There shall be a Judge of the Municipal Court who shall be appointed
by the Mayor, with the advice and consent of the Borough Council,
and who shall receive a salary as determined by the annual salary
ordinance and resolution. The Judge shall serve for a term of three
years from the date of appointment and until a successor is appointed
and qualified. A vacancy not caused by the expiration of the term
shall be filled for the remainder of the unexpired term.
The Municipal Court and the Municipal Court Judge shall have,
possess and exercise all the functions, powers, duties and jurisdiction
conferred by state law.
There shall be an Administrator of the Municipal Court, who
shall be appointed by the Mayor, with the advice and consent of the
Borough Council, and who shall receive a salary as determined by the
annual salary ordinance and resolution. The Municipal Court Administrator
shall perform all functions and duties as prescribed by law, by the
rules applicable to municipal courts, by the Municipal Court Judge,
and by the Bergen County Municipal Presiding Judge and/or Bergen County
Municipal Division Manager.
There may be any number of Violations Clerks of the Municipal
Court, as may be determined by the Mayor and Borough Council, who
shall be appointed by the Mayor, with the advice and consent of the
Borough Council, and who shall receive a salary as determined by the
annual salary ordinance and resolution. The Violations Clerk or Clerks
shall work under the direction of the Municipal Court Administrator
and shall perform such functions and duties as required by the Municipal
Court Administrator and/or the Municipal Court Judge.
