A. Pursuant
to Section 85.620, RSMo., there is hereby created the position of
Chief of Police, the occupant of which shall have power to serve and
execute all warrants, subpoenas, writs and other process and to make
arrests. He/she shall be a conservator of the peace and shall be active
and vigilant in the preservation of good order within the City. The
Chief of Police shall have supervisory control of such other Police
Officers as may be appointed by the City. The Chief of Police and
said Policemen shall be appointed by the Mayor with the consent of
the majority of the Board of Aldermen and shall serve at the pleasure
of the Governing Body of the City. All such Policemen shall have power
to serve and execute all warrants, subpoenas, writs or other process
and make arrests in the same manner as the Chief of Police. All matters
relating to the operation of the Kearney, Missouri, Police Department,
the control of all supplies, vehicles, uniforms, facilities and the
Police office and jail shall be under the direct control of the Chief
of Police. The Chief of Police and the Police Officers shall receive
such salary as shall be fixed by the Board of Aldermen and may be
changed by them at any time.
B. If the
Chief of Police or other Police Officer arrests a person in the nighttime
or on Sunday, they are hereby empowered to and shall accept bail from
the person arrested in a sum not less than fifty dollars ($50.00)
for his/her appearance before the Municipal Judge at a time near at
hand, but in default of such bail, the officer shall commit the prisoner
to the City Jail or some place for safekeeping until he/she can be
brought before the Municipal Judge.
C. Before
entering into their duties as Chief of Police and Policeman, each
person so appointed shall take the oath of office to faithfully enforce
the laws and ordinances of this City.
D. The Mayor
and Board of Aldermen, whenever they deem it necessary, may appoint
suitable and trustworthy citizen members of the Police force of the
City who shall serve for such time as they may direct and receive
such compensation as may be fixed by the Board.
