
3.
Division C. Manufacturing.
4.
Division D. Transportation, Communications,
Electric, Gas and Sanitary Services.
5.
Division I. Services.
A user in the Divisions listed may be excluded if it is determined
by the supervisor that it will introduce primarily segregated domestic
wastes or wastes from sanitary conveniences.

The word "non-governmental" shall be struck from the aforementioned
definition when the definition is used in context with the user charge
system.
|
INDUSTRIAL WASTE
Any solid, liquid or gaseous substance discharged, permitted
to flow or escaping from any industrial manufacturing, commercial
or business establishment or process or from the development, recovery
or processing of any natural resource as distinct from their employees
waste or waste from their sanitary conveniences.
MAJOR CONTRIBUTING INDUSTRY
An industrial user of the publicly owned treatment works
that:
1.
Has a flow greater than five percent (5%) of the flow carried
by the municipal system receiving the waste;
2.
Has in its waste a toxic pollutant in toxic amounts as defined
in standards issued under Section 307(a) of the Act; or
3.
Is found by the permit issuance authority, in connection with
the issuance of an NPDES permit to the publicly owned treatment works
receiving the waste, to have the significant impact, either singly
or in combination with other contributing industries, on that treatment
works or upon the quality of effluent from that treatment works.
MILLIGRAMS PER LITER (mg/l)
A unit of concentration of water or wastewater constituent.
It is one-thousandth (0.001) gram of the constituent in one thousand
(1,000) milliliters of water. It has replaced the unit formerly used,
commonly parts per million, to which it is approximately equivalent,
in reporting the results of water and wastewater analysis.
MINERAL BELT AREA
The cities of Desloge, Park Hills, Leadington, St. Joe State
Park and the surrounding area. Park Hills has been selected as the
"lead" City with respect to the treatment works.
NATURAL OUTLET
Any outlet into a watercourse, pond, ditch, lake or other
body of surface or ground water.
NORMAL DOMESTIC WASTE
Wastewater that has a BOD concentration of not more than
three hundred fifty (350) mg/l and a suspended solids concentration
of not more than four hundred thirteen (413) mg/o based on sixty (60)
gallons per day per person and other pollutants.
NPDES PERMIT
Any permit or equivalent document or requirements issued
by the Administrator, or where appropriate by the Director, after
enactment of the Federal Water Pollution Control Amendment of 1972
to regulate the discharge of pollutants pursuant to Section 402 of
the Act.
OPERATION AND MAINTENANCE
The normal direct and indirect cost of carrying on the business
other than the debt service, including replacement costs.
OWNER
Any individual(s), firm, company or corporation owning a
parcel(s) of real estate.
PERSON
Any and all persons, natural or artificial, including any
individual, firm, company, municipal or private corporation, association,
society, institution, enterprise, governmental agency or other entity.
pH
The logarithm (base 10) of the reciprocal of the hydrogen-ion
concentration expressed in grams per liter of solution. It shall be
determined by one (1) of the procedures outlined in "Standard Methods".
POPULATION EQUIVALENT
A term used to evaluate the impact of industrial or other
waste on a treatment works or stream. One (1) population equivalent
is one hundred (100) gallons of sewage per day, containing seventeen-one
hundredths (0.17) pounds of BOD and twenty-hundredths (0.20) pounds
of suspended solids. The impact on a treatment works is evaluated
as the equivalent of the highest of three (3) parameters. Impact on
a stream is the higher of the BOD and suspended solids parameters.
PPM
Parts per million by weight.
PRETREATMENT
The treatment of wastewaters from sources before introduction
into the wastewater treatment works.
PROPERLY SHREDDED GARBAGE
The wastes from the preparation, cooking and dispensing of
food that has been shredded to such a degree that all particles will
be carried freely under the flow conditions normally prevailing in
public sewers, with no particle greater than one-half (½) inch
(1.27 centimeters) in any dimension.
PUBLIC SEWER
A sewer provided by, or subject to, the jurisdiction of the
City. It shall also include sewers within or without the boundaries
of the City that serve one (1) or more persons and ultimately discharge
into the City's sanitary sewer system, even though those sewers may
not have been constructed with the City's funds.
REPLACEMENT
Expenditures for obtaining and installing equipment, accessories
or appurtenances which are necessary during the service life of the
sewage works to maintain the capacity and performance for which such
works were designed and constructed. The term "operation and
maintenance" includes replacement.
RESIDENTIAL OR COMMERCIAL USER
Non-industrial use, any user of the treatment works not classified
as an industrial user or excluded as an industrial user in this Chapter.
