No individual corporation or other legal entity or association
shall place upon public or private property within the Borough of
Kenhorst any dumpster or other similar container, whether permanent
or temporary, without first procuring a permit from the Borough of
Kenhorst.
Section
205-1 shall not be applicable to any business or entity which, in its normal business affairs, uses a dumpster for the disposition of commercial waste accumulated with its business.
The fee to obtain a permit for the use of a dumpster shall be
in such amount as set from time to time by resolution of the Borough
Council.
The location of any dumpster or other similar container within
the Borough of Kenhorst must be approved by an authorized representative
of Borough Council, with due consideration for both vehicle and pedestrian
traffic as well as the safety of persons and property, including any
property adjacent to the location on which the dumpster or other similar
container is to be located. All dumpsters must have reflective, fluorescent
signs posted, and blinking warning lights on the dumpsters, which
shall be visible at night, if container is parked on a public street,
right-of-way or resident sidewalk area.
All dumpsters must be in a good state of repair and shall be
clean and free of offensive odors. The dumpster shall be emptied each
seven-day period regardless of the load capacity. This is to prevent
the accumulation of odors, vermin or other repulsive diseases.
Prior to issuance by the Borough of a permit to place a dumpster
upon a public street, alley, private property, and/or right-of-way,
the dumpster owner or lessor shall execute a hold-harmless agreement
in such form as the Borough shall provide, guaranteeing to defend,
protect, and compensate the Borough as a result of any cause of action
which may be brought against the Borough of Kenhorst.
Any person or persons violating any of the provisions of this chapter shall be punishable as provided in Chapter
1, Article
I, Enforcement; General Penalty, of this Code.
