A. 
Individual registration for each person engaged in the business of being a peddler within the City of Bridgeton is required. Licenses shall not be transferred from one operator to another.
B. 
An individual applying for a peddler license shall request either a weekend peddler license or a weekly peddler license in the application.
C. 
With the exception of special events, only motorized peddling vehicles shall be allowed to conduct business within the City of Bridgeton. Special event licenses are subject to the additional restrictions of § 254-9H.
D. 
The holder of a peddler's license shall be entitled to operate a peddling vehicle for the calendar year in which it is issued subject to the inspection requirements of § 254-10.
E. 
The Mayor shall grant or deny peddler license applications. If the application is approved, the Municipal Clerk shall issue the license.

F. 
Applications that are denied may be appealed by the applicant to the City Council provided that the request for appeal is filed with the Municipal Clerk within seven calendar days of the denial date. A notification stating the basis for the denial decision shall be sent to the applicant.

G. 
With the exception of special event peddler licenses, licenses shall be renewed yearly, beginning January 1. Licenses shall expire on December 31 of the calendar year issued.
A. 
Applications for a peddler license shall be made to the Municipal Clerk on forms approved by the Business Administrator.

B. 
As necessary for the protection of the public, the application will be referred to the Chief of Police or his designee, to conduct a background investigation into the applicant's business responsibility, moral character and ability to properly conduct a peddler business.
C. 
Supplemental information pursuant to § 254-10 shall be required for all vehicles and food product peddlers.
A. 
No peddler shall operate in City of Bridgeton before 6:00 a.m. or after 9:00 p.m. These time limits shall apply throughout the calendar year.
B. 
No peddler shall operate in the Central Business District (CBD), defined as encompassing Broad Street (Route 49) to the south, North Pearl Street (Highway 77) to the east, Washington Street to the north and Atlantic Street/City Park to the west.
C. 
No peddler shall operate within 250 feet of any existing store within the area permitted herein.
D. 
No peddler shall have an exclusive right to any area or location, nor shall be permitted to operate in any congested area where their operations might impede or inconvenience the public. The judgment of a police officer, code enforcement officer, or zoning officer exercised in good faith shall be deemed conclusive as to whether the area is congested or the public impeded or inconvenienced.
E. 
Peddlers shall not stay at any one location for longer than 15 minutes between sales but must continue moving (at least 200 feet from a prior location) from street to street, except with the express written permission of the property owner having been previously obtained and available for enforcement officers to view.
F. 
Peddler's vehicles (or conveyances) shall not be connected to any utility service.
G. 
No person shall conduct any commercial business in the City Park or recreation areas without prior written approval of the Director of Recreation and Public Affairs.
H. 
When a special event is declared, applicants may apply for a special event peddler's license. This license allows a peddler on foot (or in an approved vehicle) to operate only on the days, times, and at the location(s) specified on the license.
(1) 
A special event may be sponsored by an organization recognized by the City of Bridgeton.
(2) 
The special event sponsor will file an application with the Municipal Clerk and provide a certificate of insurance indemnifying the City of Bridgeton against all claims and naming the City of Bridgeton as an additional insured on the certificate of insurance for the special event.

(3) 
The special event sponsor may request that the Mayor, Business Administrator, or Director of Recreation and Public Affairs waive peddler license fees for additional peddlers/vendors supporting the special event.
(4) 
Special event food vendors are required to comply with Cumberland County Health Department requirements and submit appropriate approvals to the special event sponsor or Municipal Clerk as appropriate.

(5) 
The Municipal Clerk will issue the peddler license upon receipt of all approvals to the special event sponsor or the peddler as appropriate.

A. 
The equipment used or employed by food product peddlers (such as ice cream, beverages, confections, etc.) shall be maintained in a clean and sanitary manner and is subject to the licensing and inspection of the Cumberland County Health Officer or his authorized agent. Any violation found and not immediately corrected shall be grounds for revocation of the peddler's license (§ 254-22).
B. 
Any vehicle used by peddlers shall be licensed and insured with proper verification provided upon application and as may be reasonably requested thereafter. The applicant shall provide verification of insurance coverage for a commercial motor vehicle of no less than the minimum required by law as well as commercial general liability insurance of no less than $1,000,000, and such insurance shall name the City of Bridgeton as an additional insured.
This article shall not be construed to include:
A. 
The delivery of milk, eggs, bread, newspapers or such other necessary and perishable articles of food or merchandise of the type commonly delivered on a house-to-house basis at intervals of less than one week.
B. 
Any veteran or volunteer fireman who holds a special license issued pursuant to N.J.S.A. 45:24-9 shall be exempt from application for a license, but shall be required to comply with all other applicable sections of this article.
