In interpretation of this and all succeeding parks and recreation area ordinances, the provisions shall be construed as follows:
ALCOHOLIC BEVERAGE
Intoxicating liquor or malt liquor.
ATHLETIC FIELD
Designated areas for organized athletic league play such as softball diamonds, football fields and soccer fields.
DOMESTIC ANIMALS
Such as are habituated to live in or about the habitations of people or such as to contribute to the support of a family or the wealth of the community.
LITTER
To throw or place or cause to be thrown or placed any glass, glass bottles, wire, nails, tacks, hedge, cans, garbage, trash, refuse or rubbish of any kind, nature or description in the parks or recreation areas.
MOTORIZED VEHICLE
Any self-propelled vehicle, excepting devices moved by human power or used exclusively upon stationary rails or tracks.
PERMIT
Any written license issued by the City of Kearney permitting a special event or activity on or in a park or building facility.
PERSON
Any natural person, corporation, company, association, joint stock association, firm or co-partnership.
TRAIL
Any walking trail, exercise path or path maintained for pedestrians within a City park or recreation area.
VEHICLE
Every device in, upon or by which any person or property is or may be transported or drawn.

A. 
It shall be unlawful for any person in a public park or recreation area to:
1. 
Allow domestic animals to be unrestrained. Domestic animals shall be restrained at all times by a hand-held leash by a responsible person physically capable of controlling such animal.
2. 
Possess, open or drink any alcoholic beverage except as permitted by a written contract between the City and an entity properly licensed and insured and for a local not-for-profit purpose.
3. 
Have glass beverage containers in the public park or recreation area.
4. 
Climb structures, buildings, foul poles, light poles and fences placed and maintained by the City, other than playground equipment. Climb on playground equipment and be a non-age appropriate person, as determined by posted City Rules and/or manufacturer standards.
5. 
Vandalize any existing park structures, grounds, equipment or facilities.
6. 
Litter.
7. 
Enter or remain in Lion's Park after dusk or before dawn. Enter or remain in any other public park or recreation area between the hours of 11:00 P.M. to 6:00 A.M. Officially sanctioned events approved by the Park Coordinator shall be the only exception.
8. 
Smoking of any kind is prohibited in Lion's Park.

9. 
Fishing on public property by any means other than with a pole and line is prohibited. Pole and line shall have only one (1) hook assembly or lure. No person shall have more than two (2) poles and lines in use at one time, and all persons shall possess a current State fishing license pursuant to Missouri Conservation Department rules.

A. 
It shall be unlawful for any person in a public park or recreation area to:
1. 
Drive any vehicle on any area except the park roads or parking areas or such areas as may on occasion be specifically designated as temporary areas.
2. 
Park a vehicle anywhere except on a designated parking area.
3. 
Leave a vehicle standing or parked in established parking areas or elsewhere in the park and recreation areas during hours when the park and recreation area is closed.
4. 
Ride a bicycle without reasonable regard to the safety of others.
5. 
Use the parks, park drives, parking places or parkways for the purpose of demonstrating any vehicles, or for the purpose of instructing another to drive or operate any vehicle nor shall any person use any park area, including parking places, for the repairing or cleaning of any vehicle, except in an emergency.
6. 
Cause or permit a vehicle in tow of another vehicle to enter the parks or proceed therein, except that in case of a breakdown, a disabled vehicle may be towed to the nearest exit; or operate or drive a vehicle containing any person or object projecting or hanging outside of or beyond the side or the rear thereof.
7. 
Operate, ride, push, carry or park skateboards, motorized vehicles or horses on the trails.

A. 
It shall be unlawful for any person in a public park or recreation area to:
1. 
Use an athletic field when said field has been reserved or closed for maintenance. Athletic fields may be reserved by obtaining a permit from the City of Kearney.
2. 
Use picnic shelter when said shelter has been previously reserved. Shelters may be reserved by obtaining a permit from the City of Kearney.
3. 
Practice golf techniques, such as driving, chipping or putting.

It shall be unlawful for any person to ride, push, carry or park bicycles and skate boards anywhere except on a designated area.

The violation of any provision of this Chapter shall be punished by a fine not exceeding five hundred dollars ($500.00) or by imprisonment for a period of not exceeding ninety (90) days, or by both such fine and imprisonment.
