As used in this Article, the following terms mean:
ENTER UNLAWFULLY or REMAIN UNLAWFULLY
A person enters or remains in or upon premises when he or
she is not licensed or privileged to do so. A person who, regardless
of his or her purpose, enters or remains in or upon premises which
are at the time open to the public does so with license and privilege
unless he or she defies a lawful order not to enter or remain, personally
communicated to him or her by the owner of such premises or by other
authorized person. A license or privilege to enter or remain in a
building which is only partly open to the public is not a license
or privilege to enter or remain in that part of the building which
is not open to the public.
TO TAMPER
To interfere with something improperly, to meddle with it,
displace it, make unwarranted alterations in its existing condition,
or to deprive, temporarily, the owner or possessor of that thing.
UTILITY
An enterprise which provides gas, electric, steam, water,
sewage disposal, or communication, video, internet, or voice over
internet protocol services, and any common carrier. It may be either
publicly or privately owned or operated.
It shall be a misdemeanor for any person, not a municipal employee,
to be within the fenced confines of the Marshfield Municipal Swimming
Pool at any time that the pool is not open to the general public without
the express permission and authority of the Marshfield City Park Board.
It shall be a misdemeanor for any person, not a municipal employee,
to be on the grounds of the municipal parks of the City of Marshfield,
Missouri, between the hours of 10:00 P.M. and 5:00 A.M. without the
express permission and authority of the Marshfield Board of Aldermen
or the Marshfield City Park Board.
A person commits the offense of reckless burning or exploding
if he/she recklessly starts a fire or causes an explosion and thereby
damages or destroys the property of another.

A. It
shall be unlawful to burn any of the following within the City limits
of the City of Marshfield, Missouri:
1. Any plastics, tires and rubber;
2. Any building or construction materials;
3. Any trash or materials generated by a business, trade or industry.
B. It
shall be lawful for individual household members to burn the following
items within the City limits of the City of Marshfield, Missouri,
upon applying for and obtaining a burn permit:
C. Burn
permits shall be issued without charge by the Building Regulations
Department at City Hall or by the District Fire Marshal or District
Fire Chief. Burn permits shall be valid not to exceed thirty (30)
days. Permits may not be issued during times of extreme wind or dry
conditions or during the time that an open burn ban has been established.
D. Permits
to burn the above listed authorized items may be obtained by business
owners with the approval of the District Fire Marshal, District Fire
Chief, or other designated representative as authorized by the District
Fire Chief.
E. The
following restrictions and regulations apply to all burning within
the City limits of the City of Marshfield, Missouri:
1. It shall be unlawful to burn on any street or alley.
2. The location for open burning shall not be less than fifty (50) feet
from any structure, and provisions shall be made to prevent the fire
from spreading to within fifty (50) feet of any structure.
Exceptions:
a. Fires in approved containers that are not less than fifteen (15)
feet from a structure. An approved container is a barrel covered with
a screening material.
b. The minimum required distance from a structure shall be twenty-five
(25) feet where the pile size is three (3) feet or less in diameter
and two (2) feet or less in height.
3. Open Burning may only be conducted during daylight hours unless otherwise
authorized by the District Fire Marshal, District Fire Chief, or other
designated representative as authorized by the District Fire Chief.
4. Open burning shall be no closer than ten (10) feet from any street.
5. All open burning must be constantly monitored by an adult eighteen
(18) years of age or older.
6. Anyone burning must have at that location one (1) of the following:
water hose, approved portable fire extinguisher, dirt, sand, water
barrel, or water truck.
7. Smoke created from burning must not obstruct or hinder traffic.
8. No burning shall be conducted in extreme wind, dry conditions, or
when an open burning ban has been established.
9. Smoke or odor created from burning must not create a nuisance.
10. It shall be unlawful for any person to burn within ten (10) feet
of any propane or gas tank.
F. Violations and complaints shall be investigated by the District Fire Chief or his/her designated representative. If a violation is observed, or if a nuisance is created, the District Fire Chief or his/her designated representative will order that the fire be extinguished. If the order is not complied with, the Marshfield Fire Protection District will be called to extinguish the fire. Persons found in violation of this Code shall be subject to a fine and/or confinement as provided by Section
100.240.
