Pursuant to Section 67.765, RSMo., there is hereby created a
Park Board for the City of Kearney, Missouri. The Park Board shall
have nine (9) members, which shall consist of one (1) member from
the Board of Aldermen. All Board members shall have been residents
of the City for at least one (1) year immediately prior to their appointment
and shall hold office for a period of five (5) years or until their
successors are appointed.

A. All
appointments to the Park Board shall be made by the Mayor and approved
by the Board of Aldermen as required by State law. Each member shall
serve until his/her successor is duly appointed and qualified and
shall receive no compensation. Within days after appointment of members,
there shall be an organizational meeting of the Board at which time
the members shall elect from among their number a President and such
other officers as may be necessary to serve for the ensuing year and
until the election and qualification of their respective successors.
Vacancies shall be filled in the same manner as regular appointments
and any person so appointed shall serve the remainder of the unexpired
term.
B. The
Park Board shall make and adopt such bylaws, rules and regulations
for their guidance and for the government of parks as may be expedient,
not inconsistent with Sections 67.750 to 67.780, RSMo.

Subject to approval of the Board of Aldermen, the Park Board
shall have charge of all property which has been designated by the
Board of Aldermen for park and public recreation purposes. It shall
be responsible for the erection and maintenance of all recreational
facilities on such properties, the hiring of all help needed for the
maintenance of all park property, the determination of the various
uses for which the City park and every park thereof shall be put,
the promulgation of all necessary rules and regulations for the proper
management of all the public park system, including the leasing of
concessions and the charges, if any, to be made therefor and the scheduling
of recreational events and times of operation.

A. Duties Generally.
1. It shall be the responsibility of the Park Board to serve as the
City Tree Board to study, investigate, advise, report or develop any
plan or program which is determined to be necessary or advisable for
the care, selection, preservation, pruning, planting, replanting,
removal or disposition of trees and other woody vegetation located
in public parks, on other City-owned or maintained grounds or on public
land adjacent to all City streets. Such a plan will be presented to
the Mayor and Board of Aldermen and, upon its acceptance and approval,
shall constitute the official comprehensive tree plan for the City
of Kearney, Missouri. The Board shall review annually and update,
if needed, the comprehensive City tree plan. The Board, when requested
by the Mayor and Board of Aldermen, shall consider, investigate, make
findings, report and recommend upon any special matter of question
within the scope of its work.
2. It shall also be the purpose of the Tree Board to assist in securing
the cooperation of the residents of Kearney in a coordinated and planned
program of tree protection and planting on public and private property.
B. Interference With City Tree Board And City. It shall be unlawful for any person to prevent, delay or interfere with the City Tree Board, the City or any of its agents while engaging in and about the caring for, planting, cultivating, pruning, spraying or removing of any street trees or park trees as authorized in this Chapter or Chapter

C. Penalty. Any person violating any provision of this Section shall be, upon conviction or a plea of guilty before the Kearney Municipal Court, subject to the penalties set forth in the Kearney Municipal Code Section
100.220.

All funds acquired by the City for park purposes and funds collected
by the Park Board shall be turned over to the City Treasurer and placed
by that officer in a separate fund to be designated "Park Fund". All
withdrawals of such funds shall be by warrant as required by law for
the expenditure of such funds and all expenditures shall be made subject
to approval of the Board of Aldermen.
