There is hereby established a Fair Board for the City of Lexington,
Missouri, which shall consist of nine (9) members to be appointed
by the Mayor and approved by the City Council of the City of Lexington.
To be a member of the Fair Board, a person must be eighteen (18) years
of age or older.

The term of office of each such appointee shall be for a term
of three (3) years, except three (3) of the first nine (9) members
of the Board shall be appointed for a three-year term, three (3) shall
be appointed for a two-year term and three (3) shall be appointed
for a one-year term to permit staggered terms of the membership. The
terms shall be from September 1 through August 31.

The purpose of the Fair Board shall be to organize, sponsor,
operate and manage fairs, festivals and other types of similar gatherings
for the City of Lexington, Missouri.

The Fair Board shall elect a Chairman, Vice Chairman and a Secretary/Treasurer.
The Chairman shall preside at all meetings of the Fair Board and the
Secretary shall take minutes thereof. The Secretary shall post a notice
of the agenda of all Fair Board meetings at City Hall and all meetings
of the Fair Board shall be open to the public and be conducted pursuant
to the Sunshine Law requirements of the State of Missouri.

The Fair Board shall be an advisory board. All expenditures
of City funds and contracts concerning City land must be approved
by the City Council of the City of Lexington. All revenues and/or
donations shall be given to the Treasurer of the Fair Board, money
shall be deposited and withdrawn from the Fair Board account. Any
net proceeds resulting from a fair event or donation shall be used
for projects benefiting the general public of the City of Lexington.
Said projects shall be determined by the Fair Board and where such
project may affect City owned property, coordinate with the City Council.

The Fair Board shall insure that the City causes signs to be
posted and maintained at all locations clearly visible at all major
entrances and other locations throughout the event where the Fair
Board is sponsoring an event. Such signs shall provide the following
language:

Under Missouri Law the City of Lexington, Missouri, is not liable
for an injury to or the death of any person resulting from the inherent
risks of participating in or observing any activities at this event
pursuant to the Revised Statues of Missouri Section 537.550.

Should the Fair Board cease to exist for any reason, any funds
held by the Fair Board shall be turned over to the City of Lexington
for deposit in the general fund. The City may then use these funds
for any purpose deemed necessary by the City.
