A. There is hereby created the position of
City Prosecutor. The City Prosecutor shall be a duly licensed Missouri
attorney-at-law. It shall be the duty of the City Prosecutor to prosecute
all actions in the Municipal Court involving violations of the ordinances
of the City as well as any appeals therefrom.
B. There is hereby created the position of
City Attorney. The City Attorney shall be a duly licensed Missouri
attorney. The City Attorney shall represent the City in all cases,
other than those involving the violation of a Municipal ordinance,
in all courts of record in the State; shall draft all ordinances and
contracts and all legal forms of every kind, and shall give legal
advice to the Board of Aldermen and the City Administrator and other
officers of the City and perform such other duties as shall be prescribed
by ordinance or shall be ordered by the Board or Mayor or the City
Administrator. The Mayor and Board of Aldermen, if deemed for the
best interests of the City, may, by ordinance, employ special counsel
to represent the City, either in a case of a vacancy in the office
of City Attorney or to assist the City Attorney, and pay reasonable
compensation therefor.
C. Compensation. The compensation of both
the City Prosecutor and the City Attorney shall be as provided for
by appropriate action of the Board of Aldermen.
D. Term. The City Prosecutor and the City
Attorney shall be appointed by the Mayor, with the consent and approval
of the majority of the members of the Board of Aldermen. The City
Prosecutor and the City Attorney shall serve until their resignation
or removal by the Mayor with the consent and approval of a majority
of the members of the Board of Aldermen.