RESIDENTIAL USER
Any contributor to the Mineral Belt area's treatment works
whose lot, parcel of real estate or building is used for domestic
dwelling purposes only.
SANITARY SEWER
A sewer that conveys domestic sewage or industrial wastes,
or a combination of both, and into which storm, surface and ground
water or unpolluted industrial wastes are not intentionally admitted.
SANITARY WASTE
The water supply of a community after it has been fouled
by various users. From the standpoint of source, it may be a combination
of the liquid or water-carried wastes from residences, business buildings,
institutions and industrial establishments, together with any ground
water, surface water and stormwater that may be present.
SEWER
A pipe or conduit for conveying sewage or any other waste
liquids, including storm, surface and ground water drainage, either
by gravity or pressure.
SEWERAGE
The system of sewers and appurtenances for the collection,
transportation and pumping of sewage.
SEWERAGE WORKS
Any City owned, leased or contractually arranged sewerage
or treatment works.
SHALL
Is mandatory; MAY: Is permissible.
SLUG
Any discharge of water, sewage or industrial waste which
in concentration of any given constituent or in quantity of flow exceeds
for any period of duration longer than fifteen (15) minutes more than
five (5) times the average twenty-four (24) hour concentration or
flows during normal operation.
SS (Denoting Suspended Solids)
Solids that either float on the surface of, or are in suspension
in, water, sewage or other liquids and which are removable by laboratory
filtering.
STANDARD METHODS
The examination and analytical procedures set forth in the
most recent edition of "Standard Methods for the Examination of Water,
Sewage and Industrial Wastes" published jointly by the American Public
Health Association, the American Water Works Association and the Federation
of Sewage and Industrial Wastes Association.
STORM SEWER
A sewer that carries storm, surface and ground water drainage
but excludes sewage and industrial wastes other than unpolluted cooling
water.
SUPERVISOR
The supervisor of the Public Works Department for the City
or his/her authorized deputy, agent or representative.
SURCHARGE
The assessment, in addition to the basic user charge, which
is levied on those persons whose wastes are greater in strength than
the concentration values established by Park Hills but in no event
will they be more than surcharges charged within Park Hills to those
persons whose wastes are greater in strength than the concentration
values used by Park Hills.
SUSPENDED SOLIDS
Solids that either float on the surface of, or are in suspension
in, water, sewage or industrial waste, and which are removable by
a laboratory filtration system. Quantitative determination of suspended
solids shall be made in accordance with procedures set forth in "Standard
Methods".
TOXIC WASTES
Any pollutant introduced to the treatment works, which may
interfere with, pass through or otherwise be incompatible with such
works.
UNPOLLUTED WATER
Water of quality equal to or better than the effluent criteria
in effect or water that would not cause violation of receiving water
quality standards and would not be benefited by discharge to the sanitary
sewers and wastewater treatment facilities provided.
USEFUL LIFE
The estimated period during which the treatment works shall
be operated and shall be twenty (20) years from the date of start-up
of any wastewater facilities constructed with a Federal grant.
USER
Any household, business, commercial establishment or industry
which is connected to the sewer system.
USER CHARGE
A charge levied on users of treatment works for the cost
of operation and maintenance including replacement of such works and
shall consist of both basic user charges and surcharges.
USER CLASS
The type of use either residential or commercial or industrial
as defined by this Section.
WASTEWATER FACILITIES
The structures, equipment and processes required to collect,
carry away and treat domestic and industrial wastes and dispose of
the effluent.
WASTEWATER OR SEWAGE
The spent water of a community. From this standpoint of course,
it may be a combination of the liquid and water-carried wastes from
residences, commercial buildings, industrial plants and institutions,
together with any ground water, surface water and stormwater that
may be present.
WASTEWATER SERVICE CHARGE
The charge per month levied on all users of the wastewater
facilities. The service charge shall be computed per the rates established
by Park Hills, in conjunction with the amended wastewater billing
agreement with the City of Park Hills, and shall consist of the total
of the basic user charge and a surcharge, if applicable.
WASTEWATER TREATMENT WORKS
An arrangement of devices and structures for treating and
irrigating wastewater, industrial wastes and sludge. Sometimes used
as synonymous with "waste treatment plant" or "wastewater treatment
plant" or "pollution control plant".
WATER METER
A water volume measuring and recording device furnished and/or
installed by the City or furnished and/or installed by a user and
approved by the City.
WATERCOURSE
A channel in which a flow of water occurs, either continuously
or intermittently.
