As used in this Article, the following terms mean:
ENTER UNLAWFULLY or REMAIN UNLAWFULLY
A person enters or remains in or upon premises when he or
she is not licensed or privileged to do so. A person who, regardless
of his or her purpose, enters or remains in or upon premises which
are at the time open to the public does so with license and privilege
unless he or she defies a lawful order not to enter or remain, personally
communicated to him or her by the owner of such premises or by other
authorized person. A license or privilege to enter or remain in a
building which is only partly open to the public is not a license
or privilege to enter or remain in that part of the building which
is not open to the public.
TO TAMPER
To interfere with something improperly, to meddle with it,
displace it, make unwarranted alterations in its existing condition,
or to deprive, temporarily, the owner or possessor of that thing.
UTILITY
An enterprise which provides gas, electric, steam, water,
sewage disposal, or communication, video, internet, or voice over
internet protocol services, and any common carrier. It may be either
publicly or privately owned or operated.

A. A person commits the offense of trespassing if he/she knowingly enters
unlawfully or knowingly remains unlawfully in a building or inhabitable
structure or upon real property.
B. Did knowingly enter unlawfully or knowingly remain unlawfully in
a building or inhabitable structure or upon real property that has
been posted with an order to vacate by the Jackson County Missouri
DART (Drug Abatement Response Team), or the City of Buckner. It shall
further be unlawful for any person to:
1.
Use, occupy, maintain or own any premises which fails to comply with the requirements of Subsection
(B)(2) through
(5), inclusive, of this Section, or to cause or permit such use, occupancy, maintenance or ownership, unless this Code expressly accepts that person from having to comply with the requirement.
2.
Enter, occupy, remain or permit or cause any other person to
enter, occupy or remain in any building or structure which has been
posted as unfit for human occupancy order to vacate, unless such person's
presence is authorized by the City of Buckner or by Jackson County
DART.
3.
Remove or deface any order to vacate which is posted upon any
premises.
4.
Permit a building which has been temporarily closed to remain
vacant and unrepaired for more than 150 days after the date of issuance
of the order to vacate.
5.
Refuse to admit an authorized person into a structure or premises
when such person is in lawful possession of a search warrant authorizing
entry into such building or structure.
6.
Every day that a violation continues shall be considered a separate
offense, for which the violator may be arrested, tried and convicted
without necessity for further notice.
C. A person does not commit the offense of trespassing by entering or
remaining upon real property unless the real property is fenced or
otherwise enclosed in a manner designed to exclude intruders or as
to which notice against trespass is given by:
1.
Actual communication to the actor; or
2.
Posting in a manner reasonably likely to come to the attention
of intruders.
3.
This Subsection does not apply to governmental officers or employees
when carrying out a governmental function.
D. Any person found guilty of any provision of this Section shall be
deemed guilty of an ordinance violation and shall be subject to a
fine of up to five hundred dollars ($500.00) and/or incarceration
for a term not to exceed ninety (90) days.
A person commits the offense of reckless burning or exploding
if he/she recklessly starts a fire or causes an explosion and thereby
damages or destroys the property of another.

A person commits the offense of possession of burglar's tools
if that person possesses any tool, instrument or other article adapted,
designed or commonly used for committing or facilitating offenses
involving forcible entry into premises, with a purpose to use or knowledge
that some person has the purpose of using the same in the commission
of an offense of such character. Upon conviction under this Section,
all such tools become the property of the Buckner Police Department.
