The language set forth in the text of this chapter shall be
interpreted in accordance with the following rules of construction:
A. The singular number includes the plural and the plural the singular.
B. The present tense includes the past and future tenses and the future
the present.
C. The word "shall" is mandatory, while the word "may" is permissive.
D. The masculine gender includes the feminine and neuter.
E. Whenever a word or term defined hereinafter appears in the text of
this chapter, its meaning shall be construed as set forth in the definition
thereof; and any word appearing in a parenthesis directly after a
word herein defined shall be construed in the same sense as that word.
F. The words "subdivision" and "planned unit development" are interchangeable
in the content of this chapter, and when one of these words is employed
to explain a procedure or requirement, it shall also be interpreted
to pertain to the other, unless specifically stated otherwise.
G. The following words and terms, wherever they occur in this chapter,
shall be construed as herein defined.
As used in this chapter, the following terms shall have the
meanings indicated:
ALLEY
A right-of-way which affords secondary means of access to
properties abutting upon a street.
BLOCK
A tract of land bounded by streets, or by a combination of
streets and public parks, railroad rights-of-way, or other similar
natural boundaries. A block may be located in part beyond the boundary
lines of the corporate limits of the City.
BUILDING INSPECTOR
The Building and Zoning Officer of the City of Mendota, Illinois,
or his duly authorized representative.
BUILDING SETBACK LINE
A line within a lot or other parcel of land which denotes the area between such line and the adjacent street right-of-way line where a building and other obstructions are prohibited, except those obstructions that are permitted by Chapter
340, Zoning, of the City Code.
CITY
The City of Mendota, Illinois.
CITY CLERK
The City Clerk of the City of Mendota, Illinois.
CITY COUNCIL
The City Council of the City of Mendota, Illinois.
CITY ENGINEER
A professional engineer, registered in the State of Illinois,
who has been duly appointed as the City Engineer of the City of Mendota,
or who has been hired by the City as its consulting engineer.
COLLECTOR STREET
A street which carries traffic from minor streets to arterial
streets, including the principal entrance streets of residential developments
and the principal streets for circulation within such a development.
EASEMENT
A quantity of land set aside over or under which a liberty,
privilege, or advantage in land without profit is dedicated and is
distinct from ownership of land or is granted either to the public,
a particular person, or a combination of both.
FINAL PLAT
A map or plan of a subdivision or a planned unit development and any accompanying material as described in Article
V which will be recorded in the Recorder's office of LaSalle County and/or the City Clerk's office of Mendota.
FRONTAGE ROAD
A minor street which is parallel to and either adjacent to
or within the right-of-way of a thoroughfare.
HALF STREET
A minor street of less than the total required width along
one or more property lines of a subdivision.
LAND IMPROVEMENT
Any sanitary sewerage system, storm sewer system, water supply
and distribution systems, roadway, side-strip, sidewalk, pedestrian
way, no-access strip, off-street parking area, lot grading, or other
improvement which the City of Mendota may require under this chapter.
LOT
A portion of a subdivision or other parcel of land intended
for transfer of ownership or for building development.
LOT, BUTT
A lot at the end of a block and located between two corner
lots.
LOT, DOUBLE-FRONTAGE
A lot which has a pair of opposite lot lines along two substantially
parallel streets.
LOT WIDTH
The width of the lot measured along the minimum building
setback line, except for lots which front on the concave side of a
curving street, where the width of the lot shall be measured 60 feet
back from the front lot line.
MAYOR
The Mayor of the City of Mendota, Illinois.
MINOR STREET
A street of limited continuity. Its primary purpose is to
service abutting properties.
NO-ACCESS STRIP
A land area at least 12 feet wide along the rear lot line
of a double-frontage lot and abutting a thoroughfare within which
no vehicular driveway shall be permitted.
OWNER or SUBDIVIDER
Includes any person, firm, association, partnership, private
corporation, public or quasi-public corporation, or a combination
of any of them, or other legal entity having sufficient proprietary
interest in the land sought to be subdivided or divided to commence
and maintain proceedings under the provisions of this chapter.
PEDESTRIAN WAY
A right-of-way across or within a block designated for pedestrian
use.
PLANNED UNIT DEVELOPMENT
This item refers to an owner or developer intending not to
convey any or all complete title of land for transfer of ownership,
but rather to develop the tract of land into various planned units
or blocks for livable and nonlivable purposes, along with improvements
made upon such land. When such planned development on a tract of land
occurs, and the owner and/or developer requests from the City that
any constructed and/or improved roads, infrastructure utility and/or
other constructed improvements be turned over for ownership and/or
be maintained by the City of Mendota, and if agreed upon by the City,
then said owner and/or developer shall comply with the rules, regulations,
and stipulations of this chapter for making such land improvements
and/or construction. However, the City reserves the right not to accept
any such ownership and/or maintenance for any or all such improvements
and/or construction. If the City declines such ownership and/or maintenance,
then the owner and/or developer may construct such improvements and/or
construction as he (she or they) wishes, as long as all such improvements
and/or construction is in accordance with sound and acceptable engineering
principles, the laws of the State of Illinois, the ordinances of the
City of Mendota, and the law of the federal government.
PRELIMINARY PLAT
A tentative way or plan of a proposed land division or subdivision or planned unit development as described in Article
IV.
ROADWAY
That portion of the street designated for vehicular use.
SIDE-STRIP
The unpaved strip of land within a street right-of-way and
is parallel to the roadway.
SIDEWALK
That portion of the street designated for pedestrian use.
STREET
A right-of-way which affords primary means of access by pedestrians
and vehicles to abutting properties, whether designated as a street,
avenue, highway, road, boulevard, easement or however otherwise designated.
STREET WIDTH
The shortest distance between the right-of-way lines of a
given street.
SUBDIVISION
A.
Defined.
(1)
A described tract of land which is to be or has been divided
into two or more parcels of land;
(2)
Any division of land which creates a lot or parcel for transfer
of ownership and/or building development; or
(3)
The dedication of streets, ways, or other areas for the use
of the public.
B.
Upon approval of the City Council, a certified plat of survey,
signed and sealed by a professional land surveyor in the State of
Illinois and conforming to the applicable provisions of this chapter,
may be accepted in lieu of a preliminary plat or final plat as explained
in the following sections of this chapter. The term "subdivision"
includes resubdivision and, where it is appropriate to the context,
relates to the process of subdividing or to the land subdivided.
C.
A subdivision shall not include the following:
(1)
The sale or exchange of parcels of land between owners of adjoining
and contiguous land.
(2)
The conveyance of parcels of land or interests therein for use
as rights-of-way for railroads or other public utility facilities
and other pipelines, which does not involve any new streets or easements
of access.
(3)
The conveyance of land owned by a railroad or other public utility
which does not involve any new streets or easements of access.
(4)
The conveyance of land for highway or other public purposes
or grants or conveyances relating to the dedication of land for public
use or instruments relating to the vacation of land impressed with
a public use.
(5)
Conveyances made to correct descriptions in prior conveyances.
SUBDIVISION DESIGN STANDARDS
The basic land-planning principles established as guides
for the preparation of preliminary and final plats and engineering
plans.
THOROUGHFARE
A street with a high degree of continuity and which serves
as an arterial traffic way between the various districts of Mendota
and its environs.
