As used in this chapter, the following terms shall have the
meanings indicated:
DESIGNATED AREA
The area bound on the west by the Susquehanna River, on the
east by Church Street and Spring Alley, and on the north and south
by the City line borders in an area known as the "Central Business
District," its surrounding pavement and public streets and the intersecting
public streets, their roadways, berms and adjacent sidewalks. This
area shall include private lots without the owner's permission.
SKATEBOARDING
A.
"Skateboarding" is that practice of one or more persons
riding, pedaling or otherwise propelling themselves on a single board
mounted upon two or more wheels without the benefit of handlebars
or other manual control device.
B.
"Roller-skating" or "roller-blading" is that practice of a person
propelling themselves on a shoe or boot designed with wheels.
C.
These three forms of recreation will hereinafter be referred
to as "skateboarding," which shall refer to all three.
Any person violating any of the provisions of this chapter shall,
upon summary conviction thereof in a summary proceeding before a Magisterial
District Judge of the City of Pittston, be sentenced, for a first
offense, to pay a fine of not more than $25, and costs, and/or to
be imprisoned in the county jail for a period not exceeding 90 days
and shall have the skateboard confiscated at the time of the citation.
The skateboard will be held until the disposition of the citation.
Upon conviction of a second offense, such persons shall be sentenced
to pay a fine of not more than $50, and costs, and/or to be imprisoned
in the county jail for a period not exceeding 90 days. Upon conviction
of a third and any subsequent offense, such person shall be sentenced
to pay a fine of not more than $300, and costs, and/or to be imprisoned
in the county jail for a period not exceeding 90 days. Each and every
day upon which any person shall violate or continue to violate the
provisions of this chapter shall constitute a separate offense.
