The purpose of this article is to ensure public health, safety and welfare by prohibiting the deposit of mud, dirt, sediment, dust, debris, snow and/or other material on the roadways, streets, public right-of-ways, alleys and sidewalks which may create a safety hazard for pedestrians and the motoring public, and to reduce the amount of sediment and debris that may otherwise enter storm sewers and/or pollute the waters of the Township.
A. 
The deposit or placement of mud, dirt, dust, sediment debris, ashes, waste or solids, sand, clay, gravel, snow and/or other material, directly or indirectly, on the roads, streets, public rights-of-way, alleys and sidewalks within the municipal limits of the Township of Harrison, or to drive or haul said debris or material in such a manner so as to scatter about or litter same on any road, street or adjoining premises, or into any stream or watercourse, or ditch running into, through, or adjacent to the Township of Harrison is prohibited.
B. 
In the event that mud, dirt, dust, debris, sediment, snow and/or other material is deposited upon any road, street, public right-of-way, alley or sidewalk within Harrison Township, it shall be the responsibility of the contractor, vehicle operator and/or property owner to remove and clean such material or debris immediately. The corrective actions will include cleaning of the streets, driveways, paths, storm sewers, ditches and all areas impacted by the unlawful deposit of debris or material.
C. 
Written notification of the violation shall be delivered to the person(s) or entity violating this article and/or posted at the site where the condition is attributable. The corrective actions must be performed within four hours of the issuance of the notice of violations. Cleaning shall not be done in such a manner as to introduce mud, dirt, sediment dust, debris and/or other material into the air or water.
D. 
If, after issuance of said notice, all corrective actions have not been completed within the prescribed four hours, work shall be stopped at the site to which the condition is attributable, and the violators shall be subject to the penalty provided for in § 189-24. The work shall not be resumed until the condition is corrected or abated. The Township of Harrison may issue a stop-work order at the offending site in the event the condition is not corrected after notice has been provided.
E. 
Any person or entity who owns, leases or occupies property in connection with which fill, excavated material, debris, mud, dirt, rock, sand, gravel, concrete, asphalt, snow and/or other material is hauled to or removed from, or caused or allowed to be spilled, dumped, deposited or tracked onto the public streets, alleys, rights-of-way or sidewalks shall be subject to any penalty authorized by this article.
F. 
Any person or entity who transports or contracts to do construction or excavation work on property in connection with which fill, excavated material, construction debris, mud, dirt, rock, fill, gravel, concrete, asphalt, snow and/or other material is hauled to or removed from, or caused or allowed to be spilled, dumped, deposited or tracked onto the public streets, alleys, right-of-ways or sidewalks shall be subject to any penalty authorized by this article.
The enforcement of this article shall be by the Township Police Department, Township Engineer, Zoning Officer, Code Enforcement Officer and/or Building Inspector.
Any person violating any of provisions of this article shall, upon conviction thereof, be subject to one or more of the following: a fine not exceeding $2,000; up to 90 days in jail; and/or by a period of community service not exceeding 90 days.
